Feltovic, and Robert Cerchione, Associate arrived at 7 00 P M Absent were Joseph Lynch, Jr, Robert
Mansour and Beth Wescott and James Demotses, Associate

The meeting was called to order at 7 PM by Scott Masse, Chairman

General Business:
242-856 -Modification to OOC -#200 Chickering Rd. (Terra Properties, Inc.)
On a motion by Mr Manzi, seconded by Ms Feltovic, the commission voted unanimously
to grant the Applicants request for a withdrawal
242-885 -Extension to Order of Conditions Forest View (Marchionda)
Applicant requested a continuance On a motion by Mr Manzi, seconded by Ms Feltovic, the
commission voted unanimously to continue to Mar 7th
242-772— Certificate of Compliance 80 Flagship Dr. (Dutton & Garfield
This Order was issued on 10/5/95 authorizing the construction of a 9,500 s f addition, added
parking, storm drainage and a detention basin On a motion by Mr Manzi, seconded by Ms
Feltovic, the commission voted unanimously to deny the request for a partial Bond Release
The Commission voiced concerns over an existing violation on the property On a motion
by Mr Mabon, seconded by Mr Manzi, the commission voted unanimously to deny the
request for a Certificate of Compliance
242-784 -Modification to Order of Conditions lot 7 (Abbott Village) (Bill Barrett)
This Order was issued and amended on 6/16/99 authorizing the construction Abbott Village
Subdivision within the Buffer Zone of a BVW Applicant requested a continuance and Mr.
LaGrasse recommended to issue a Modification for Lot 7 Abbott Village and accept plans
dated 1/11/01 The applicant discussed with the Commission about installation of a 2' stone
wall marking conservation boundaries Applicant agreed to a segmented block wall starting
at the head wall and stopping at the 25' No Disturbance Zone with an avadavat for the new
home owner to sign Applicant will resubmit plans with wetland flags by Hayes Eng on the
edge of the replacement area, and placed on the plan, a cross section drawing, and a
foundation drawing On a motion by Ms Feltovic, seconded by Mr. Manzi, the commission
voted unanimously to continue to Mar 7 h
242-816 -Modification to Order of Conditions Cambell Forest(Lot's 21,30,& 31(Meseti Dvlpmnt
Lot 21 - This Order was issued on 5/8/97 authorizing the construction Campbell Forest
Subdivision An extension permit was issued extending the OOC through 5/8/01
Lot 30 - This Order was issued on 5/8/97 authorizing the construction Campbell Forest
Subdivision An extension permit was issued extending the OOC through 5/8/01
Lot 31 - This Order was issued on 5/8/97 authorizing the construction Campbell Forest
Subdivision An extension permit was issued extending the OOC through 5/8/01
Applicant will resubnut plans On a motion by Mr Mabon, seconded by Ms Feltovic, the

r 242-857—Certificate of Compliance 57/59 Concord Street(Michael & Michelle Yore
This Order was issued on 3/20/97 authorizing the construction of a single family house in
the buffer zone. This site has a history There is a violation of the 50' NCZ that Doug Ahern
walked away from and the bond was seized An agreement was made between the NACC
and the new home owners to plant mitigation plantings at a 5 1 ratio and the Commission
agreed to keep the bulkheads The home owners have requested reimbursement of$500 for
their plantings along with their COC request The commission denied reimbursement The
applicants requested a Modification for the deck On a motion by Mr. Manzi, seconded by
Ms Feltovic,the commission voted unanimously to continue to Mar 7`h
492 Sutton St. (Lawrence Enterprise Commission)
The unanimous decision was a positive confirmation of the delineation line
Fire Station Task Force Update
Although not on the Agenda, an update was given by Mr Manzi regarding the task force for
the proposed Outcountry Fire Station,Lot 20 The Task Force is going to perform a
Delineation and flag a suitable building site on March 1" The Task Force has requested the
Conservation Commission to appropriate'funding of$1,000 On a motion by Ms Feltovic,
seconded by Mr Mabon, the commission voted unanimously to request funding The
Commission is under no obligation or authority to do such work but for the new Associate,
Brian LaGrasse, will receive training to learn certain things to better perform his Job
However no monies will be provided to anyone else for surveys upon request that would not
benefit the Conservation Commission

