Conservation Commission Meeting
June 11,2003
Members Present: Scott Masse, Chairman, and Albert Manzi, Jr , Vice Chairman, John J
Mabon, and Deborah Feltovic
Members Absent: Joseph W Lynch, Jr., Sean F. McDonough
Staff Members Present: Julie Parrino, Conservation Administrator, and Alison McKay,
Conservation Associate,Donna Wedge, Conservation Secretary
Meeting came to order at 7:15pm Quorum was present.
General Business
242-1176-COC, 45 Settlers Ridee Road (Gross)
No one was present Ms Parrino stated the Order of Conditions was issued on 11/12/02 for the
construction of an enclosed addition to an existing deck located in the buffer zone to a bordering
vegetated wetland The as-built plan is in conformance with the proposed. There was no grading
associated with the work The applicant has stabilized the site with stone and seed as requested
The site is stable and there are no pending issues A motion to issue a COC and bond release was
made by Albert Manzi, seconded by John J Mabon Unanimous
242-589- COC.Heritage Estates (Brookview Country Homes,Inc.)
John Barrows of Marchionda was present Ms. McKay stated all the homes, with the exception
of lot 12 were proposed outside of the 100-foot buffer zone The 50-foot no-build and the 25-foot
no-disturbance were held except at the road entranceway as approved in the order The applicant
has submitted all required paperwork for the COC request on 6/2/03. A modification was issued
for lot 12 for a change in the driveway. The wetland markers are up as required Mr. Barrows
stated the drainage is working very well The detention drainage was cleaned about 2 months
ago Ms McKay stated that jute matting has been installed on Lot 11 and additional grass seed
has been added All the lots and drainage structures appear to be in compliance and are
adequately stabilized. Mr Manzi requested that upon removal of the haybales, the disturbed un-
vegetated areas be seeded A motion to to issue a COC and bond release was made by Albert
Manzi, seconded by Deborah Feltovic Unanimous
242-158,PCOC,Lot 69, 346 Bear Hill Road (Davis)
No one was present Ms McKay stated the Order of Conditions was issued on 9/8/82 for the
construction of numerous lots in the Bear Hill Subdivision The Subdivision had not received
final compliance, thus causing individual lot owners to apply for a PCOC The homeowner is
requesting a release of the Certificate of Compliance for Lot 69 (#346) This is a non-
jurisdictional lot, with no wetlands within 100 foot A site inspection was done on 6/6/03 which
verified no wetlands existed within 100 feet of wetland resource areas A motion to issue a
PCOC for Lot 69 was made by John J Mabon, seconded by Deborah Feltovic Unanimous
242-885, Modification & PCOC-Lot 32 Forest View(Pulte Homes)
John Barrows of Marchionda was present Ms McKay stated approval predated the 75-foot No-
Build Zone from a vernal pool The modification is for the addition of a retaining wall in the rear
yard, two small retaining walls at the front left of the dwelling, an A C unit on the left side of
the house, a short retaining wall on the right rear corner of the dwelling and revised grading
within the limit of work Included in the modification 1s a request for approval of a front
walkway All the final work including the above modifications complies with the 50-foot and 25-
foot setbacks The site is stable Mr Manzi stated there are too many changes being requested
under this modification. He stated significant modification requests should not be addressed at
the same hearing as the request for a Certificate of Compliance. Mr Masse stated he felt the
modification is minor and insignificant A motion to issue the modification was made by John J.
Mabon, seconded by Deborah Feltovic Vote 2 to 1, Albert Manzi opposed A motion to issue the
PCOC was made by Deborah Feltovic, seconded by John J Mabon Vote 2 to 1, Albert Manzi
opposed.

John Barrows of Marchionda was present. Ms. Pamno stated this item has been removed from
the agenda
242-1154, 103 Lost Pond Lane(Bielicki)
No one was present. Ms Parrino stated the OOC issued 7/25/02 for construction of an addition
and deck in the buffer zone to BVW. The deck footings are 50 feet from the wetland however the
deck overhang is 48 feet from the wetlands The base of the deck is enclosed with wood lattice.
The site is stabilized Four plantings have been installed along the edge of the lawn within the
25-foot No-Disturbance Zone. A motion to issue a COC and Bond Release was made by
Deborah Feltovic, seconded by John J Mabon.Unanimous

No one was present Ms.McKay stated the Order of Conditions was issued 2/8/96 for
construction of a single family home and driveway and associated utilities and grading The
applicant had planted the requested plantings upon the receipt of the letter in the fall of 2002 A
site inspection was performed on 6/6/03 to verify the number and the health of the plantings All
the plants appear to be in good health and all previous outstanding violations have been
addressed A motion to issue a COC was made by Deborah Feltovic, seconded by John J
Mabon Unanimous
A motion by Deborah Feltovic was made to re-elect Scott Masse as the Chairman and
Albert Manzi as Vice-Chairman, seconded by Jack Mabon.Unanimous.

