HomeMy WebLinkAbout2003-06-25 Conservation Commission Minutes DD �Conservation Commission Meeting June 25,2003 Members Present: Scott Masse, Chairman, Albert Manzi, Jr, Vice Chairman, Joseph W Lynch, Jr.,Deborah Feltovic, and Sean F McDonough Staff Member Present: Juhe Parrino,Conservation Administrator, Alison McKay, Conservation Associate and Donna Wedge, Conservation Secretary. Meeting came to order at 7:05pm Quorum was present. General Business 242-1140-COC, 107 Old Farm Road (Karelas) No one was present.Ms McKay stated the Order of Condition was issued on 5/14/02 for the construction of an addition to an existing dwelling in the buffer zone to a bordering vegetated wetland The addition was proposed to be, at its closest point, 50 5 feet from the resource area The as-built plan shows the addition, at its closest point, 54 5 feet from the resource area There was no grading associated with the work. The wetland markers are up. The site is stable. A motion to issue a COC and to release the bond was made by Ms Feltovic, seconded by Mr Lynch. Unanimous 242-1084&NACC#13,Modification,443 Boston Street(Mongell) Mrs. Mongell was present. Ms. Parrino stated the modification was filed for the increase of the size of the addition and for the addition of two sonotubes to support a roof over hang The work meets all setback requirements A motion to issue a modification was made by Mr. Lynch, seconded by Ms. Feltovic Unanimous. 242-1089-COC,Lawrence Municipal Airport(Dufresne& Henry) Michael Miller,Airport Manager and Jeffrey Dubois of Dufresne&Henry were present Ms Parrino stated the project was completed last summer Additional clearing was conducted with review and approval by Ms Parrino, however the clearing was out of the 100-foot buffer zone The site was reviewed in the field by Ms. Parrino and is stabilized. Commission members questioned if this work was separate from the VMP filing Ms. Parrino stated this project is separate from the VMP project A motion to issue the COC and the bond release was made by Mr. Lynch, seconded by Ms. Feltovic Unanimous 242-1179,Carter Fields,(Tara Leigh Development) Thomas Zahoruiko of Tara Leigh Development was present Ms Parrino stated the roadway has been constructed and the site has been continuously monitored by Epsilon Associates Ms Parrino has reviewed and approved the as-built plans of the crossing and replication area Minor erosion along the replication slopes are being addressed and the replication area appears to have sufficient hydrology. Ms Parrino recommended a partial bond release of$24,000 from the total posted $33,120 Mr Lynch stated the track record of this developer is very good he has no issues A motion to issue a partial bond release for the amount of $24,000 was made by Mr Manzi, seconded by Ms. Feltovic. Unanimous. r - 242-1057,Brooks Academy (RFS), Modification and Extension Permit John Scott of RFS, Mr Callahan of Brooks Academy, Robert Peterson of Cannon Design, and Thomas Reagan of Reagan Associates were present Ms Parrino stated the Order of Conditions was issued on 5/17/01 for construction of a new athletic facility and associated drainage structures The work is to be located within the 100 foot buffer zone An outside escrow account was set up for Lisa Eggleston to review the new modified drainage design in the amount $1,500 The applicants stated the changes are primarily interior The revised project is for the same facility but the building has been reduced in size No impacts to wetland resource areas are being proposed Drainage structures have been reduced in size to accommodate the smaller building The building was originally proposed to be two levels but has been revised down to one level The stormwater management concept is the same The building will have a natural gas pipeline connection Lisa Eggleston has reviewed the project and submitted a comment letter She expressed her concerns about the grading necessary to accommodate breakout on the slope The applicants are willing to address the concerns in Mrs Eggleston's letter The comment letter also addressed the potential of adding a forebay into the detention pond This was discussed and applicants stated they may be able to add a forebay Mr Lynch stated his concerns about the slope and the roof runoff volume into the detention pond Mr Manzi questioned the soil type in this area and requested that information be submitted as he is concerned about erosion He feels the changes are larger than a modification and should be addressed as an Amendment A motion to continue to the July 9, 2003 meeting was made by Ms Feltovic, seconded by Mr Manzi Unanimous A motion to issue an extension permit to 5/17/05 was made by Ms. Feltovic, seconded by Mr. Manzi Unanimous 242-1186,Peach Tree(Northpoint),Request to Reduce required Bond Jerry Lynn Darcy was present No action taken due to a lack of quorum. 