HomeMy WebLinkAbout2001-03-21 Conservation Commission Minutes Conservation Commission Minutes DPW Conference Room 1 4"-7 March 21,2001 Members Present: Scott Masse, Chairman Albert Manzi,Jr , Vice Chairman,John Mabon, Robert Mansour, Robert Cerchione, Associate, arrived at 7 00 P M Joseph Lynch Jr, arrived at 7 30 P M Absent were Deborah Feltovic,Beth Wescott, and James Demotses, Associate Staff Present: Brian J LaGrasse, Conservation Adnumstrator, and Linda Poiner, Secretary The meeting was called to order at 7 PM by Scott Masse,Chairman Minutes: Minutes are being reviewed General Business: 242-816- Modification to Order of Conditions Campbell Forest Lot 21A ,(Mesiti Dev.) This Order was issued on 5/8/97 authorizing the construction Campbell Forest Subdivision An extension permit was issued extending the OOC through 5/8/01 Mr Mansour's concern was the revisions should be noted on the plan On a motion by Mr Manzi, seconded by Mr Mabon, the conumssion voted unanimously to accept the Modification to Order of Conditions as drafted 242-968 -Modification to Order of Conditions Rte 114 Car Wash (No.Andover Bldg Corp) This order was issued on 10/20/99 authorizing the construction of a commercial office bldg With associated grading,utilities,parking,driveway, drainage structures,4,500 s f of wetland replication and 11,360 s f of wetland restoration within the Buffer Zone of a BVW and Riparian Zones to Mosquito Brook On a motion by Mr. Manzi, seconded by Mr Mabon, the commission voted unanimously to accept the Modification to Order of Conditions as drafted 242-885 - Extension to Order of Conditions Forest View lot 35 (Marchionda) This order was issued on 3/10/98 authorizing the construction of a 92 Lot subdivision with associated roadways,utilities, stormwater mgmt Structures and wetland replication areas Revised date of record plan 2/8/01 On a motion by Mr Manzi, seconded by Mr Mabon, the commission voted unanimously to accept the Modification to Order of Conditions as drafted 242-885 - Extension to Order of Conditions Forest View lot 52A (Marchionda) This order was issued on 3/10/98 authorizing the construction of a 92 Lot subdivision with associated roadways,utilities,stormwater mgmt. Structures and wetland replication areas Mr Mansour's concern was that the contractor have a good understanding on building the stone wall on the 25' NDZ Mr.Lynch was concerned about the bleed-out from the retaining wall—the applicant replied the large stones that they are using should be able to handle it effectively Mr Manzi stated that there would be no waiver granted Date of record plan 3/5/01 On a motion by Mr Manzi, seconded by Mr Mabon, the comnussion voted unanimously to accept the Modification to Order of Conditions as drafted 242-885 -Extension to Order of Conditions Forest View lot 55A (Marchionda) This order was issued on 3/10/98 authorizing the construction of a 92 Lot subdivision with associated roadways,utilities, stormwater mgmt Structures and wetland replication areas Mr Lynch's concern was to have better clarity on maintaining the outlet structure Mr Mabon's concern were the roof liters were not connected to anything and there were no basin changes Mr Cerchione inquired about the type of fence to be installed On a motion by Mr Lynch, seconded by Mr Manzi, the commission voted unanimously to continue to April 4ch 242-945 - Modification to Order of Conditions Lot 5 Keys Way Charles Carroll (Christian & Sergi) This order was issued on 7/21/99 authorizing the construction of a roadway, wetland crossing, single family homes, grading, utilities, stormwater mgmt structures, replication and necessary appurtenances within the Outer Riparian Zone to Mosquito Brook and Buffer Zone to a BVW On a motion by Mr Manzi, seconded by Mr Mabon the commission voted unanimously to continue to April 4t' 242-784 - Modification to Order of Conditions lot 4 Abbott Village(NE Eng. Serv.) This Order was issued and amended on 6/16/99 authorizing the construction Abbott Village Subdivision within the Buffer Zone of a BVW On a motion by Mr Manzi, seconded by Mr Mabon, the commission voted unanimously to accept the Modification to Order of Conditions as drafted 242-999—Ratification of Enforcement Order 1679 Osgood St. (Richard Kelly On a motion by Mr Manzi, seconded by Mr Lynch, the commission voted unanimously to accept the Enforcement Order as drafted Ratification