The meeting was called to order at 7 p.m by Scott Masse, Chairman
Minutes: Scott Masse made a request to approve the June 21,2000 minutes as drafted. A
motion was made by Albert Manzi to approve the June 21, 2000 minutes as drafted and this
was seconded by Beth Wescott The vote was unanimous
General Business:
242-879 Extension to OOC - 7A Old Cart Way (Thomas Neve)cont fr 9/6/00
Attorney James Senior was present and stated that the litigation in question had been
resolved in August of 2000 No work has commenced on this project due to this litigation
This Order was issued on 10/1/97 authorizing the construction of a single family dwelling,
associated appurtenances within the Buffer Zone to a BVW and certified vernal pool Brian
LaGrasse stated the site has been reflagged and he did not have any issues on this project
The extension request would extend the Order of Conditions through 10/1/2001 Scott
Masse asked if the applicant would be looking to get any Modification to the Order of
Conditions at any time Attorney Senior stated that as far as he knows they wouldn't be A
motion was made by Albert Manzi and seconded by Joseph Lynch to grant the Extension to
Order of Conditions for 242-879 and the vote as unanimous
242-940 COC - 400 Osgood St (William Bamster)(Joseph Serwatka,P E)cont fr 9/6/00
This was continued from our last two meetings requesting submittal of revised plans with
the Buffer Zones removed from around the detention pond As of today we are still awaiting
these revised plans A motion was made by John Mahon and seconded by Joseph Lynch to
continue 242-940 to our meeting of 10/4/2000 The vote was unanimous.
242-920 Modification to OOC - Executive Quarters (Mesita Dev)cont fr 9/6/00
Brian LaGrasse advised the Commission that this was continued from our last meeting so
applicant could submit revised plans with the transformer pad outside the 50' NCZ These
plans have been submitted and transformer and chiller are now placed outside the 50' NCZ
It will be a 65 ton chiller that will be air cooled The compressor will be located inside the

chiller and you would hear a noise like a fan from the chiller Joseph Lynch made a motion
to deem this a moderate modification and this was seconded by Beth Wescott At this point
John Mabon questioned why it would be considered a moderate modification? Joseph
Lynch stated he was concerned about the noise emitted from this transformer and Beth
Wescott was concerned about the parking lot now Albert Manzi felt that we needed more
information We need a sketch of what the transformer and chiller will look like,the
acoustics, we need an Operation& Maintenance Plan for snow removal and also report on
aviary life
Joseph Lynch withdrew his motion and recommended a continuance for more information to
our meeting of 10/4/00 and this was seconded by Beth Wescott The vote was unanimous
242-1016 COC -20 Abbott St (Christopher Sawyer)(MHF Design Consultants)
This Order was issued on 6/7/00 authorizing the re-construction of a stone wall and
mitigation plantings within the Buffer Zone of a BVW They have submitted stamped As-
Builts from the surveyor. Brian LaGrasse visited the site on 9/19/00 and had no issues. The
plantings are satisfactory Albert Manzi also went on site on 9/20/00 and had no issues A
motion was made by Albert Manzi to grant the COC for 242-1016 and release the $1,500
Bond and this was seconded by Beth Wescott The vote was 3 for and one abstained-
Joseph Lynch.
242-820 Extension to OOC - Raleigh Tavern Lane(Coolidge Construction)
This Order was issued on 10/16/96 authorizing the construction of a roadway, detention
pond, two single family dwellings and associated appurtenances within the Buffer Zone to a
BVW One extension permit has been issued extending the Order of Conditions through
10/16/2000 This extension request will extend the Order of Conditions through
10/16/2001 This October will be the completion of the second growing season for the
replication area Brian LaGrasse stated that this project is Just about complete Brian visited
the site on 9/19/2000 and had no issues There are no violations on site Brian LaGrasse
recommended we grant the Extension to Order of Conditions for 242-820. A motion was
made by John Mabon and seconded by Albert Manzi to Extend the Order of Conditions for
242-820 until 10/16/2001 The vote was unanimous
242-1000 Modification to OOC - 173 Coachman's Lane(Hancock Eng)
Brian LaGrasse informed the Commission that this Order of Conditions was issued on
3/15/2000 for the construction of an addition, blue stone patio and fire pit The modification
is for the approval of another addition/storage shed to the northeast corner of the house The
addition is outside the 50' NCZ Julie Parrmo of Hancock Engineering was present for the
applicant Brian had no issues with this modification and recommended we issue it A
motion was made by Albert Manzi to grant the Modification to Order of Conditions for 242-
1000 and this was seconded by Joseph Lynch The vote was unanimous.

