Please accept this request to continue the Hearing on the Road Improvements being proposed for
Saville and Wallace Streets scheduled for tonight's meeting.This request is made for 2 reasons. Clay
cannot attend dze Planning Board meeting this evening and,as far as I know,Town Counsel,Tom Urbelis
has not rendered an opinion on the key points of this proposal- namely, the impact of Subdivision
Control Law on this Wallace/Saville proposal in the context of the exceptions in Chapter 41 Sections 81-
FF;81-0 and 81-P.And secondly,we would further ask you to ask Mr. Urbelis to advise the Board on the
ability the Planning Board to lawfully endorse an ANR plats of this proposal wherein 18 pre-existing,pre-
1952 registered land lots are combined into 2 Lots (Lot A and Lot B) that meet the frontage and acreage
requirements of the current zoning by-law in this R-3 zone.We make this request in the interest of time,
Filing a new plan with land court can be quite time-consuming process.We propose that signing an ANR
plan under these circumstances is appropriate under the laws cited above. We would appreciate Mr.
Urbelis resolving both questions for the Board if the Board may be wrestling with this issue. If the Board
has no problem with this question, then Mr, Urbelis will not need to render an opinion. Our intention is
to file an ANR plan prior to the next June 4,02 meeting.Hopefully,these issues will be resolved so we can
progress with this proposal,

Hi Clay:
Just a quick reminder-the timeline for issuing a decision on the Saville Wallace Street Subdivision Application will
expire the end of July. As such, the Planning Board needs to render a decision by their meeting of Tuesday, July 24,
2002 and file a decision with the Town Clerk by the end of that week(the application was filed on March 19, 2002; 41 81
mandates the town has 135 days to make a decision) or else receive an extension of time from the applicant pursuant to
41, 81.

1 don't think you have any other new public hearings,just a lot of informal discussion items; since the meeting was
cancelled on Tuesday I would expect July 9th to be a humdinger.
P.S. - Since 1 have the power to pull rank the executive session item with Long Pasture has been placed first on the
agenda, with the discussion of permit fees immediately after.

As you are aware,we are in the process of finishing up our definitive p1m for the
above named streets. We are very close to being completed and are about to submit the
plan to Mr. Beshara and VHB. We have had some difficulty in redesigning the Booth St.
cul-de-sac such that we are then able to re-j-astall Wallace St. so that it meets the n ly
required grade. We expect to tum these plans into you for your review by the end of this
week. We kindly request the Board's indulgence in our being rescheduled for the next
meeting of the Board.

Definitive Subdivision Extension
Agreement to extend time required to take action on a Definitive Subdivision Plan
1. Pursuant to MGL, Chapter 41, Section 81U, the Board and the Applicant hereby mutually
agree that the time within which the Board shall take action on the Wallace/Seville Street
Definitive Subdivision Plan is hereby extended to end on December 23, 2002 and the
action taken on said application issued by the Board at any time on or before December
23, 2002 shall be one which complies with the time-period requirements of MGL Chapter
41, Section 81U, for the Planning Board to take final action on a Definitive Subdivision