of Enforcement Order 350 Winthrop Ave. (Delta &Delta Realty Trust) On a motion by Mr Manzi, seconded by Mr Lynch, the commission voted unanimously to accept the Enforcement Order as drafted Discussion of the Planning Board's Warrant Article to purchase Hawk Ridge Subdivision Lot 5 Assessors May 62 owned by Tom Zahoruiko On a motion by Mr Mabon seconded by Mr Manzi, the commission voted unanimously to support the Planning Board's acquisition of the warrant article as drafted J Appropriate money for temporary assistance for a secretary Mr Manzi `s was concerned that the money used to pay the temporary secretary for 2 weeks should not be taken out of the licensing fees He suggested the money should come out of the budget Nomination of CPA Committee Members Scott Masse received a directive from the Town Manager to nominate and appoint a member to the CPA Committee On a motion by Mr Masse, seconded by Mr Lynch, the commission voted unanimously to nommate and appoint Mr Mabon On a motion by Mr. Masse, seconded by Mr Manzi, the commission voted unanimously to accept the appointment of Felipe Schwarz to the Open Space Committee Public Hearing(8:00 P.M.) RDA's Map 62 Parcel 138 Bradford Street(Tara Leigh Development,LLC) Mr LaGrasse explained to the Commission how he conducted his site walk Plan of record dated 3/5/01 On a motion by Mr Manzi, seconded by Mr. Mahon, the commission voted unanimously that it was positive. 25 Carriage Chase Rd.(Hancock Bldg. Assoc.) (New England Eng.) On motion by Mr Manzi, seconded by Mr Mansour, the commission voted unanimously to continue to April 18th 242-1063—544 Foster St.Mike Olsen (Advantage Real Estates) (BDO Eng) This NOI is for the replacement of a septic system in the Buffer Zone to a BVW, Inner Riparian Zone to Rocky Brook and flood plain This is a very restricted site and the proposed linut of work is outside the 25' NDZ They have requested a waiver from the 50' NCZ for the septic tank The septic tank is also near the Inner Riparian Zone and 100 year flood plain The leaching field is proposed 60' from WF-1 and 63' from WF-10 This was not heard due to an s� advertising error 242-1036- 1070 Osgood Street(Chaff Senabunyarithi)(Neve& Assoc.)cont fr 1/3/01 This project proposes the construction of a 3,400 s f restaurant, driveway, associated parking, utilities, and stormwater management structures The project also includes 300s f of wetland alteration, 1,800 s f of wetland replication and a waiver request from the 25' On a motion by Mr Manzi, seconded by Mr Mansour, the commission voted unanimously to continue to April 18th 242-1020 492 Sutton St. (MA Aeronautics Com.)(Dufresne-Henry,Inc.) Applicant and Conservation Commission received the National Heritage recommendation and comments on February 71h and they are going to place limitations on the amount of cutting and when it will take place Due to the receipt of this letter Richard Doucette of the MAC requested a continuance to 3/7 Dennis Card, (Abutter) submitted final draft of meeting with concerns of replanting On a motion by Mr Manzi, seconded by Mr Lynch the commission voted unanimously to continue to April 4`h 242-1059 - Wallace Lane (Stephen & Cheryl Juba) This NOI is for a single farmly dwelling and associated appurtenances within the 100' Buffer Zone to a BVW Only the driveway entrance and erosion controls are located in the 100' Buffer Zone Mr LaGrasse had concerns about the access to the lot from the street They have to cross a town owned right of way The Town Planner has issued a letter indicating they may want a different driveway configuration Mr LaGrasse also doesn't feel the Commission can issue an Order for this project because the work within our jurisdiction is not located on their property Mr LaGrasse would require documentation granting the applicant permission to perform work J on land they don't own On a motion by Mr.Manzi, seconded by Mr Lynch the commission �J voted unanimously to continue to April 4`h 242-1058 -Lot 13 Nutmeg Ln. Andover Land Corp.)