242-966 Modification to OOC - 351 Willow St - Bake-n-Joy(Thomas Neve Assocs )
Tom Neve was present for this project Brian LaGrasse stated that this Order was issued on
9/1/99 authorizing the construction of an addition and enlargement of the front parking lot
within the Buffer Zone to a BVW The modification is for connecting the concrete pad to
the existing foundation The pad itself is in the 50' NCZ as is the additional work proposed
They also want to raise the pad elevation approximately 6" No mitigation has been
proposed for the work in the NCZ
Tom Neve informed the Commission that applicant wishes to bring in new piping
underground into the pad They would trench back into pad and then into the building The
systems are already in place. Beth Wescott would like to see a drawing showing how the
pad would be extended Joseph Lynch stated they were within a couple of feet to the
resource area. He is concerned about containment of the equipment on the pad
Commission would like to see a cross-section shown on the new Plan to be presented They
would also like applicant to show what type of equipment will be placed on the pad Albert
Manzi asked would mitigation be done? Tom Neve stated he would ask his client that
question A motion was made by Albert Manzi and seconded by Joseph Lynch to continue
242-966 in order to gather the above information The vote was unanimous
242-486 COC -Liberty Hills II (George Secchiaroli)(Robert P Morris, RPLS)
Brian LaGrasse informed the Commission that this Order was issued on 12/28/88
authorizing the construction of the roadways,utilities and drainage facilities within the
Buffer Zone to a BVW The Order of Conditions permitted a wetland crossing and a 2,250
s f wetland replication area Brian advised the Commission that they have not submitted a
letter from the engineer certifying compliance with the Order of Conditions A motion to
continue to 10/4/00 was made by Joseph Lynch and this was seconded by John Mabon. The
vote was unanimous
242-852 COC - Lot 3A-1 Rea Street(Chuck& Denise Romano)(Burton S Kliman, Esq )
This Order was issued on 3/20/97 authorizing the construction of a single family dwelling,
driveway, associated appurtenances and septic system within the Buffer Zone to a BVW and
outer riparian zone of Mosquito Brook The As-Built submitted is deficient according to
Brian LaGrasse per Condition#40 of the Order of Conditions They have not submitted the
recording information of the Conservation Restriction as mandated per condition#47 of the
Order of Conditions Brian LaGrasse recommended denial of this COC for 242-852 A
motion was made by Joseph Lynch to deny the COC for 242-852 and this was seconded by
Albert Manzi The vote was unanimous

242-1005 COC - 146 Olympic Lane (N E Engineering)
Brian LaGrasse informed the Commission that this Order was issued on 4/5/00 authorizing
the replacement of a septic system within the Buffer Zone to a BVW They have submitted
stamped As-Builts and a letter from the engineer certifying compliance with the Order of
Conditions. The 25'/50' were mandated and met Brian visited the site on 9/18/00 and had
no issues The site is stable. There are no violations on site The Bond is $1,500. Brian
LaGrasse recommended we issue a COC and release the$1,500 Bond A motion was made
by Joseph Lynch to issue a COC for 242-1005 and release the $1,500 Bond and this was
seconded by John Mabon. The vote was unanimous.
Public Hearings:
Request for Determination of Applicability
411 Pleasant Street(Scott& Patricia Massey)(William Barrett Homes)
Proof of mailings were presented for the above project Bill Barrett was present This RDA
is for the construction of a single family home, grading and associated appurtenances within
the Buffer Zone to a BVW The house is proposed 92' and the erosion control is proposed
at 75' The only issue Brian had is that the erosion control detail on the plan submitted is
backwards Bill Barrett is asking for a negative determination Joseph Lynch would like the
25'/50' zones shown on the plan Albert Manzi would like stamped notices of protective
areas with erosion controls to be posted A negative determination for 411 Pleasant Street
was made by Albert Manzi and this was seconded by John Mabon. The vote was
unanimous
Lot 129C Waverly Road(Stephen Smolak)(Christiansen& Sergi)
This item was tabled until later in the evening as there was no one in attendance at the time
Weir Hill Reservation/Stevens Street(The Trustees of Reservations)
Wayne Castonguay presented and Bob Morey Superintendent of Trustees was in attendance
This project is to temporarily house sheep for as long as ten days but more likely 2 days at a
time to graze within 50' of a BVW surrounding an intermittent stream as part of a vegetation
management project They are proposing a paddock/temporary fenced off area for the 300
to 500 sheep The Commission wanted to know if the Mass Bylaw applied to this type of
activity. Albert Manzi stated that this project qualified as an agricultural project and that
they were allowed to go up to the 25' zone This meadow is mowed for hay every year and
therefore qualifies as an agricultural area. Albert Manzi made a motion that this project be
exempt from the Mass Bylaw and this was seconded by Joseph Lynch The vote was
unanimous