Ben Osgood was present Ms Parrino stated she met with Ben Osgood in the field to review
wetland flags and some changes made,the wetland line needs to be re-surveyed. Ms Parrino
stated it may be a good idea for Epsilon to review the line as some changes may be necessary
The applicant requested to continue to the June 25, 2003 meeting A motion to continue to June
25, 2003 meeting was made by John J Mabon, seconded by Deborah Feltovic Unanimous

Brian Graves of Epsilon was present Ms Parrino stated revised plans have been submitted
depicting the changes re-flagged in the field A letter was prepared to the applicant addressing
the drainage issues that will need to be addressed during the NOI process A motion to close and
issue the ANRAD confirming the wetland boundary locations was made by Albert Manzi,
seconded by John J Mabon Unanimous

Ben Osgood of New England Engineering was present Mr Mabon read the Legal Notice Ms
Parrino stated the filing is for a septic replacement in the buffer zone of BVW The septic is
approximately 70 feet from the resource area, with the limit of work approximately 55 feet The
work is to be conducted within a previously disturbed area The wetland line was reviewed and
approved A large leaf pile was observed directly in the resource area, within standing water It is
unknown if the leaves were dumped by the applicant or neighbor, however it must be removed
immediately A letter will be sent to the abutter if necessary A motion to issue a Negative
Determination of Applicability with conditions was made by John J Mabon, seconded by
Deborah Feltovic Unanimous

Thomas Childs a Board Member of the North Andover Country and John Bresnahan a Turf
Grass Management Specialist were present Mr Bresnahan stated the IPM Plan continues to be
revised and the golf course is willing to participate in the Certified Audubon Cooperative
Sanctuary Program Ms Parrino stated the golf course must continue to monitor the water quality
on the golf course The revised plans submitted are at a 20 scale A motion to close and issue a
decision in 21 days was made by John J Mabon, seconded by Deborah Feltovic Unanimous

Charles Katuska of ECO-Solution was present Ms Parrino stated revised plans have been
submitted and reviewed A motion to close and issue a decision in 21 days was made by Albert
Manzi, seconded by Deborah Feltovic Unanimous

Ben Osgood of New England Engineering was present Mr Osgood stated plantings were
previously conducted in the 25 foot No-Disturbance The wall will be no more than 2 feet in
height The shed located in the No-Build Zone is on blocks Mr Manzi stated every back yard in
this area is in the Riverfront area the foundation for this house had an area that jetted out and the
construction of a patio within this area was previously approved No DEP file number has yet
been issued A motion to continue to the June 25, 2003 meeting was made by Albert Manzi,
seconded by Deborah Feltovic Unanimous

Eugene Willis of Christiansen& Sergi, Inc and Timothy Willis were present Ms Parrino stated
the house meets the 25 foot and 50 foot setbacks Wetland flags 1 through 5 were approved Ms
Parrino requested that the applicants continue the wetland line off property as buffer zone
extended onto the lot The wetland line is shown as approximate and Ms Parrino questioned
how the delineation was approximated in the field Ms Parrino stated erosion controls need to be
shown on the revised plans There is a high possibility for encroachment in the 25 foot No-
Disturbance Area and a permanent barrier must be constructed along the No-Disturbance Zone
A motion to continue to the June 25,2003 meeting was made by Deborah Feltovic, seconded by
John Mabon Unanimous

The bond amount was set at $ 2,500 Erosion controls and weekly monitoring will be a
requirement A motion to accept as drafted was made by Albert Manzi, seconded by Deborah

Albert Manzi, seconded by Deborah Feltovic, made a motion to issue a Negative Determination
with conditions Unanimous
500 Great Pond Road (North Andover Country Club)
A motion to set the bond amount at $2,000 and to require no snow- stockpiling signs at the edge
of the parking lot was made by Deborah Feltovic, seconded by John Mabon
