HomeMy WebLinkAbout2000-11-15 Conservation Commission Minutes Conservation Commission Minutes DPW Conference Room November 15, 2000 Members Present: Scott Masse, Chairman, John Mabon,Robert Mansour and Robert Cerchione, Associate Joseph Lynch arrived at 7 55 p in Staff Present: Brian J LaGrasse, Conservation Associate and Germaine L Ouellette, Secretary The meeting was called to order at 7.55 p in (when we had a quorum)by Scott Masse, Chairman Minutes: May 3, 2000 August 2, 2000 August 16, 2000 September 6,2000 September 20, 2000 October 4,2000 October 18, 2000 November 1, 2000 On a motion by Mr Mansour, seconded by Mr Mabon,the Commission voted unanimously to approve as drafted the above listed minutes General Business: 242-1023 COC—4 Kathleen Drive (Bruce&Diane Carey) This Order was issued on 1/26/93 authorizing construction of a 12'X12' deck within the Buffer Zone to a BVW They have submitted stamped plans which was the only outstanding issue Brian LaGrasse visited the site on 11/14/00 and had no issues On a motion by John Mabon and seconded by Joseph Lynch,the Commission voted unanimously to issue a COC for DEP 4242-1023 and release the $1,000 Bond 242-966 Amendment to OOC - Bake-n-Joy(Tom Neve Associates, Inc) This Amendment is for connecting the concrete pad to the existing foundation, raising it 6" and enclosing it to house the compressor. The compressor will be computerized and will be in a panelized room They are proposing a 3.1 mitigation ratio. Brian LaGrasse would like to have them put in 8-10' maples and 6-8' dogwoods He would also like a post and rail fence along the pavement and have NDZ signs put on the outside of the fence. Mr LaGrasse would also like to condition 2 growing seasons Mr Robert Mansour brought up the point if a footing and a frost wall would have to be put in since this is now an enclosed structure? He wanted the engineer to be aware that this may be required by the Building Dept Mr Mansour also would like to condition the two columns to be hand excavated Mr Joseph Lynch asked if there would be a downspout off the roof proposed? He would like to see an erosion control shown on the plan. Tom Neve said they could do that Mr Lynch stated that the Commission needs to have the construction drawings agree with what is proposed A motion to continue DEP 4242-966 to our 12/06/00 meeting was made by Joseph Lynch and this was seconded by John Mahon The vote was unanimous 242-885 Mod To OOC Lots 1,37,43,44A,46A,53A& Parcel G-Forestview Estates (Poulty) (Marchionda) This Order was issued on 3/10/98 authorizing the construction of a 92 Lot Subdivision with associated roadways, utilities, storm water management structures and wetland replication areas within the Buffer Zone to a BVW 2,519 s f of wetland alteration was permitted with 5,038 s f of replication This modification request is for the change in the house footprints and the addition of decks and sidewalks to the site plans Lot 1 This Lot was modified on 4/5/00 authorizing the change in the house location, footprint, driveway and the deck. The front stairs and sidewalk have been added to the site plan The 25'/50' were mandated for this lot and are met on the proposed plan On a motion by Joseph Lynch and seconded by John Mabon the Commission voted unanimously to grant the Modification to Lot 1 - DEP #242-885 and accept plans REV 10/16/00 Lot 37 This Lot was modified on 5/17/00 authorizing the change in the house location, footprint and the driveway The deck, front stairs and sidewalk have been added to this site plan and the house has been moved 1 1/z' away from the wetlands A retaining wall has also been added by the front walkway The 25'/50' were mandated for this lot and are met on the proposed plan On a motion by Joseph Lynch and seconded by Robert Mansour the Commission voted unanimously to grant the Modification to Lot 37 -DEP #242-885 and accept plans REV 10/16/00 Lot 43 This Lot was modified on 4/5/00 authorizing the change in the house location, footprint and the driveway The front stairs and sidewalk have been added to the site. There is no change in the footprint or the location of the house or driveway A retaining wall has also been added by the front walkway The 25'/50' were mandated for this lot and are met on the proposed plan On a motion by John Mabon and seconded by Joseph Lynch the Commission voted unanimously to grant the Modification to Lot 43 -DEP#242-885 and accept plans REV 10/16/00 Lot 44A This modification request is for the change in the location of the house and the footprint A small deck has been added to the back of the