242-968,Mr. Sudsy Carwash (Northpoint), Bond Reduction Jerry Lynn Darcy was present. No action taken due to lack of quorum Violation,24 Autran Ave. No one present Ms Parrino stated the Building Department discovered a violation last year with the installation of a deck and Jacuzzi built without a building permit, within 50 feet of the wetland; homeowners are currently before ZBA for a variance. Building Department told the homeowners last year there may be a wetlands issue The ZBA site plans do not display wetlands, however, this is a plan requirement. There are many violations on Autran Ave Ms Parrino stated she submitted a letter to homeowners on Autran Ave informing them of the presence of resource areas behind their houses and requiring them to removal all debris within the resource area There has been significant violations and continuous dumping violations_ on the properties. Mr.Manzi discussed that the houses are 40-years old homes and many are 20 feet away from the stream. Ms Parrino stated an enforcement order was sent to 96 Autran Ave for recent un-permitted activities. Commission members voted to issue an Enforcement Order a requiring the homeowner to remove the deck and jacuzzi in the buffer zone The fence is allowed to remain only upon the filing of a Notice of Intent No Recess Public Hearings 8:05pm Abbreviated Notice of Resource Area Delineation 242-1199,Lots 1 & 2 Great Pond Road (Great Pond Road Realty Trust)(New England Engineering) (Cont. from 6/11/03) Ben Osgood of New England Engineering was present Ms Parrino stated Mr Osgood is working on the re-delineation of the site The applicant has requested to continue to the July 9, 2003 meeting Motion to continue to July 9, 2003 was made by Mr Manzi, seconded by Ms Feltovic Unanimous Requests for Determination of Applicability(RDA) 43 Nadine Lane(Chamberlin & Babson) (New England Engineering) Ben Osgood of New England Engineering and Ms Chamberlin were present Mr McDonough read the legal notice and it was noted that the legal notice read as an NOI, a mistake made by the paper Ms McKay stated she has reviewed the flags in the field and feels erosion controls adjacent to the driveway should be a requirement Mr Osgood stated this is property is part of the Meadows subdivision and work will consist of relocating a driveway, converting a garage into living space and constructing a deck and shed in the buffer zone Work on the driveway should be completed within 2-3 days and no grading is proposed A motion to issue a negative determination with conditions including a pre-construction inspection, as-built plans, and erosion controls was made by Mr Manzi, seconded by Ms Feltovic Unanimous Notice of Intent(s)(Continued) 242-1194- 78 Vest Way(Milliken)(New England Engineering) Ben Osgood of New England Engineering was present The applicant needs additional time to prepare a landscaping plan within the 50-foot setback A motion to continue to July 9, 2003 meeting was made by Mr Manzi, seconded by Ms Feltovic Unanimous 242-1204,46 Wildrose Drive(Matrage)(New England Engineering)(Cont. from 6/11/03) Ben Osgood of New England Engineering was present Mr Manzi stated that he and Mike Howard spent considerable time within this area of the subdivision during it's construction Ms Pamno reviewed the files to determine if the patio and shed were previously approved As-built plans of the site did display the patio structure and shed Mr Osgood stated this is the third owner of the property The wall will only be 1'/2 feet high and is being constructed to level the land for his children Mr Lynch stated he wants medallions at the 25' No-Disturbance Zone A fence is to be constructed on top of the wall to prevent dumping Plantings may be required at the base of the wall upon construction Planting requirements to be determined by the Administrator A motion to close the hearing and issue a decision in 21 days with conditions was made by Mr Manzi, seconded by Ms Feltovic 242-1203- 0 Stiles Street(Willis) (Cont. from 6/11/03) No one was present Ms Parrino stated she told the applicants they did not need to be present. The revised plans have been submitted depicting the limit of clearing, stockpiling areas, and a stone wall along 25 foot No-Disturbance Zone In addition, plantings will be required in the 25' No-Disturbance Zone for enhancement Mr Manzi stated he wants the approved list of Environmental Monitors to be listed in the OOC, Epsilon Associates, West Environmental and Seekamp Environmental A motion to issue a decision in 21 days with conditions was made by Mr Manzi, seconded by Ms Feltovic Unanimous Decisions 0 Stiles Street(Willis) The bond amount set at $ 3,000 The boulder wall must be 36 inches height Within the 25' No Disturbance Zone, highbush and lowbush plantings can be added considered Environmental Monitors must be chosed from a list of three Epsilon Associates,West Environmental and Seekamp Environmental A motion to accept as drafted was made by Mr Lynch, seconded by Ms Feltovic 43 Nadine Lane A motion to issue a negative determination with conditions was by Mr Manzi, seconded by Ms Feltovic 46 Wildrose Drive The bond amount was set at $ 2,000 Requirements include medallions and a fence installed on the wall A motion to accept as drafted was made by Ms Feltovic, seconded by Mr Manzi Meeting Adjourned at 9:30pm.
