Quorum present. General Business PCOC,242-816,Lot 11,Campbell Forest LLC Ken Ahern of Mesiti Development was present at the meeting Alison McKay stated the address of Lot 11 is 201 Webster Woods Lane The as-built plan has some minor deviations from the proposed plan Alison McKay stated all work on this lot is entirely outside of the 100 foot buffer zone and is non-jurisdictional.Ken Ahern stated he wanted to continue for four weeks to the February 12, 2003 meeting Motion to continue Lot 11 for four weeks to the February 12, 2003 meeting by Joseph Lynch, seconded by Albert Manzi Vote Unanimous PCOC,242-816,Lot 6,Campbell Forest LLC Ken Ahern of Mesiti Development was present at the meeting Alison McKay stated the address of Lot 6 is 155 Webster Woods Lane The as-built plan has some minor deviations from the proposed plan A building permit was submitted for the construction of a pool within the buffer zone The application was rejected for the reason that a modification was needed No modification was found in the file, but the building permit was issued The pool is within the 100 foot buffer zone, but outside of the 50foot No-Build zone Ken Ahern stated the finish coat is on the road Joseph Lynch stated this area has rocky soil and has high runoff Albert Manzi stated the by-pass culvert construction was conducted to reduce the flooding that occurred in this area for years Ken Management) Mr Marc Pouter, the applicant, and Michael Poiner from This Olde Spouse were present at the meeting Sean McDonough read the legal ad into the record Alison McKay stated the RDA filing is for reconstruction of an existing deck into a sunroom in the same footprint Ms Pamno stated the reconstruction would not require grading A four-foot balcony expansion will be constructed and two hand dug sons tubes will be installed Albert Manzi stated he wants an As- built requirement Motion to close and issue a Negative Determination with a pre-construction meeting and as-built plan condition by Joseph Lynch, seconded, by Albert Manzi Vote Unanimous DEP#242-1169- 2357 Turnpike Street, (Valley Realty Trust)(West Environmental) Mark West of West Environmental, Jerry Lynn Darcy of Valley Realty Trust and Steve Trettle of GZA were present at the meeting Mark West stated wetland buffer enhancement areas will be seeded with a New England Upland mix, mixed with arrow-wood and pine bushes Restoration will be monitored per request of the Administrator Ms Parrino stated the Town of Middleton had significant concerns on the downstream impacts to the Emerson Bog, which is the Danvers and Beverly water supply Ms Pamno stated DEM issued a letter stating they do not want any discharge of storm water to the wetlands hydrologically connected to the state park wetland resources Ms Parrino reviewed the letter submitted by GZA dated 12/24/02 and the new revised submitted plans Ms Parrino stated applicant needs snow stockpiling areas shown on the plan Joseph Lynch discussed the concerns of the Town of Middleton Mr Lynch satisfied small wetlands not ILSF Brad Wire, an abutter on Turnpike Street requested to review the plan Ms Parrino discussed Lisa Eggleston's review letter regarding the drainage flow towards the vernal pools Steve Trettle stated all the reviews have been completed Motion to continue to January 22, 2003 meeting by Sean McDonough, seconded by Joseph Lynch Vote Unanimous DEP#242-1174, Lot 4 DEP#242-1175, Lot 5 Waverly Road (Highview LLC) (Seekamp Environmental) Steve Stapmski of Merrimack Engineering and Mr Chris Wazczuk, an abutter, were present at the meeting The two lots were discussed together at the meeting Ms Parrino stated the final submitted plans show driveway spot shots and a revised drainage design Ms Parrino stated she believes all the issues have been resolved Joseph Lynch stated he has drainage concerns for Lot 5 Albert Manzi stated a bmder coat should be applied immediately on the driveway upon completion of construction Chris Wazczuk stated retaining wall close to the 50-foot No-build Zone Chris Wazczuk stated he would be sending a letter to Robert Nicetta, the Building Commissioner, stating his concerns Ms Parrino stated new plans have been submitted with revised grading to the rear of the property and also grade changes to the driveways Motion made to close both hearings and issue a decision in 21 days by Joseph Lynch, seconded by Albert Manzi Vote Unanimous DEP#242-1180-Route 114 to Palomino Dr. (Valley Realty Development)(West Environmental) Jerry Lynn Darcy of Valley Realty Development, Mark West of West Environmental and Steve Trettle of GZA were present at the meeting Sean McDonough read the legal ad into the record Ms Pamno stated the NOI is for the installation of a 12-inch sewer line and an 8 inch water main along the shoulder of route 114, from Palomino Drive to the Middleton line Ms Parrino stated the wetland line has not been reviewed Formal approval of the wetland delineation will not be conducted under this filing as the wetland line on the plans are shown in approximate locations Abutter John Waters questioned if the project would be cutting thru driveways off Route 114 Mark West stated work would occur through driveways and all driveways would be repaired upon installation of the line Brad Wires, an abutter was present at the meeting and questioned if he would be able to tie into town sewer Jerry Lynn Darcy stated yes if on gravity but will not be providing any stubs for tie-ins The sewer line is designed for future development beyond the Meadows project stating if they would be able to be connected to the sewer line Jerry Lynn Darcy stated that maybe in the future but they will not be installing any stubs for the sewer line Ms Pamno stated erosion controls would be in place Albert Manzi stated that the Town of North Andover would take over the responsibility of the sewer in the future Motion to continue to the January 22, 2003 meeting by Joseph Lynch, seconded by Albert Manzi Vote Unanimous DEP# 242-1179, Bradford Street, Carter Hill (Tara Leigh Development LLC)(Epsilon Associates) Michael Howard of Epsilon Associates, Thomas Zahoruiko of Tara Leigh Development and Mark Gross of MI-IF Design were present at the meeting Sean McDonough read legal ad into the record Thomas Zahoruiko stated the land swap between Boxford and North Andover was approved by the State of Massachusetts Ms Parrino stated the NOI is for the construction of a roadway through an intermittent stream and bordering vegetated wetland to service a 17-lot subdivision outside of the buffer zone to bordering vegetated wetland, also included is offsite construction of sewer and gas Roadway is filed under the limited project provisions The wetland delineation was revised and impacts were reduced from 2900 s f to 2,080 square feet The crossing area will have vertical retaining walls and the replication area is proposed to be 6,000 s f in size The applicant secured an easement from Mr Barker for access over an active agricultural field The subdivision is a PRD and a small portion of the site is being developed while the remainder, approximately 95 acres is to be left in open space Except for the crossing area, no work proposed in the buffer zone This development also contains three ball fields to be used by the public Thomas Zahoruiko stated the fields would have 120 spaces of parking Albert Manzi stated 120 spaces would not be enough parking for the fields Elsie Pouliot, a member of the Open Space Committee was present at the meeting Ms Parr no proposed additional plantings be added to the replication area Concerns were raised regarding stormwater management All discharges proposed just outside the 100 foot buffer zone Commission discussed the requirement for stormwater review if no discharge in the buffer zone Applicant agreed to allow a limited stormwater review Motion to set up an outside escrow for Lisa Eggleston to review storm water management for the amount of$ 2000 and to continue to January 22, 2003 meeting, by Joseph Lynch, seconded by Albert Manzi Vote Unanimous Decisions RDA 160 Christian Way, (Poirier) (Wetlands& Land Management) Mr Marc Poirier the applicant, and Michael Poirier from This Olde Spouse were present at the meeting Motion to close and issue negative determination with conditions by Joseph Lynch,
