HomeMy WebLinkAbout2003-01-22 Conservation Commission Minutes Conservation Commission Meeting January 22, 2003 Board Members Present: Scott Masse, Chairman, Albert Manzi, Jr , Vice Chairman, Joseph W Lynch, Jr , Deborah Feltovic, Sean F McDonough Board Members Absent: Beth Wescott, John J Mabon Staff Members Present: Julie Parrino, Conservation Administrator, Alison McKay, Conservation Associate Donna Wedge, Secretary. Meeting came to order at 7:10 pm General Business 242-989, 52 Laconia Circle - Modification & COC (Lot 1D) (Letwin) (Neve Associates) No one was present The Order of Conditions was issued on 11/17/99 for the construction of an mground swimming pool enclosed by screen house, grading and associated utilities within the buffer zone of a BVW A formal modification was approved on 10/10/01 for an addition to an existing deck The modification now was for a boulder wall in lieu of the grading/slopes for the project Ms Parrino stated that a modification request fee would be submitted under a separate cover Ms Parrino stated that a site inspection was performed and the site was stable A motion to accept the modification was made by Joseph Lynch, seconded by Deborah Feltovic Unanimous. A motion to grant a COC was made by Joseph Lynch, seconded by Deborah Feltovic. Unanimous 242-589,Heritage Estates—Partial Bond Release (Brookview Country Homes)(Kindred) David Kindred of Brookview Country Homes was present The Order of Conditions was issued on 115100 for construction of a 12 lot residential subdivision including homes, roadway, driveways, water and sewer lines, utilities, drainage structures, grading, and other necessary appurtenances within the buffer zone to BVW The total bond posted was $28,000($10,000 for the roadway and drainage structures and $18,000 for the lots - $3,000/lot x 6 lots) Ms McKay stated she had frequently inspected the project and all work was complete All lots were stable with the exception of lot 11, which was discussed under a violation letter with the current owner due to additional landscaping along a significantly sloped area The applicant will be subnutting certification letters and a formal request for full compliance in the spring A motion to grant a partial bond release in the amount of $14,000 was made by Joseph Lynch, seconded by Deborah Feltovic Unanimous Filing Fee Appropriation for Conferences and Workshops A motion to encumber$1,500 from the filing fee account was made by Albert Manzi, seconded by Joseph Lynch Unanimous Recess for 15 min. Albert Manzi left the meeting at 8:OOpm. Public Hearing 8:OOpm. 242-1162, 10 Commerce Way (Grasso)(Hancock Environmental)(Cont.from 12/18/02) No one was present Ms McKay stated that the applicant was all set to move forward, however Ms Eggleston had not been able to fully review the revised report/plans due to her mother's passing Therefore, the applicant has requested a continuance in writing to the meeting of February 12, 2003 Motion to continue to February 12, 2003 meeting made by Scott Masse, seconded by Deborah Feltovic Unanimous 242-1179, Bradford Street, Carter Hill (Tara Leigh Development LLC) (Epsilon Associates) (Cont. from 1/8/03) Michael Howard of Epsilon Associates was present Revised plans and revised wetland replication planting plans were submitted Ms Parrino stated that according to the stormwater policy, discharges outside of the buffer zone were not subject to Conservation jurisdiction The applicant had requested a waiver of the drainage review due to the lack of jurisdiction Mr Howard defended that the vegetated swale had a long way to go before water reached the wetland Mr Lynch argued that the discharge outlet was just beyond the 100-foot buffer and the slope beyond the 100-foot buffer was significant enough to create significant erosion problems within the jurisdictional buffer zone Mr Howard stated that the appropriate stormwater information and documents were included with the filling Mr Lynch stated the Commission should know how ground water would be handled and how runoff would be controlled A motion to continue to February 12, 2003 meeting .