The meeting was called to order at 7 p in by Scott Masse, Chairman

General Business:
242-991 Bond Reduction- 140 Willow Street(Dutton& Garfield)
This Order was issued on 3/1/00 authorizing the construction of a 7,344 s f two story office
building, parking lot, drainage structures, wetland replacement areas and necessary
appurtenances within the Buffer Zone to a BVW, Bank, Land Under Water,Riparian Zones
to Mosquito Brook and BLSF A waiver of the 25' NDZ was granted for the construction of
the detention pond and 14,985 s f of wetland replication was approved The wetland
replication was recently planted and passed a pre-construction inspection The applicant is
asking for a Bond Reduction,however, the Commission's views are not favorable on partial
bond releases for projects of this nature and Brian LaGrasse had discussed this with the
applicant but the applicant desired to appear before the Commission
Since the plantings have only been in for 30 days the Commission stated it needed to
complete a 2 year growing season per Order of Conditions At this point Albert Manzi made
a motion to deny the Bond Reduction for 242-991 and this was seconded by Deborah
Feltovic The vote was unanimous
242-927 Partial Bond Release— 80 Campbell Road (Hancock Env)cont fr 9/6/00
Julie Parrino of Hancock Environmental presented asking for a release of$3,000 of the
$4,500 Bond being held Brian LaGrasse informed the Commission that this Order was
issued on 9/17/98 authorizing the construction of a barn and horse paddock within the BZ to
a BVW Brian visited the site on 9/6/00 and the project is complete and the site is stable
There are no violations on site Scott Masse, Chairman recommended partial release of
Bond being held A motion was made by Albert Manzi to release $3,000 of the Bond being
held for 242-927 and this was seconded by Deborah Feltovic The vote was unanimous

242-17 PCOC -Lot 3 Bridle Path Lane (Diane Matses)(Domenic Scalise, Esq )
Brian LaGrasse informed the Commission that this Order was issued on 1/3/77 authorizing
the construction of Bridle Path Lot 3 is all wetlands Apparently Lot 3 and 4 have been
combined to create one buildable lot Brian inspected the property on 10/3/00 and had no
issues The lot is wetlands and there are no violations on site There is no Bond This
seems to be an administrative issue only Deborah Feltovic made a motion to grant a PCOC
for 242-17 and this was seconded by Albert Manzi The vote was unanimous
242-940 COC -400 Osgood Street(William Banister)(Joseph Serwatka, P E)cont fr 9/20/00
This was continued from our last meeting for the submittal of revised plans with the buffer
zones removed from around the detention pond. The plans requested have been submitted
and are satisfactory Brian LaGrasse stated that this Order was issued on 12/3/98
authorizing the construction of a parking area and a stormwater management basin within
the Buffer Zone to a BVW They have submitted stamped As-Builts and a letter from the
engineer certifying compliance with the Order of Conditions The 25'/50' were mandated
and met except at the entrance where the existing gravel drive was paved The site is stable
The Commission stated that the applicant needs to install signs for No Disturbance Zone and
No Stockpiling Zones before they can issue a COC. A motion was made by Deborah
Feltovic to continue 242-940 to our meeting on 10/18/00 and this was seconded by Albert
Manzi. The vote was unanimous
Robert Mansour excused himself from the meeting at this point and since we didn't
have a quorum at that point the meeting was haulted until his return 5 minutes later.
242-920 Modification to OOC - Executive Quarters(Mesrti Dev)cont fr 10/4/00
This was continued from the last meeting so they could submit information regarding noise
specifics regarding the chiller. They have submitted a packet and letter from Jeffrey
Fullerton, a sound consultant from Acentech, Inc and a letter from Mark West regarding the
noise levels of the chiller and their impact The sound consultant does not predict any
adverse effects but would recommend a stockade fence reinforced with 1/4"plywood to
surround the chiller and act as a solid barrier With the stockade fence the noise levels in the
wetland would be 55 dBA and further reduced by requesting that the chiller be specified to
have sound reduction option for the compressor Mark West states that the increase in noise
from the chiller will not have a negative impact on aviary wildlife
This modification is for a change in the location of the transformer pad and chiller. They are
not proposed within the 50' NCZ The 25' NDZ is met on the proposed plans The erosion
controls are in the same location Robert Mansour asked if there was a reason why there is