house. The front stairs and sidewalk have also been added. The original house was proposed along the 50' NCZ This house is proposed 51' from Wetland Flag F21 and Wetland Flag F24 and the deck is also proposed at 51' from the wetland line The 25'/50' were mandated for this lot and are met on the proposed plan. The hay bale line is proposed in the originally approved location The grading does not change on the proposed plan On a motion by Robert Mansour and seconded by Joseph Lynch the Commission voted unanimously to grant the Modification to Lot 44A-DEP #242-885 and accept plans dated 10/16/00 Lot 46A This modification request is for the change in the location and footprint of the house The front stairs and sidewalk have also been added The original house was proposed 12' closer to the wetlands in the back of the property The back deck was originally approved at 51' and is now proposed at 63' from the wetland line The side of the house was originally proposed at 51' and is still proposed at 51' from the wetland line The 25'/50' were mandated for this lot and are met on the proposed plan. The hay bale line is proposed in the originally approved location The house elevation has been lowered and less grading is necessary On a motion by Joseph Lynch and seconded by John Mabon the Commission voted unanimously to grant the Modification to Lot 46A - DEP #242-885 and accept plans dated 10/16/00 Lot 53A This modification request is for the change in the location and footprint of the house. The front stairs and sidewalk have also been added The original house was proposed along the 50' NCZ The house was moved further away from the wetlands and is now proposed 54' from Wetland Flag F 14 The deck is proposed at 50 6' from the wetland line, which is consistent with the original deck The 25'/50' were mandated for this lot and are met on the proposed plan. The hay bale line is proposed in the originally approved location This house has been lowered and less of a slope towards the wetlands is necessary On a motion by John Mabon and seconded by Robert Mansour the Commission voted unanimously to grant the Modification to Lot 53A - DEP#242-885 and accept plans dated 10/16/00. Parcel G This modification request is for the change of lot use This lot was formerly Lot 55 and a house was proposed on it. The modification request is for the conversion of the Lot from a house to a play field The 25'/50' were mandated for this lot and are met on the proposed plan There is no construction proposed on the modified site plan The hay bale line is proposed in the originally approved location. A 2 `/2' boulder retaining wall is proposed along the hay bale line. A fence has been proposed along this wall On a motion by Robert Mansour and seconded by Joseph Lynch the Commission voted unanimously to grant the Modification to Parcel G—DEP#242-885 and accept plans dated 10/16/00 242-985 Modification to OOC -Lots A & B Forest Street(Ralph Joyce) This Order was issued on 11/3/99 authorizing the construction of two single family homes, driveway, septic systems, utilities, grading, appurtenances and restoration within the Buffer Zone to a BVW and Vernal Pool A 50' NDZ and a 75' NCZ were established except at the existing driveway entrance The Modification request is for the switching from underground utilities to the installation of 3 utility poles and overhead lines along the driveway. The three utility poles proposed are within the limit of work approved The closest pole is proposed 17' from the wetland line and is within the original limit of work Brian LaGrasse felt that the installation of 3 utility poles will be less likely to impact the resource areas than excavating for underground utilities On a motion by Joseph Lynch and seconded by John Mabon the Commission voted unanimously to grant Modification to Order of Conditions for DEP #242-985 and accepting plans REV 10/23/2000 242-862 Extension to OOC -Rocky Brook Estates Phase II (Peter Breen)(Neve Assocs) Brian LaGrasse informed the Commission that this Order was issued on 12/4/97 authorizing the construction of a residential subdivision with an associated roadway, utilities, septic systems and appurtenances within the Buffer Zone to a BVW and Riverfront area 15,000 s f replication was completed under Rocky Brook Phase I The roadway and crossing are complete House construction has started on Lots 11 and 12. The site has been reflagged and is in compliance with the Order of Conditions Brian LaGrasse inspected the site on 11/13/00 and did not have any issues This will be the first extension request On a motion by Joseph