� was made by Joseph Lynch, seconded by Deborah Feltovic Unanimous l 242- 2060 Turnpike Street (Brian Walter) (Neve Associates) Greg Hochmuth from Neve Associates was present The filing was for restoration of the BVW and buffer zone as required under an Enforcement Order Alteration included fill and clearing in a BVW resource area and clearing, grading and construction of a swingset play area in the 25-foot No-Disturbance Zone Ms Parnno said the violation was discovered and the applicant was told not to proceed with any more work Ms Parrino said that one week later the site was revisited and grading activities and the construction of a swingset play area was identified Ms Parrino said that a $300 a day fine was levied until restoration was completed Ms Parrino added that the applicant said he would meet with her and never did Because of these facts, Mr Masse felt that the fines were appropriate and should continue until restoration was completed Mr Lynch noticed that the applicant has done work on his neighbor's property Greg Hochmuth said that the applicant did not know were his property line were and was unaware that this had occurred The Commission felt that since the applicant had recently purchased the home, with the seller recently receiving a Certificate of Compliance, he should have been well aware of his own property boundaries and the resource areas on the property Ms Parrino said the wetland line was reviewed and approved.Ms Parrino stated the planting plan was reviewed and approved. Ms Parrino said she felt that a boulder wall should be required along the newly planted 25 feet No-Disturbance zone Mr McDonough felt it was necessary to notify the neighbor that work had occurred on their property Mr Lynch said he wanted to see a 2-foot high wall as a physical barrier Mr Hochmuth requested that a post and rail fence be installed instead, as it right work better in the area The Commission denied the request They felt that a large boulder wall was a more permanent structure, which would act better as a deterrent from encroachment Mr Hochmuth argued to decrease the fines under the fact that the applicant had contacted his company immediately to resolve the issue and that current weather conditions would prohibit immediate restoration work The Commission agreed that the initial fine would stand A motion to continue to February 12, 2003 meeting was made by Deborah Feltovic, and seconded by Joseph Lynch Unanimous. 242-1169,2357 Turnpike Street(Valley Realty Development) (West Environmental) (Cont. from 1/8/03) Jerry Lynn Darcy from Valley Realty Development was present Ms Parrino discussed some additional conditions for the project and stated that all materials have been submitted She presented a draft OOC to the Commission Motion to close and issue decision in 21 days was made by Joseph Lynch, seconded by Deborah Feltovic Unanimous 242-1180, Route 114 to Palomino Dr. (Valley Realty Developmentally) (West Environmental)(Cont.from 1/8/03) Jerry Lynn Darcy from Valley Realty Development was present Ms Parrino stated new revised plans had been submitted and were reviewed A pre-construction meeting would be a requirement Mr Lynch asked if all work would be conducted in the gravel shoulder of the road. Ms Parrino stated that all work would be in the shoulder of the road Ms Parrino stated new revised plans were submitted and reviewed and a draft OOC was prepared A motion to issue a decision in 21 days by was made by Joseph Lynch, seconded by Deborah Feltovic Unanimous Decisions 242-1174,Lot 4 & 242-1175,Lot 5 Waverly Road (Highview LLC) (SeeKamp Environmental) Both the lots were discussed together Mr Lynch requested that a binder coat be placed on the J1 driveway within the first two weeks of construction Mr Lynch also requested 10 yards of 3/a" stones to be placed as a check dam backed by haybales Ms Parrino indicated that prior to the pre- construction meeting she would make the check dam a requirement and would note this in the Order The bond amount for lot 4 was discussed to be $2,500 and the bond amount for Lot 5 was discussed to be $6,000 because the house was in the buffer zone A motion to issue a decision in 21 days was made by Albert Manzi and seconded by Joseph Lynch Unanimous 242-1169, 2357 Turnpike Street,The Meadows (Valley Realty Development) Ms Parrino reviewed some of the conditions with the Comnussion Erosion controls would be placed along the 25 feet No-Disturbance zone, weekly monitoring reports would be required, and a pre-construction meeting would be held The bond amount would be $65,000 A motion to issue a decision in 21 days was made by Joseph Lynch and seconded by Deborah Feltovic Unanimous 242-1180, Route 114 from Meadows Property to Palomino Drive, (Valley Realty Development) (West Environmental) Ms Parrino discussed some of the conditions with the Commission Dewatering procedures, erosion controls, and stockpiling would be discussed and approved at the pre-construction meeting The bond amount would be $5,000 A motion to issue a decision in 21 days was made by Joseph Lynch and seconded by Deborah Feltovic Unanimous Meeting Adjourned at 9:30 pm.