an opening in back of the stockade fence surrounding the chillers The answer was that it
was for maintenance purposes They need 5 feet all around entire chiller on the inside of the
fence for maintenance purposes Mr Mansour wanted to see the gate in the stockade fence
moved away from the detention basin Ken Ahern stated that they could flip it around so
that no vehicles would be allowed near the detention basin A motion was made to grant the
Modification to Order of Conditions for 242-920 by Deborah Feltovic accepting Plans dated
6/30/98 and REV 9/20/00 and incorporating letter from Jeffrey Fullerton and letter from
Mark West and this motion was seconded by Albert Manzi The vote was 3 for and one
abstained -Beth Wescott, as Ms Wescott had arrived in the middle of this presentation.
242-966 Modification to OOC - 351 Willow St(Thomas Neve)cont fr 9/20/00
This Order was issued on 9/l/99 authorizing the construction of an addition and enlargement
of the front parking lot within the Buffer Zone to a BVW The modification is for
connecting the concrete pad to the existing foundation The pad itself is in the 50' NCZ as is
the additional work proposed Brian LaGrasse informed the Commission that they are
trying to work out some details and have not submitted anything at this time Brian spoke
with Tom Neve and he has indicated that there is more to this project than originally
proposed He stated that they are possibly looking into some type of metal
enclosure/structure The applicant would also like to request a site walk with the
Commission to look at possible alternatives and mitigation The Conservation Commission
does not feel a site walk is warranted now until all plans are submitted. A motion was made
by Robert Mansour to continue 242-966 to 10/18/00 and this was seconded by Deborah
Feltovic The vote was unanimous
242-1000 COC— 173 Coachman's Lane(Richard& Peggy Issenberg)(Hancock Eng.)
Brian LaGrasse stated this Order of Conditions was issued on 3/15/2000 for the construction
of an addition, blue stone patio and fire pit and modified at the last meeting to include an
addition/storage shed to the northeast corner of the house. They have submitted stamped
As-Builts and a letter from the engineer certifying compliance with the Order of Conditions
The 25'/50' were mandated and met except to blue stone walkway The site is stable Brian
LaGrasse recommended issuance of COC for 242-1000 and release of the $1,500 Bond A
motion was made by Albert Manzi and seconded by Deborah Feltovic to grant a COC for
242-1000 and release the $1,500 Bond The vote was unanimous
242-640 COC—295 Candlestick Road(John Kosheff)(Scott Giles)
Scott Giles is requesting a continuance of the above COC for 242-640 until our meeting of
10/18/2000 so that he can re-establish the wetland flags A motion was made by Albert
Manzi to continue 242-640 to 10/18/2000 and this was seconded by Robert Mansour The
vote was unanimous