This RDA would be subject to the No Andover Wetland Protection Bylaw Act and Joseph
Lynch made a motion to approve a negative determination for this RDA with an
environmental monitor to oversee this project and this was seconded by John Mabon. The
vote was unanimous
137 Kara Drive(Mark Mosier)
This RDA was incomplete and therefore not heard this evening.
Lot 129C Waverly Road(Stephen Smolak)(Christiansen& Sergi)
Proof of mailings were presented Gene Willis was present representing Christiansen&
Sergi This RDA is for grading and erosion control within the Buffer Zone to an Isolated
Vegetated Wetland. The house and driveway are proposed outside the 100' Buffer Zone
The shed is to be moved outside the 50' zone WPI delineated the wetlands in April, 2000
John Mabon moved to issue a negative determination for Lot 129C Waverly Road with pre-
construction and erosion control measures to be in place and this was seconded by Beth
Wescott The vote was unanimous
242-1020 492 Sutton St (Mass Aeronautics Com)(Dufresne-Henry, Inc)cont fr 9/6/00
Brian LaGrasse informed the Commission that we are still awaiting the escrow account to be
posted Scott Masse, Chairman would like this project continued to 10/4/2000 to more fully
see Patrick Seekamp's review A motion was made by Albert Manzi and seconded by Beth
Wescott to continue 242-1020 to 10/4/2000 The vote was unanimous
242-1036 1070 Osgood Street(Chas Senabunyarithi)(Thomas Neve Assocs)cont fr 8/16/00
Brian LaGrasse stated this project proposes the construction of a 3,400 s f restaurant,
driveway, associated parking, utilities, and stormwater management structures The project
also includes 300 s f of wetland alteration, 1,800 s f of wetland replication and a waiver
request from the 25' NDZ The waiver for the 25' NDZ is for grading, parking, driveway,
and stormwater infiltration chambers They are requesting a 0' No Disturbance Zone
They just submitted revised plans on 9/15/2000 which is not within the 7 day submittal
period Per Scott Masse and Tom Neve we would only be discussing the previous plans
submitted prior to 9/15/2000 This old lot pre-existed the Wetland Protection Act and the
Wetland Protection Bylaw
Michael Howard of Epsilon Associates spoke and informed the Commission that he saw the
site plan revisions on his 2°d site visit on September 8, 2000 This revised plan is at 20 scale
and reduces the building by 400'and is now outside the 50' zone Applicant needs to set up
a 2►' escrow account so that Epsilon can complete the 2nd aspect of the review. Joseph

Lynch made a motion to set up an additional $3,500 in escrow for this project and this was
seconded by Albert Manzi The vote was unanimous
At this point Joseph Lynch stated that he holds firm about the parking area proposed. Mr.
Lynch then made a motion to reconsider the escrow amount just passed and this was
seconded by Albert Manzi That vote was unanimous. The Commission stated that both
plan scenarios should meet stormwater management plan Joseph Lynch then moved to re-
establish the $3,500 escrow amount and this was seconded by Albert Manzi This vote was
unanimous
In order to properly evaluate the new plan submitted on 9/15/00 a motion was made by
Joseph Lynch to continue this project to our meeting of 10/4/00 and this was seconded by
John Mabon. The vote was unanimous
242-1026 Lot 33 Abbott St (No Andover Land Corp)(N E Eng)cont fr 9/6/00
Ben Osgood, Jr presented This was continued from our last meeting so that they could
submit copies of their easements intention, a septic system alternatives analysis and a
revised mitigation plan
They have submitted a copy of the easement and they have also submitted a statement
saying that in their opinion a septic system is not a viable alternative due to the size
limitation of the site and would not meet all the setbacks They further state that they will
not design a septic system that will not be approved by the Town The applicant also needs
some evidence from the BOH that they can't put a septic system in
The Commission referenced Ben Osgood's letter of 8/30/2000
Alternative 1 This is for a gravity force main This is not a viable alternative due to the
cost involved Mr Manzi had suggested a possible cost-sharing proposal from the other
owners
Alternative 2 This was to connect property to the new sewer line at the intersection of
Nutmeg Lane and Abbott Street This line cannot be accessed by gravity Ben Osgood
stated that DPW wouldn't allow a single user force main in the public way for a new home
The Conservation Commission asked that Ben submit a letter from DPW to this affect
Alternative 3 Requests to install a private force main in the existing sewer easement that
runs between Abbott St and Nutmeg Lane This is the preferred alternative that Ben would
like to see happen
Alternative 4 Install a septic system This alternative has been investigated per Ben in the
past, and it has been determined that the site does not have sufficient area outside the 100'
BZ to install a septic system Ben needs to get a letter from the BOH to that affect.