242-1036 - 1070 Osgood Street(Chai Senabunyarithi)(Neve & Assoc.) cont fr 1/3101
This project proposes the construction of a 3,400 s f. restaurant, driveway, associated
parking, utilities, and stormwater management structures The project also includes 300s f
of wetland alteration, 1,800 s f of wetland replication and a waiver request from the 25' On
a motion by Mr Manzi, seconded by Ms Feltovic, the commission voted unanimously to
continue to Mar 7`h.
242-1020 492 Sutton St. (MA Aeronautics Com.)(Dufresne-Henry,Inc.)
Applicant and Conservation Commission received the National Heritage recommendation
and comments on February 7`h and they are going to place linutations on the amount of
cutting and when it will take place Due to the receipt of this letter Richard Doucette of the
MAC requested a continuance to 3/7 Dennis Card, (Abutter) submitted final draft of
meeting with concerns of replanting. On a motion by Mr Manzi, seconded by Ms Feltovic,
the commission voted unanimously to continue to Mar 2 1"
242-10571160 Great Pond Road (Brooks School)(Rist-Frost-Shumway)
Applicant has re-designed the project with no wetland impacts and submitted the revised
drawings to J Chessia On a motion by Mr Manzi, seconded by Ms Feltovic, the
commission voted unanimously to continue to Mar 21s`
242-1058 - Lot 13 Nutmeg Ln. Andover Land Corp.)(B.Osgood,Jr.)map 38 parcel 284
This NOI is for the demolition of an existing house and construction of a new dwelling
within the 100' Buffer Zone to an isolated wetland Applicants are proposing the project as
a redevelopment project with a 15' NDZ and a 25' NCZ with a stone wall along their
proposed NDZ Mabon Aubrey, ((Abutter)) voiced concerns over damage to her property
by the existing line of trees during construction The Commission wanted revised plans
submitted, and the zoning waiver research On a motion by Mr Manzi, seconded by Ms.
Feltovic, the commission voted unanimously to continue to Mar 21"
242-1059 - Wallace Lane (Stephen & Cheryl Juba)
This NOI is for a single family dwelling and associated appurtenances within the 100'
Buffer Zone to a BVW Only the driveway entrance and erosion controls are located in the
100' Buffer Zone Mr.LaGrasse had concerns about the access to the lot from the street
They have to cross a town owned right of way The Town Planner has issued a letter
indicating they may want a different driveway configuration Mr LaGrasse also doesn't feel
the Commission can issue an Order for this project because the work within our unsdiction
is not located on their property Mr LaGrasse would require documentation granting the
applicant perrmssion to perform work on land they don't own On a motion by Mr Mabon,
seconded by Ms Feltovic, the commission voted unanimously to continue to Mar 7`h
242-1052 492 Sutton Street (LMA)(Christiansen & Sergi,Inc.)
This NOI is for the construction of two hangers and pavement within the 100' Buffer Zone
The detention basin and soil stockpiling location are proposed outside of the 100' Buffer
Zone The hangers are proposed 52' and 57' from the wetland line The erosion control is
proposed 27' at its closest point and is in appropriate location accept in one area where it is
proposed around the existing pavement and into the 25' NDZ This section will have to be
moved It is mostly at the top of the slope that leads to the wetlands On a motion by Ms
Feltovic, seconded by Mr Mabon, the commission voted 2 -1 to continue to Mar 7`h
242-1062 Reynolds Field corner of Rew& Johnson (No. Andover DPW)
This NOI is for the installation of a sprinkler system and the nunor regrading of the existing
fields Large piles of asphalt along Mosquito Brook are also going to be removed as part of
this proposal The asphalt pile that is to be removed and restored needs to have erosion
control depicted on the plan and the 100 yr flood elevation needs to be labeled as 250 0 on
the plan Brian LaGrasse, (Conservation Admin) will be working with Jim Rand(Dir of
Eng , DPW) to come up with an adequate restoration plan to be implemented prior to
construction Abutter, Charles Drafton, 137 Salem St voiced concerns over seasons of
irrigation which would be June 1s`through late Oct and a timetable which Jim Rand (DPW)
explained it would take approximately 2-5days The extension of the total job would be
within 2 years On�a motion by Mr Manzi, seconded by Ms Feltovic, the commission
voted unanimously to continue to Mar 7`h
242-1061 —Salem St.Brookview Country Homes
This NOI is for the installation of a 3" force main from the sewer main installed on Salem
Street for Heritage Estates to Lot 1 Salem Street which had a wetland line approved through
an RDA in December The house proposed is outside of the 100' buffer The only portion
of the project within our jurisdiction is a portion of the force main near the entrance to
Leanne Drive Abutter, Peter Devlin, 175 Salem St voiced concerns over scope of work
which was explained by the Applicant and Abutters rights which was explained by Scott
Masse, Chairman Abutter,Ted Buron, 151 Salem St voiced concerns about not being
notified and the applicant explained that he was not within 300 feet of the project Abutter,
Lou Jones, 166 Salem St voiced concerns about alternative service to other homes and the
Applicant explained that there was not enough interested parties and it would cost too much
money Abutter, Carmelina Galvagna, 136 Salem St voiced concerns about the designs of
�y pipe and the Applicant explained it will be a 3" pipe with a pump chamber for each Ihouse
A motion was made by Mr Manzi, seconded by Ms Feltovic, to close the public hearing
and issue a decision within 21 days The vote was unanimous
242-1060—211 Boxford St. (Mike Cronin)
This NOI is for the installation of an inground swimming pool,Jacuzzi, concrete patio, deck,
addition, pool shed, relocation of a septioitank, a driveway turnaround and associated
grading Applicant will resubmit plans that may include a modification from the Health
Dept On a motion by Mr Manzi, seconded by Ms Feltovic, the commission voted
unanimously to continue to Mar 7`h
Decisions
242-1055 Lot 66 Turnpike St. (Joe Serwatka)
Applicant addressed all issues and all documentation and data sheets have been submtted from the
biologist A motion was made by Mr. Manzi, seconded by Mr Mabon to close the public hearing and
issue a decision within 21 days The vote was unanimous The Order of Conditions was accepted as
drafted
242-1045 No.Andover High School (DiNisco Design)
This NOI is for the demolition of the North Andover High School and the construction of a new,
300,000 s f new High School, with parking,driveways, utilities, grading,landscaping, athletic fields,
and associated appurtenances Applicant has redesigned the roadway to substantially lower the wetland
impacts. A wildlife habitat enhancement plan that is satisfactory was submitted with revised buffer
zone enhancement plantings. A motion was made by Mr Manzi, seconded by Mr. Mabon, to close the
public hearing and issue a decision within 21 days The vote was unanimous The Order of Conditions
was accepted as drafted
