The meeting was called to order at 7 00 P M

7.00 P.M. General Business:
242-1024- COC Request 5 Skyview Terrace(Andrew Chabin)(Howe Surveying Assoc)
Mr Paquette stated the project is in compliance and recommended that the NACC issue a COC On a
motion by Mr Manzi, seconded by Ms Feltovic,the NACC voted unanimously to grant the Certificate of
Compliance as drafted
242-772 - COC Request 80 Flagship Drive(Central Metal Finishing)(Dutton&Garfield,Inc)
Mr Paquette said the required 6 shrub plantings was done to his satisfaction and recommended that the
NACC issue a COC On a motion by Mr Manzi, seconded by Ms Feltovic,the NACC voted
unanimously to grant the Certificate of Compliance as drafted
Mr Mansour stated the NACC's concerns to Mr Paquette about making sure that original plans on any
project compare to the As-Builts
242-966- COC Request 351 Willow St (Bake' n Joy Foods)(Neve Assoc)
�� Mr Paquette stated the project is in compliance and recommended that the NACC issue a COC On a
- motion by Mr Manzi, seconded by Ms Feltovic,the NACC voted unanimously to grant the Certificate of
Compliance as drafted
242-969- OOC Modification Request 1212 Salem St (Ted Hanley)(Hancock Envir)
This modification was to increase the additionfrom 16'x16' to 20'x16' Mr Mansour stated his concern
about the type of foundation (i e full) Mr Paquette stated it was shown outside the 50'NBZ and
therefore complied with the setback The NACC felt the new size was close and Mr Manzi stated for the
record that if it's too close,the NACC will not grant a waiver and will make the Applicant comply with
the 50' NBZ Mr Lynch stated for the record it is 51'plus, but not less than 50' On a motion by Mr
Manzi, seconded by Ms Feltovic,the NACC voted unanimously to grant the Modification as-drafted
242-991 -Bond Reduction Request 140 Willow St (Dogleg Realty Trust)(West Envir)
Mr Paquette stated he had outstanding issues and recommended a continuance to the 1/9/02 Public
Hearing Mr Lynch inquired about an extra growing season that he thought had not been completed On
a motion by Mr Manzi,seconded by Ms Feltovic,the NACC voted unanimously to continue to 1/9/02
242-1030- COC Request 96 Sugarcane Ln (Todd&Karen Clark)(Scott Giles)
Mr Paquette stated the project was in compliance and recommended that the NACC issue a COC On a
motion by Mr Mansour, seconded by Ms Feltovic,the NACC voted unanimously to grant the Certificate
of Compliance as drafted
242-1050- COC Request 84 Sugarcane Ln (Chris&Lisa Hanson)(Scott Giles)
Mr Paquette stated the project was in compliance and recommended that the NACC issue a COC On a
motion by Mr Mansour, seconded by Ms Feltovic,the NACC voted unanimously to grant the Certificate
of Compliance as drafted
The NACC took attendance for the 1/9/02 meeting Attending would be Mr Masse, Mr Manzi,Mr
Lynch, Mr Mabon,and Mr Cerchione Absent would be Mr Mansour and Ms Feltovic

Mr Paquette noted the proposed gazebo and pool were in compliance with the setbacks Mr Paquette
stated he had no further issues with the project The NACC set the Bond at$5K On a motion by Mr
Mabon, seconded by Ms Feltovic,the NACC voted unanimously to approve the Order of Conditions as
drafted and amended
242-1112 -Lot 2,map 106B north of 505 Forest St (Paul Plismski)(Michael Cuneo)
On a motion by Mr Mabon, seconded by Ms Feltovic,the NACC voted unanimously to issue a denial of
the Order of Conditions as drafted and amended
The NACC decided to recess until 8 00 P M

Mr Paquette stated that the flag locations were confirmed in the field and he had no further issues with
the Wetland Delineation Mr Paquette recommended that the NACC issue a positive Determination of
Applicability On a motion by Mr Mabon, seconded by Mr Lynch,the NACC voted unanimously to
approve the Request for Determination of Applicability as drafted

242-1065 - Boxford St 104D Town of North Andover(Ben Gary)
Mr Paquette stated the review from Coler& Colantonio indicated there should be test pits to verify the
elevation of seasonal high groundwater Mr Paquette stated he could condition the test pits into the
Order of Conditions Mr Lynch asked if the NACC closed the file, could the test pits be done in two
weeks Mr Lynch stated that the Applicant should do the test pits in the coming week and, assuming
favorable results,the NACC could close and issue a decision at the next Public Hearing on 1/9/02 Mr
Hmurciak(North Andover Town Representative)agreed and will get together with Mr Paquette to select
test pit area Mr Lynch inquired as to how often the basin's would be cleaned out Mr Hmurciak replied
at a minimum they would be cleaned once a year Mr Paquette stated that the project was in compliance
with all setbacks An Abutter asked who he should go see to try to prohibit parking on Boxford St Mr
Masse suggested the Selectmen or the Town Manager On a motion by Mr Mansour,seconded by Ms
Feltovic,the NACC voted unanimously to continue to 1/9/02