The alternative analysis would have to be exhausted in order for the Conservation
Commission to grant a waiver Albert Manzi feels that the applicant could facilitate the cost
of this sewer A motion to continue 242-1026 to 10/4/2000 was made by Joseph Lynch and
this was seconded by John Mabon The vote was 3 for and Beth Wescott abstained from
this vote
242-1028 39 Hawkins Lane (Maureen& Thomas Scott)(Merrimack Eng)cont fr 9/6/00
This NOI was continued from the last meeting so they could submit updated plans with the
new driveway easement This NOI is for the construction of a driveway, grading and
appurtenances within the BZ to a BVW The house and septic system are proposed out of
the 100' BZ Brian walked the site and confirmed the wetland line The erosion control is
depicted in an appropriate location They meet the 25'/50' setbacks The driveway and
erosion controls are proposed along the 25' NDZ and both must be kept outside of the NDZ
Brian had no issues with this project The work proposed is just outside the outer riparian
zone No abutters were present for this project A motion was made by Joseph Lynch to
close the public hearing and issue a decision for 242-1028 in 21 days and this was seconded
by John Mabon The vote was unanimous
242-1032 127 Bridle Path(George Chatson)(Thomas Neve Assocs.)cont fr 9/6/00
This NOI is for the construction and installation of proposed drainage improvements to the
existing property within the BZ to an Isolated Vegetated Wetland The proposal includes
connecting all gutter downspouts to subsurface drainage pipes that will discharge to the
existing catch basin on Bridle Path, the existing 4" sump line will be abandoned, regrading
around the foundation and the filling in of a 520 s f area in the wetland A groundwater
interceptor trench is also proposed behind the house as a contingency plan
The Conservation Commission walked the site and had a few comments and ideas. Albert
Manzi mentioned a french dram as an alternative Mr Manzi also thought that the sump
pump is in a poor location now
Tom Neve was present and stated that the problem is surface water and ground water The
grading was done toward the house instead of away from the house If the grading is done
properly there will be a 1%pitch. They need to show micro-grades to the Conservation
Commission The Conservation Commission wants the aquatic area left alone They
recommended just plugging up the pipes and leaving the aquatic area alone
Beth Wescott wants to see a very detailed construction plan especially where equipment
being brought in is concerned
Joseph Lynch asked does water behind garage area really get up to 3 feet in depth after a
rainstorm? Tom Neve thought it was more 3 or more inches rather than feet.