242-1018 COC -Harkaway Rd -Bay State Gas(Guertin&Assocs )
This Order was issued on 7/5/00 authorizing the replacement of a 2" gas line and associated
home connections within the Buffer Zone to a BVW This filing was the result of an
Enforcement Order and filed after the fact They have submitted stamped As-Builts and a
letter from the engineer certifying compliance with the Order of Conditions The gas line
was installed under the existing pavement Brian LaGrasse visited the site on 8/2/00 and
had no issues. The site is stable There are no violations on site. Brian recommended
issuance of the COC and release of the $2,000 Bond A motion was made by Deborah
Feltovic to grant a COC for 242-1018 and release the$2,000 Bond and this was seconded by
Albert Manzi The vote was unanimous
242-1023 COC -4 Kathleen Drive(Bruce & Diane Carey)
Brian LaGrasse informed the Commission that this Order was issued on 7/19/2000
authorizing the construction of a 12'X12' deck within the Buffer Zone to a BVW They
have submitted As-Builts and a letter from their engineer certifying compliance with the
Order of Conditions However, the As-Built plans submitted are not stamped by the
engineer Mr Carey, the homeowner was present and stated that the original plans were
accepted without a stamp, therefore he thought that the As-Builts could be accepted the
same as well The Conservation Commission informed Mr Carey that he needed to get his
engineer to stamp the As-Built Plans A motion to continue 242-1023 to 10/18/00 was made
by Robert Mansour and this was seconded by Beth Wescott The vote was unanimous
242-784 Modification to OOC -Lot 9 Abbott Village (William Barrett)
This Order was issued and amended on 6/19/99 authorizing the construction of Abbott
Village Subdivision within the Buffer Zone of a BVW The modification is for a change in
the footprint of the house, driveway and grading The house was originally proposed at 62'
and is now proposed at 55' from the wetlands The driveway was originally proposed at 40'
and is now proposed at 32' from the wetlands The 25'/50' are met on the proposed plans
The grading between the house and the wetlands is not as steep as originally proposed The
erosion controls are in the same location Bill Barrett informed the Commission that the
flags are up in the field Brian LaGrasse stated that this modification would not require any
additional conditions and Mr LaGrasse recommended we issue Modification to Order of
Conditions for 242-784 and accept plans received 9/21/00 A motion was made by Deborah
Feltovic and seconded by Albert Manzi to accept Modification to Order of Conditions for
242-784 and accept Plans dated 9/21/00 The vote was unanimous
242-997 COC - 105 Wintergreen Drive (N E Engineering)
Brian LaGrasse informed the Commission that this Order was issued on 1/19/00 authorizing
the replacement of a failed septic system within the Buffer Zone to a BVW and riparian

zones to Mosquito Brook They have submitted As-Builts and a letter from the engineer
certifying compliance with the Order of Conditions The 25'/50' were mandated and met
Brian visited the site on 10/3/00 and had no issues The site is stable There are no
violations on site Brian recommended we issue a COC for 242-997 and release the $1,500
Bond A motion was made by Deborah Feltovic and this was seconded by Albert Manzi.
The vote was unanimous
242-845 COC—Brookview Drive (Brookview Country Homes)(Paul Marchionda)
This Order was issued on 4/3/97 authorizing the construction of a roadway providing access
to a planned residential subdivision along with underground utilities within the Buffer Zone
to a BVW The houses were not proposed under this filing A wetland crossing was
approved with 5,900 s f of replication 24,000 s f of flood plain compensation area was
replicated The Order of Conditions requires the wetland replication area to be monitored
for 5 growing seasons and it has only been through 3 growing seasons Scott Masse
recommended that the growing season be reduced to 3 years instead of the 5 years There is
also some rip rap next to Lot 2 that needs to be cleaned up Brian LaGrasse stated that he
needs a status report for this growing season At this point the applicant withdrew his
request for a COC without prejudice and will reapply when he is ready
Ratification of Enforcement Order- 1060 Turnpike Street
Enforcement Order was signed for 1060 Turnpike Street Brian LaGrasse will draft a letter
to the owner stating that he has two weeks in which to comply with this Enforcement Order
A motion was made by Deborah Feltovic and seconded by Beth Wescott to ratify
Enforcement Order for 1060 Turnpike Street The vote was unanimous.
Decision:
242-1034 210 Farnum Street
This was for replacement of a failed septic system It was decided that the shed on the
property is too big and too old to be moved further away from the wetlands The shed
would fall apart if moved The Order of Conditions was drawn up by Brian LaGrasse to
include 10 extra hay bales along with a$1,500 Bond payable to the Town of North Andover
A motion was made to adopt as drafted the Order of Conditions for 242-1034 by Albert
Manzi and this was seconded by Deborah Feltovic The vote was unanimous