Lynch and seconded by John Mabon the Commission voted unanimously to grant the Extension to OOC for 242-862 to December 4, 2001 NACC#7 - Extension to OOC - Lot 3 Saile Way(Marlyn Elias)(Daniel Bailey) This Order was issued on 12/4/97 authorizing construction of a single family dwelling within the Buffer Zone of an isolated wetland subject to protection under the North Andover Wetlands Protection Bylaw The Order is set to expire on 12/04/00 No work has taken place on this lot per Brian LaGrasse A waiver of the 25' NDZ was granted for the driveway It is proposed at I I' from an isolated Bylaw wetland. Staff from the Conservation Department inspected the site on 11/14/00 and verified and approved the wetlands flags They have supplied the recording information The only issue Mr LaGrasse had is the isolated wetland flags are not shown on the original plan of record Applicant will submit new plan that shows wetland flags On a motion by John Mabon and seconded by Joseph Lynch the Extension to Order of Conditions for NACC#7 - Lot 3 Saile Way was passed. The vote was as follows John Mabon yes Joseph Lynch yes Scott Masse yes Robert Mansour abstained 242-784 Modification to OOC -Lot 20 Abbott Village(William Barrett) This Order was issued and amended on 6/16/99 authorizing the construction of Abbott Village Subdivision within the Buffer Zone of a BVW The modification is for a change in the location and footprint of the house, driveway and grading The house was originally proposed 77' and is now proposed at 72' from the wetlands The foundation has also been raised approximately 4' The driveway was originally proposed on the other side of the house and is now proposed 31' from the wetlands The erosion controls are extended along the 25' NDZ in the northwest portion of the lot They are proposed at approximately 27' from the wetland line and extend further than originally proposed The 25'/50' are met on the proposed plans This modification would not require any additional conditions On a motion by John Mabon and seconded by Joseph Lynch the Commission unanimously approved the Modification to OOC - Lot 20 Abbott Village and accepted plans dated November 1, 2000 Robert Mansour made a recommendation that the Conservation Commission needs to standardize the size of record plans that are received by us. Public Hearings (8:00 p.m.) Request for Determination of Applicability There are no RDA's this evening as both applications submitted were incomplete Abbreviated Notice of Resource Area Delineation There are no ANRAD's this evening as the application submitted was incomplete. Notice of Intent(s) 242-1031 1812 Turnpike Street(Jean Proulx)(Allen& Major)cont fr 10/18/00 Gary Scola was present from Allen&Major There were no abutters present for this project This NOI is for the construction of a 10,000 s f (footprint)two story building, associated roadways, parking, drainage structures, landscaping and associated appurtenances They are not requesting any waivers for this project They are utilizing versa lock block retaining walls along the 25' NDZ on the eastern portion of the site This project is being reviewed by Coler& Colantonio The last response from Chessia was sent to us on 11/7/00 The intermittent stream on the eastern portion of the property has not been studied by FEMA Chessia commented previously that the intermittent stream should be modeled for the 100 yr flood elevation. Brian LaGrasse stated that they needed to submit TSS calc sheets Side slopes proposed in this project are greater than 3 1, which does not meet DEP standards This needs to be addressed. The detention ponds need to be sloped to drain Detention basin 1 is partly located on abutting property The easement needs to be provided to the Commission. This can be a pre-construction condition according to Mr. LaGrasse. Mr Scola advised the Commission that they have lowered the top of the pond by one foot. John Chessia is asking for a 5' wide berm Gary Scola is asking for consideration of a 2' berm The Conservation Commission agrees with Mr Chessia and would go with a 5' berm (for maintenance purposes) however, if John Chessia agrees with a 2' berm then the Conservation Commission would agree with the 2' berm also Brian LaGrasse stated that we need updated plans submitted and John Chessia commented that we should require an inspection of the modular block retaining walls during its construction because it is so close to the 25' NDZ On a motion made by Joseph Lynch and seconded by John Mabon the Commission unanimously agreed to continue 242-1031 to 12/20/00 242-1045 675 Chickering