HomeMy WebLinkAbout2000-02-02 Conservation Commission Minutes r4 1 Conservation Commission Minutes DPW Conference Room February 2,2000 Members Present: Albert P Manzi, Jr , Chairman, Deborah Feltovic, Beth Wescott, John Mabon, Robert Mansour and James Demotses, Associate Scott Masse, Vice Chairman and Joseph Lynch were absent Staff Present: Richelle L Martin, Conservation Administrator and Brian J LaGrasse, Conservation Associate The meeting was called to order at 7 00 p m Minutes: No minutes were accepted General Business: 242-898 Amendment to Order of Conditions-Lot 4/5 Willow Street(Channel Bldg) This amendment request is for a location change of the transformer and its associated containment area that will hold double the amount of oil contained within the transformer The new location change proposes the transformer pad 30' from the wetland boundary The commission stated that the transformer and containment area is considered a structure and would encroach upon the 50' No Construction Zone This would require a waiver not previously requested or granted Gregory Wiech from Channel, stated that they should be exempt from the 50' No Construction Zone because the transformer should be considered a utility and not a structure Beth Wescott stated that it is a structure and needs to be kept out of the 50' No Construction Zone Greg Wiech stated that they needed to have paved access to the transformer to meet Mass Electric standards and to meet those standards they had to propose it in this location Beth Wescott stated that they had not explored all possibilities and suggested that they do She stated that they put the transformer inside the building or find a new location on site John Mabon motioned to deny the amendment request Seconded by Deborah Feltovic Unanimous vote 242-428 COC Lot I #1171 Turnpike Street(Jay Burke) An Order of Conditions was issued on 9-28-87 authorizing construction of a self storage facility. The 25' No Disturbance Zone and 50' No Construction Zone were mandated and met The Conservation office is in receipt of a P E stamped letter and as-built certifying compliance. Staff from the Conservation Department visited the site on 2/1/2000 and has no issues The Bond is $500 On a motion by Beth Wescott, seconded by John Mabon, the Commission voted unanimously to issue a Certificate of Compliance for DEP #242-428 � 1 I 242-026 PCOC-Lot 19 #146 Olympic Lane (Hatem&Mahoney) This Order of Conditions was issued in May of 1979 authorizing construction of Olympic Lane and Ingalls Crossing This lot was not jurisdictional Staff from the Conservation Department visited the site on 2/1/2000 and has no issues On a motion by Deborah Feltovic, seconded by John Mabon, the Commission voted unanimously to issue a Partial Certificate of Compliance for DEP #242-026 242-055 PCOC-Lot 5 #49 Crossbow Lane (Daniel Bowes) This Order of Conditions was issued in May of 4/30/79 authorizing construction of a 5 5 acre pond Staff from the Conservation Department visited the site on 2/l/2000 and has no issues On a motion by Deborah Feltovic, seconded by Beth Wescott,the Commission voted unanimously to issue a Partial Certificate of Compliance for DEP #242-055 Draft Open Space and Recreation Plan On behalf of The Open Space Committee, Richelle L Martin presented draft copies of the Open Space Plan to the Commission members for their review and letter of support to accompany the plan submitted to EOEA by March, 1, 2000 As it is not yet 8:00 p.m. the Commission took a recess. Public Hearings (8:00) Request for Determination of Applicability 83 Lost Pond Lane (Leah Basbanes) This RDA is for the extension of an extension of and existing addition consisting of only one sono tube which is proposed 88' from the wetlands Erosion control is proposed on the plan The wetland line is accurate on the plan as confirmed in the field No abutters present On a motion by Johm Mabon, seconded by Deborah Feltovic,the Commission voted unanimously to issue a negative determination Notice of Intent(s) 242-996 1812 Turnpike Street(The Equestrian Shop)(Allen& Major) cont fr 1/5/2000 Richelle L Martin stated that the Conservation Department has not received revised plans with the changes requested. The changes requested were moving the erosion control outside the 25' No Disturbance Zone and adding the soil stockpile and dewatering locations Coler and Colantonio need more information to complete the drainage review They need the TSS calculations, test pit logs and the 100-year flood elevation The applicant mentioned that the hay bale line was on the 25' No Disturbance Zone line and Beth Wescott suggested shrinking the building 6"and not to move the hay bale line into the No Disturbance Zone The applicant requested a continuance to the 3/15/00 meeting so Coler and Colantonio would have sufficient time to complete the drainage review with c the new information The Commission instructed the applicant to renotify the abutters because the next hearing will be more than 30 days On a motion by Robert Mansour, seconded by Deborah Feltovic, the Commission voted to continue until March 15, 2000. 242-991 —Lot 9 Willow Street(MHF Design) They are adding a structure to meet the TSS removal rate The only remaining issue is the floodplam and that is not resolved yet Mark Gross is waiting for Jim Rand to return his call to determine whether or not Willow Street overflowed during the October of 1996 storm On a motion by Johm Mabon, seconded by Deborah Feltovic,the Commission voted to continue until March 15, 2000 On a motion by Robert Mansour, seconded by Deborah Feltovic,the Commission voted to continue until March 15, 2000 242-???—500 Great Pond Road (Irrigation Consultants) J