Brian LaGrasse informed the Commission that the Airport has submitted the escrow money
and that Patrick Seekamp has started his review Mr. LaGrasse has not received any

continue 242-1020 to 10/18/00 and this was seconded by Deborah Feltovic The vote was

Thomas Neve asked for a continuance to our meeting of 11/01/00 A motion was made by
Albert Manzi to continue 242-1036 to 11/01/00 and this was seconded by Deborah Feltovic
The vote was unanimous
242-1025 Greene St/Kenwood St(Richmond Rlty)(Wetlands Pres)cont fr 9/6/00
This NOI is for the construction of a four story, 44 unit condominium building with parking,
cul de sac, stormwater management systems, flood plain compensation,replication and wild
life habitat restoration Michael Howard and Lisa Eggleston have performed the third party
reviews and have submitted their comments They have relocated the intermittent stream
from under the building to on the side of the building The relocated stream will be an open
above ground stream channel
Beth Wescott questioned stockpiling areas shown on the plan Any snowstorm that occurs -
all snow removal will have to be done right away and not stockpiled on site. This was
agreed upon Refueling will be outside the rivefront area There were no abutters present
for this project Albert Manzi made a motion to close the public hearing and issue a
decision in 21 days However since Epsilon Associates is not completely finished with their
review Mr Manzi withdrew his previous motion and recommended an increase in the
escrow account to add another$500 00 Albert Manzi made a motion to increase the escrow
account to add another$500 00 and this was seconded by Deborah Feltovic The vote was
unanimous At this point Albert Manzi made a motion to close the public hearing and issue
a decision in 21 days and this was seconded by Deborah Feltovic The vote was unanimous

This NOI is for the expansion of an existing deck and sidewalk addition within the Buffer
Zone to a BVW At the last meeting Brian LaGrasse mentioned that he wanted the erosion
control moved Mr LaGrasse has conditioned this in the Order of Conditions
The proposed deck meets the 50' NCZ A motion was made by Beth Wescott to close the
public hearing on 242-1030 and issue a decision in 21 days and this was seconded by Albert
Manzi The vote was unanimous
242-1026 Lot 33 Abbott Street(No Andover Land Corp )(N E. Engineenng)cont fr 9/20/00
This NOI was continued from our last meeting so that the applicant could explore more
alternatives We have received a letter from the DPW today (10/4/00) stating that they

would allow a temporary forced main to be installed within the sidewalk currently under
construction up to the existing sewer at the intersection of Abbott Street and Nutmeg Lane
The DPW will permit the connection subject to their review and approval of plans and
specifications for the force main,pumping station and appurtenances A continuance to our
meeting of 10/18/00 was asked for and granted A motion was made by Albert Manzi to
continue 242-1026 to our meeting of 10/18/00 and this was seconded by Deborah Feltovic

242-1029 440 Marbleridge Road (Michael& Mary Borzi)(Scott Giles)cont fr 9/20/00
This was continued from our last meeting in which applicant was requesting construction of
a 12'X22' deck within the Buffer Zone to a BVW
They have submitted revised plans with a detail added to show the deck cantilevered Brian
LaGrasse stated that they have not obtained structural drawings at this time The building
inspector will require full structural specifications when a permit is applied for Mr
LaGrasse stated that we could condition the submittal of the structural drawing as a pre-
construction inspection A motion was made by Albert Manzi to close the public hearing
and issue a decision in 21 days and this was seconded by Beth Wescott The vote was
unanimous

No proof of mailings were brought in When notice was read it was found to be outdated
Conservation Commission was very upset especially Albert Manzi who stated"get your act
together or we'll throw this application out next time." It was recommended that applicant
could either withdraw without prejudice and re-apply, or renotify and re-advertise and start
again in 2 weeks Applicant chose to renotify and re-advertise It was also decided that
whatever Escrow amount was left in the old filing 4242-996 be brought over to the new
filing A motion was made by Albert Manzi to continue 242-1031 to 10/18/2000 and this
was seconded by Deborah Feltovic The vote was unanimous