(B.Osgood,Jr.) map 38 parcel 284 This NOI is for the demolition of an existing house and construction of a new dwelling within the 100' Buffer Zone to an isolated wetland. Applicants are proposing the project as a redevelopment project with a 15' NDZ and a 25' NCZ with a stone wall along their proposed NDZ Marion Aubrey, ((Abutter)) voiced concerns over damage to her property by the existing line of trees during construction The Commission wanted revised plans submitted, and the zoning waiver research On a motion by Mr Manzi, seconded by Mr Mabon, the commission voted unanimously to continue to April 18'h 242-1057 1160 Great Pond Road (Brooks School)(Rist-Frost-Shumway) Applicant has re-designed the project with no wetland impacts and submitted the revised drawings to J Chessia On a motion by Mr. Manzi, seconded by Mr Mabon, the commission voted unanimously to continue to April 18`h 242-1052 492 Sutton Street(LMA)(Christiansen & Sergi,Inc.) This NOI is for the construction of two hangers and pavement within the 100' Buffer Zone The detention basin and soil stockpiling location are proposed outside of the 100' Buffer Zone The hangers are proposed 52' and 57' from the wetland line The erosion control is proposed 27' at its closest point and is in appropriate location accept in one area where it is proposed around the existing pavement and into the 25' NDZ This section will have to be moved It is mostly at the top of the slope that leads to the wetlands A motion was made by Mr Manzi, seconded by Mr Mabon, to close the public hearing and issue a decision within 21 days The vote was unanimous 242-1060—211 Boxford St. (Mike Cronin) This NOI is for the installation of an inground swimming pool,Jacuzzi, concrete patio, deck, addition,pool shed,relocation of a septic tank, a driveway turnaround and associated grading Applicant will resubmit plans that may include a modification from the Health Dept A motion was made by Mr Manzi, seconded by Mr Lynch,to close the public hearing and issue a �J decision within 21 days The vote was unanimous 242-1065 - Boxford St. 104D Town of North Andover(Ben Gary) This NOI is for the construction of three athletic fields, gravel driveway, paved entryway, gravel parking lot, fencing, well,water main, irrigation system and leaching basins within the buffer zone a BVW I have spoken with the representative for this project in regards to additions to the plans and items needed in the field Mr LaGrasse explained to the Commission that he reviewed the delineation,found boundaries, and agreed they were accurate, and took soil samples in suspect places Mr Lynch commented that a deep well would not be an issue. Jim Rand, (DPW Eng) commented using a well would conserve water Dorothy Varga(abutter) inquired about a main road to a school Ben Gary (applicant) stated it was not in the proposed plans John Lozier(abutter)pointed out on the applicant's map where each field was He was concerned about the wildlife and wanted to know if some areas had extra protection Virginia Campagna, (abutter) said her property has become flooded Water used to flow into Celeste Pond She said there is no more drainage Mr LaGrasse will conduct a site walk on her property Several abutters voiced their concern about safety issues and other non- conservation issues and Mr Masse explained that the Conservation Committee had no jurisdiction over such matters and they should file with the appropriate Boards The commission agreed to schedule a site walk with the neighbors after the delineation was completed Plan of record dated 3/9/01 On a motion by Mr Manzi, seconded by Mr Lynch the commission voted unanimously to continue to April 4`h t 242-1064 - 125 Court Street Town of North Andover Historical Society J� This NOI is for the construction of a foundation for a house relocation,retaining wall, grading, driveway and associated appurtenances The delineation was done by me and is only approximate right now and needs to be finalized when the snow melts The wetland line to the north is in a wet meadow and is extremely difficult to accurately delineate before the vegetation starts to come up The Commission agreed to an Enforcement Order to temporarily store it on the Parson Barnard Lot,delineate the line and then lift the order to commence on or before 3/31/01 On a motion by Mr. Manzi, seconded by Mr Lynch the commission voted unanimously to continue to April 4th 242-1066 - 333 Forest St. Richard & Kristina Jackson (Wetlands Preservation) This NOI is for the installation of an inground swimming pool,concrete patio,retaining wall and a backwashing filtration system. On a motion by Mr Lynch, seconded by Mr Mabon the commission voted unanimously to continue to April 4`h Decisions There were no decisions this evening