Rd (No Andover School Bldg )(Schofield Bros)cont fr 10/18/00 No abutters were present for this project Ken DiNisco of DiNisco Design spoke and informed the Commission that they had a meeting with John Chessia on 11/13/00 which was very well received They are looking into eliminating the exit to Chickenng Road, leaving the pedestrian bridge and utilizing the Osgood Street entrance They delineated the wetlands and surveyed the area last week They are in the process of revising the plans and submitting them to us They are looking to continue to our 12/20/00 meeting Brian LaGrasse would like a clearer,break down of the proposed alterations He would like them to provide numbers for permanent wetland alterations,temporary wetland alterations, permanent 25' No Disturbance Zone alterations and temporary 25' No Disturbance Zone alterations A construction schedule, even if approximate, needs to be submitted The construction schedule is updated through frequent status reports during construction On a motion by Joseph Lynch and seconded by John Mabon the Commission voted unanimously to continue 242-1045 to 12/20/00 242-1049 659 Forest Street(Robert Reed)(N E Engineering)cont fr 11/01/00 This was continued from our last meeting as DEP had not issued this project a number. They have issued a number and Brian LaGrasse stated that we are now ready to close on this project This NOI is for the construction of a replacement septic system and associated grading within the Buffer Zone of a BVW Mr LaGrasse reviewed the wetland line and had no issues There are no violations on site The FEMA maps show they are not in a flood plain Mr LaGrasse recommended we close the public hearing and issue a decision in 21 days On a motion by Robert Mansour and seconded by Joseph Lynch the Commission voted unanimously to close 242-1049 and issue a decision in 21 days 242-1047 212 Haymeadow Road(Leo Quinn)(N E Engineenng)cont fr 11/01/00 Brian LaGrasse reminded the Commission that this NOI had been continued from our last meeting because the applicant needed to submit FEMA information and re-number the wetland flags to correspond with the numbers in the field This information has been submitted and is satisfactory Mr LaGrasse recommended we close the public hearing and issue a decision in 21 days On a motion made by Robert Mansour and seconded by Joseph Lynch the Commission voted unanimously to close 242-1047 and issue a decision in 21 days Decisions: 242-1044 428 Winter Street This NOI was for the construction of a replacement septic system and associated grading within the Buffer Zone of a BVW Brian LaGrasse drafted the Order of Conditions. On a motion made by Robert Mansour and seconded by John Mabon the Commission voted unanimously to accept the Order of Conditions as drafted for 242-1044 242-1046 314 Rea Street Brian LaGrasse drafted the Order of Conditions for 242-1046 which was for the construction of a replacement septic system and associated grading within the Buffer Zone of a BVW The Bond for this project was set at $1,500 On a motion made by John Mabon and seconded by Robert Mansour the Commission voted unanimously to accept the Order of Conditions as drafted for 242-1046. 242-1049 659 Forest Street This NOI is for the construction of a replacement septic system and associated grading within the Buffer Zone of a BVW Brian LaGrasse reviewed the wetland line and did not have any issues There are no violations on site Mr LaGrasse also reviewed the FEMA maps and they are not in a flood plain An Order of Conditions was drafted by Brian LaGrasse On a motion by Robert Mansour and seconded by Joseph Lynch the Commission unanimously voted to accept the Order of Conditions as drafted for 242-1049 242-1047 212 Haymeadow Road Brian LaGrasse informed the Commission that this was continued from the last meeting as applicant needed to submit FEMA information and re-number the wetland flags to correspond with the numbers in the field This information has been submitted and is satisfactory Mr LaGrasse drafted an Order of Conditions conditioning the removal of the yard waste. On a motion by Robert Mansour and seconded by Joseph Lynch the Commission unanimously voted to accept the Order of Conditions as drafted for 242-1047 This was the last item on our Agenda. Robert Mansour brought up the point that when a meeting falls on the 3 d Wednesday of the month sometimes we have a quorum problem. He suggested we start that meeting at 8 p.m.when a quorum would be met. A motion to adjourn was made by Robert Mansour and seconded by Joseph Lynch at 9:45 p.m. The vote was unanimous.