Proof of mailings were presented Terry Gensel was present for this project This NOI is
for a sewer tie in within the Buffer Zone to a BVW The tie in will be going down the north

side of the driveway The area where the tie in is proposed is between two driveways. This
project requires a waiver of the 25' NDZ There are no other alternatives feasible due to the
amount of wetlands surrounding the property Erosion controls are proposed to the north of
the sewer line and in an appropriate location The south side of the driveway there is a 7"
asphalt berm in between the work being performed and the resource area The berm is solid
and will act as a barrier to the resource area Dewatermg and soil stockpiling locations have
been determined in the field and depicted on the site plan Brian LaGrasse walked the site
on 10/3/00 with Terry Gensel and confirmed the wetland line. There are no violations on
site Hyder Construction will be doing the work A motion to close the public hearing and
issue a decision in 21 days for 242-1039 was made by Deborah Feltovic and tlus was
seconded by Beth Wescott The vote was unanimous.
242-1040 160 Bridle Path(Patrick& Christina Morgan)(Terry Gensel)
Proof of mailings were presented Brian LaGrasse informed the Commission that this NOI
is for a sewer tie in within the Buffer Zone to a BVW The tie in will be going down the
center of the driveway There are wetlands to each side of the driveway that are connected
by a culvert This project requires a waiver of the 25' NDZ There are no alternatives
feasible due to the amount of wetlands surrounding the property Erosion controls are
proposed around the wetland to the south and are in an appropriate location The north side
of the driveway has a 7" asphalt berm in between the work being performed and the
resource area The berm is solid and will,act as a barrier to the resource area except for two
breaks near the house Hay bales are proposed in the breaks Dewatermg and soil stockpile
locations have been determined in the field and depicted on the site plan Brian LaGrasse
walked the site on 10/3/00 and confirmed the wetland line There are no violations on site.
He recommended closing the public hearing and issuing a decision in 21 days A motion
was made by Deborah Feltovic to close the public hearing and issue a decision in 21 days
for 242-1040 and this was seconded by Beth Wescott The vote was unanimous

Proof of mailings were presented One abutter was present for this project-Mrs Virgima
Campagna
Brian LaGrasse stated that this NOI is for the construction of a 6' extension of the garage
within the Buffer Zone to a BVW The addition is 79' from the wetlands, but the hay bales
are proposed 14' at the closest point The erosion control is proposed along the side of the
driveway between the driveway and the resource area This seems to be the only feasible
area that the erosion control can go The work is being performed at the top of the driveway
and this is the only permeable area that the silt fence can be trenched and the hay bales can
be staked The other side of the driveway looks possible but because of the steep slope of
the driveway, I feel that any unstable soil at the excavation area will wash down the
driveway and end up in the resource area Brian LaGrasse walked the site on 10/3/00 and
could not locate all the wetland flags These wetland flags will need to be re-flagged

