Dear Planning Board Members;
In August 1994 the Board issued approval of a three lot subdivision of land known as
Beechwood Hill located at 1755 Osgood Street which subdivision is now Beechwood Drive. The
Subdivision Plan was recorded on September 4, 1996 as Plan No. 12902 along with the Form I
Covenant dated July 31, 1996 recorded at Book 4586 Page 50.
In August 1996 the Board approved a Site Plan Review Special Permit for construction of a
30,000 square foot building on what was originally Lot 2. As part of the approval the owner
agreed to move the building as originally proposed closer to Osgood Street creating an additional
50 foot buffer between the residential neighborhood to the east of Lot 2, and not allowing
vehicular access to the east side of the building. In order to accomplish this, additional land was
required for vehicle access and parking on the west side of the building. This was accomplished
by taking Iand from Lot 1, and a new plan was recorded showing Lot IA, Lot 2A and Lot 3 (Plan
No. 12911), The Notice of Decision of the Board granting the Special Permit references Lot 2
while the decision itself references Lot 2A. The Form J Release dated September 17, 1996 and
recorded at Book 4595, Page 215 releases only Lot 2, Since Lot 2A includes a portion of the
former Lot 1, a release is needed to include that portion of Lot I now a part of Lot 2A.
There has been no construction.on Lot IA, and Lot IA will still require a Site Plan Review
Special Permit before any construction is allowed,
Lot 3 consists of an office park which was constructed prior to the subdivision, and should not
have been included in the original Covenant.
The owner is seeking release of all three lots from the Covenant. As Lot 3 was previously
constructed and Lot IA is vacant land, we request that the board approve the modification of the
Site Plan Review Special Permit as an unsubstantial change.