John Mabon stated that the backyard area seemed to have mounds- some going toward the
house and some going toward the wetlands Mr Mabon would have an easier time
approving the plan if offered plantings and buffering down to the wetlands A motion was
made by Albert Manzi to continue to 10/4/20,00 to get a more detailed alternatives analysis
and this was seconded by Beth Wescott The vote was unanimous
242-1030 96 Sugarcane Lane (Todd& Karen Clark)(Scott Giles)cont fr 9/6/00
No abutters were present for this project This NOI is for the expansion of an existing deck
and sidewalk addition within the Buffer Zone to a BVW The plan has been corrected and is
accurate per Brian LaGrasse The proposed deck meets the 50' NCZ Brian feels that the
erosion control should be located at the top of the retaining wall instead of at the bottom
There is dense vegetation at the bottom of the retaining wall and it is really close to the 25'
NDZ Scott Giles was present for this project and was asked to submit new erosion control
plans for our meeting of 10/4/2000 and Brian LaGrasse would have a draft Order of
Conditions decision ready that evening A motion was made by Beth Wescott to continue
242-1030 to our 10/4/2000 meeting and this was seconded by Albert Manzi The vote was
unanimous
242-1029 440 Marblendge Road (Michael&Mary Borzi)(Scott Giles)cont fr 9/6/2000
Brian LaGrasse informed the Commission that this NOI is for the construction of a deck
within the Buffer Zone to a BVW This was continued from our last meeting of 9/6/2000 in
order for the engineer to submit revised plans To date we have not received them and Scott
Giles, engineer has asked for a continuance to our 10/4/00 meeting The size of the deck
will be 12'X20' and it will be cantilevered A motion was made by Joseph Lynch and
seconded by John Mabon to continue 242-1029 to our meeting of 10/4/00 and the vote was
unanimous.
242-1033 110 Laconia Circle(Currier Env/Dave Currier)(Hancock Engineering)
Proof of mailings were presented This NOI is the result of an Enforcement Order issued to
Currier Environmental for doing unauthorized work within the Buffer Zone to a BVW
without approval of the Conservation Commission The work performed was the
replacement of a septic system A Cease & Desist Order was delivered on 8/10/2000 Julie
Parrino of Hancock Engineering was present and asked that the $4,500 fines be waived The
Conservation Commission agreed that the fines would not be waived The fine will run
from 8/10/2000 to 9/5/2000
Brian LaGrasse wants to lift the Cease & Desist Order and write up an Enforcement Order
requesting that they stabilize the area, grade the area, hydroseed it and rebuild the brick
walkway A motion was made to close the public hearing and issue a decision in 21 days by
Joseph Lynch and this was seconded by Albert Manzi The vote was unanimous '

242-1034 210 Farnum Street(Susan& Charles Behveau)(Merrimack Engineering)
Proof of mailings were presented No abutters were present for this project Bill Dufresne
was present for Merrimack Engineering This NOI is for the construction of a replacement
septic system and associated grading within the Buffer Zone of a BVW Brian LaGrasse
informed the Commission that this is a very tight site and the wetlands are very close on all
sides The septic tank itself is within 50' from the wetlands but they are in the process of
revising the plans This house would never be permitted today It was felt by the
Commission that the BOH would allow closer inclusion of septic system at 7' from
foundation
Bill Dufresne asked that since this is a failed septic system would he be allowed to present
the revised plans tonight to the Commission? The Commission allowed this and a motion to
close and issue a decision for 242-1034 in 21 days was made by Albert Manzi and this was
seconded by Joseph Lynch The vote was unanimous
242-1035 399 Summer Street(Lori &Jake Steigerwald)(Memnack Engineering)
No abutters were present for this project Proof of mailings however, were presented This
NOI is for the construction of a replacement septic system and associated grading within the
Buffer Zone of a BVW This project is also a very tight site and very close to the wetlands
on all sides They have erosion controls proposed along the 25' NDZ Right now the lawn
goes up to the wetlands for the most part The owner's are moving and are anxious to have
this project completed A motion was made by Albert Manzi and seconded by John Mabon
to close the public hearing on 242-1035 and issue a decision in 21 days The vote was
unanimous
242-1037 1210 Osgood Street(Forgetta Development)(Epsilon Associates)
No abutters were present for this project Mike Howard of Epsilon Associates presented this
project Bill Barrett is the developer for this project Chris Huntress was also present for
this project This NOI is for a mixed use development within the Buffer Zone to a BVW
They are proposing an office building, a 102 room hotel, a retail building and a sewer force
main on Rte 125 The 25' NDZ and 50' NCZ are met for the proposed buildings and
development They are requesting a waiver of the 25'NDZ for the force main,which is
proposed in the existing pavement of 125 and the demolition of the existing greenhouses and
sheds The mitigation report is sufficient Brian LaGrasse walked the site and confirmed
the wetland line Erosion control is depicted in an appropriate location
It was decided that an Escrow Account needed to be set up Albert Manzi moved to
establish an escrow account of$2,000 and this was seconded by Joseph Lynch. The vote
was unanimous Since Coler& Colantonio received this project on September 11,2000
there was not enough time to review it Therefore a motion to continue 242-1037 to our