Mrs Campagna thinks that the culvert is not working properly Two years ago it was an
intermittent stream and now they have standing water there She is getting water backed up
in her backyard Albert Manzi stated that the culvert is working properly. Michael Howard
stated that when he was working for the Town of North Andover they had yanked out a steel
plate from this culvert Brian LaGrasse will call Bill Hmurciak on this A motion was made
by Deborah Feltovic to continue 242-1041 to our meeting of 10/18/00 and this was seconded
by Albert Manzi. The vote was unanimous
242-10371210 Osgood Street(Forgetta Development)(Epsilon Associates)cont fr 9/20/00
Michael Howard of Epsilon Associates asked the Commission that this be tabled until later
in the evening
242-1038Barker Street(Tara Leigh Dev,LLC)(Epsilon Associates)cont fr 9/20/00
Brian LaGrasse informed the Commission that he had spoken to John Chessia regarding this
project and he indicated that the applicant is looking at alternative routes for the sewer line
This NOI is for the construction of a cross country sewer line and stormwater management
system within the Buffer Zone to a BVW The cul-de-sac roadway and the seven lots are
out of the 100' Buffer Zone Three alternate sewer line routes were proposed Route C is
the longest and most expensive site but alternate route C is clearly the best site because it
complies with the Bylaw and there would be the least disturbance to the area Albert Manzi
agreed that alternate route C is also the best one Scott Masse has a letter from Mr Smolak
which states that he is satisfied and everything is fine with him A motion was made to
continue 242-1038 to our meeting of I I/l/2000 and this was seconded by Albert Manzi
The vote was unanimous
Albert Manzi left the meeting at 9:05 p.m. to go to work.
242-1037 1210 Osgood Street (Forgetta Dev)(Epsilon Associates)cont fr 9/20/00
This NOI is for a mixed use development within the Buffer Zone to a BVW They are
proposing an office building, a 102 room hotel, a retail building and a sewer force main on
Rte 125 The 25' NDZ and 50' NCZ are met for the proposed buildings and development
They are requesting a waiver of the 25' NDZ for the force main, which is proposed in the
existing pavement of 125 and the demolition of the existing greenhouses and sheds. The
mitigation report is sufficient Brian LaGrasse walked and confirmed the wetland line and
erosion control is depicted in an appropriate location John Chessia has started his review
and we've received his comments on 9/26/00 He would like some additional information to
be provided to him and he would also like permeability tests done for the infiltration system.
Mr Chessia had comments regarding maintenance procedures of the subsurface infiltration
systems and recommended that the applicant install monitoring wells The spill ways should
be rip rapped to avoid erosion and siltation

The DPW is in the process of reviewing the sewer capacity There will be a forced main all
the way up to the manhole by the airport A 6"forced main will be used Beth Wescott
feels it is a long forced main and asked what will the head pressure be? Stormwater
management will also be a big issue on this project Brian LaGrasse asked that applicant
submit a revised O&M Plan
To meet the setbacks they'll be doing a series of versa-lock walls The Commission wanted
to know how high the walls would be Some spots will be 12 to 14 feet high Versa-lock
blocks have a certain way of building these walls in order to make them safe Brian
LaGrasse stated we can make this a pre-requirement before construction A motion was
made by Robert Mansour to continue 242-1037 to I I/1/00 and this was seconded by Beth
Wescott The vote was unanimous
242-1032 127 Bridle Path(George Chatson)(Thomas Neve Assoc)cont fr 9/20/00
Mr Thomas Neve is requesting a continuance to our meeting of 1 I/I/00 in order to fulfill
mitigation requirement A motion was made by Deborah Feltovic to continue 242-1032
until 11/1/00 and this was seconded by Robert Mansour The vote was unanimous.
242-1042 Bayfield Drive(Benjamin Farnum)(Thomas Neve)
Proof of mailings were presented Thomas Neve was present This NOI is for the leveling
of a mound in the 25' NDZ to a resource area to provide access to Bayfield Drive from
Route 125 for moving of the Barn Venzon has been on strike and this has hampered the
moving of the barn The proposed route along Hillside would take 3 to 6 months to move
due to fiber optic cables which would be a very time consuming job and cost prohibitive
The new route will go down Rte 125 and take a right onto Bayfield Drive which is about 28
to 30 feet wide The barn would need about 40 feet to go through this route They are
proposing to clear vegetation, take soil out, stockpile it then put soil back They are
proposing to put down 2 layers of plywood then put a cribbing section on the wetland
surface. The cribbing will be built of 8X8 timbers, then steel plates will be placed upland on
either side making it possible for the barn to pass over this site on dollies Brian LaGrasse
suggested revegetating with more valuable plants when returning soil to original area
Robert Mansour was concerned about the 2 layers of%"plywood. He didn't think it would
