M. Contarino, The deed, a copy of which is enclosed, is dated May 5, 1998. I have not performed a title search with respect to this land; not have you requested me to do so. As I understand the Town Planner's May 13, 1998 letter to Attorney Latham, the Board intends to vote on the acceptances on the three streets (East Pasture Circle, Beechwood Lane, and Sugarcane Lane Extension) listed on Article 33 of the 1998 Annual Town Meeting, once all necessary documents for the three acceptances are received and reviewed. The Town Planner sent the Sugarcane Lane Extension deed acceptance to you on June 2, 1998. I am waiting to receive a revised deed from the landowner's attorney for East Pasture Circle, including an access and utility easement on Lot 3 which does not appear to have heretofore been granted to the Town. Once I receive the revised East Pasture Circle deed, I will forward a copy to you with an acceptance form so that you may arrange for a vote on all three deed acceptances. Once the Board has voted on these acceptances, please return the deed acceptances to me with three certified copies of the vote under Article 33 of the 1998 Annual Town Meeting. James, Jr., Esq. 23 Main Street Andover, MA 01810 Re; Beechwood Drive—Acceptance as a Public Way Dear Attorney James, At last night's town meeting, the Town of North Andover voted to accept Beechwood Drive as a public way subject to the final receipt of all easements and deeds. Based upon a review of the as-built plans by the Department of Public Works, a water easement must be granted to the Town over a portion of Lot 3 as referenced in the attached letter from Timothy Willett, Staff Engineer. The deed as submitted is acceptable, The deed must be signed and the Board of Selectmen must officially vote to accept the deed. Jeanne McKnight of Kopelman&Paige will draft an acceptance of the deed for the Selectmen to sign. When all of the documents for all of the accepted streets have been received and reviewed, the Selectmen will schedule a meeting to vote upon the acceptance. The deed may then be recorded. Based upon a review of the as-built plans by the Department of Public Works, a water easement must be granted to the Town over a portion of Lot 3 as referenced in the attached letter from Timothy Willett, Staff Engineer. The deed as submitted is acceptable, The deed must be signed and the Board of Selectmen must officially vote to accept the deed. Jeanne McKnight of Kopelman& Paige will draft an acceptance of the deed for the Selectmen to sign. When all of the documents for all of the accepted streets have been received and reviewed, the Selectmen will schedule a meeting to vote upon the acceptance. The deed may then be recorded. The remaining bond money held for this project will not be released until the Planning Department has received certified copies of the recorded access and utility easement and deed referenced above. .