meeting of 10/4/00 was made by Joseph Lynch and this was seconded by Albert Manzi. The
vote was unanimous
242-1038Barker Street(Tara Leigh Development,LLC)(Epsilon Associates)
Chris Huntress,Mike Howard and Tom Zahoruiko were present for this project This NOI is
for the construction of a cross country sewer line and stormwater management system within
the Buffer Zone to a BVW The cul-de-sac roadway and the seven lots are out of the 100'
Buffer Zone They are requesting a waiver of the 25' NDZ for the sewer line near wetland
flags H1 through H6 They are proposing 508 s f of temporary alteration 342 s f is
vegetated and 166 s f is manicured lawn They are proposing to restore it in kind The
wetland lines were approved through an RDA previously. Brian LaGrasse stated that the
erosion control seems to be depicted in appropriate locations Coler& Colantonio will be
doing the review for this project There is already a$1,000 escrow account established,
however, another escrow account needs to be established for drainage review in the amount
of$2,000 A motion was made by Albert Manzi to establish an additional escrow account in
the amount of$2,000 and this was seconded by Joseph Lynch The vote was unanimous
At this point a motion was made by Joseph Lynch and seconded by Albert Manzi to
continue 242-1038 until our meeting of 10/4/00 The vote was unanimous
Decisions:
242-1028 Hawkins Lane
This NOI was approved for construction of a single family house, driveway, grading and
associated appurtenances within the Buffer Zone to a BVW The Order of Conditions
includes A row of double staked hay bales backed by trenched siltation fence to be placed
between all construction areas and wetlands A minimum of 15 extra hay bales and
sufficient stakes for staking these bales A check payable to the Town of North Andover in
the amount of$3,000 as a Bond There were no waivers on this Order of Conditions The
As-Builts are to have the engineer's and land surveyor's signatures. A motion was made by
Albert Manzi to accept the Order of Conditions for 242-1028 as drafted and this was
seconded by Joseph Lynch The vote was unanimous
242-1011 Boston Ski Hill
This NOI was approved for the construction of a roadway,two Condominium Buildings,the
demolition of existing structures and a 25' No Disturbance Zone restoration within the
Buffer Zone to a Bordering Vegetated Wetland The Order of Conditions includes.
In order to prevent any alteration of wetland resource areas a 25' NDZ and a 50'NCZ shall
be established from the edge of the adjacent wetland resource area except for the demolition
of existing structures and the 25' NDZ restoration.

The NACC finds the applicant's proposal for 13,675 s f of wetland restoration to be
adequate
A minimum of 200 extra hay bales covered on-site and sufficient stakes for staking these
bales (or an equivalent amount of silt fence)
A check payable to the Town of North Andover shall be provided in the amount of$61,025
as a Cash Bond and due to the combination of Paxton soils, steep grades and shallow ground

The applicant shall designate a professional Wetland Scientist as an"Erosion Control
Monitor"to oversee any emergency placement of controls and regular inspection or
replacement of sedimentation control devises Credentials of said Erosion Control Monitor
(prior to designation) shall be submitted for review and subsequent approval by the NACC
or an Agent thereof This person shall be given the authority to stop construction for erosion
control purposes
At least once per day during which construction activities occur on-site and for as long
thereafter as ground remains unstabilized,the "Erosion Control Monitor" shall contact the
NACC or agent thereof and verbally submit a daily update At least once during each week
in which construction activities occur on-site and for as long thereafter as ground remains
unstabilized, the applicant shall submit a written report from the"Erosion Control Monitor"
to the NACC at the end of each week certifying that, to the best of his/her knowledge and
belief based on a careful site inspection, all work is being performed in compliance with the
Order of Conditions and that approved setbacks are being adhered to
All catch basins shall contain oil/gasoline traps and Cascade Covers
As soon as the drainage system is on line,Bi-annual (April lst and October 1s) inspection
reports must be submitted by a Registered Professional Engineer
There shall be no stockpiling of soil or other materials within 25' of any resource area The
toe of any stockpile of soil shall be no closer in distance to the NDZ than the total height of
the stockpile itself measured from the toe to the crest
No trash dumpsters will be allowed within 50' of areas subject to protection under the Act or
local ByLaw
An annual Affidavit that the O&M Plan has been carried out, including proof such as
invoices of catch basin cleaning and street sweeping shall be submitted to the NACC by no
later than April 1 st This shall be a perpetual condition

The Commission also agreed that the Order of Conditions be incorporated into the Condo
Documents A motion was made by Albert Manzi to accept the Order of Conditions as
drafted and amended and this was seconded by Beth Wescott The vote was unanimous

At this point Scott Masse asked that the Conservation Commission appropriate $2,500 from
the Wetland Filing Fee Account for Michael Howard of Epsilon Associates to come into the
Conservation Office and help with reviews and training A motion was made by Joseph
Lynch to appropriate the $2,500 and this was seconded by John Mabon The vote was
unanimous
A motion to adjourn was made by Joseph Lynch at 12:30 a.m. and this was seconded
by Beth Wescott. The vote was unanimous.
