e: Boston Brook Estates
design approval permit has been issued for Boston Bros proposed
septic system -but a letter outlining additional approvals that will be
needed may be helpful . The project will be subject to Health Dept,
approval during construction to be sure that it does .in according to
plan. Gravity fed collection lines will be tested to confirm resistance
to groundwater intrusion; pump assemblies will be tested to assure
proper functioning; most importantly the contractor will be watched
closely as he installs the leach trenches because as I pointed out to
the designer trenches this size are very difficult to construct in
gravel fill .
n conclusion, while the project will be subject to Health Dept.
approval during and after construction it has received all the approval
it can prior to start of construction,

I have reviewed the latest revision for this plan and have
several comments:
1 Is there still a proposed retention pond in the c l de sac
nearest the l.eac ielid It would be too close .
2 1 will want to discuss with your installer how be proposes
.o dig the trenches so that the excavations don ' t collapse, before
any permits are issued.
3 Septic tank does not comply with 10 CMR 15 . 06
Dosing tank does not comply with 310 CMR 1 .
Emergency overflow tank does not comply with 310 CMR 15. 09
Sewage connection lines would have to be pressure tested after
installation to stake sure that groundwater intrusion will not
burden the system. This is a responsibility that rests with the
installer that I will wart to make clear to him,
No garbage grinders . This must be a deed restriction but how
will. it be enforced? some condo associations levy fines on members
for infringements like walking on the lawn. This is a serious issue
for community systems and I will have the cooperation of the
building and plumbing departments to guarantee that no disposals
are installed.
The leach trenches may be accepted if you find a - contractor
who can assure one that be will proper.y construct them. The plan
for the leach field seems to meet codes in other respects ,
In conclusion, I have not approved the plan, but the leach area
shows promise. The septic tank and pump cambers are still
serious obstacle and will not be approved as shown.

Number of buildable lots . The burden of proof for this is
on the developer. I will review any proposal he submits to
make sure the proposed density is supported by suitable site
conditions . I have a meeting with the design engineer scheduled
for 2- - 9 ,

was also rejected by DEQE, The design engineer is working o
revision,

It seems that sty estimate of the maximum number of septic
systems that could be designed for this site has created more
questions than answers . It is an estimate. whether 21 Lots could
e designed to satisfy health and zoning regulations I cannot say,
I based my estimate on health criteria and ten years of experience
in septic systems , there are not 21 plans for septa.c systems and there
are not 42 passing percolation tests . Maybe 40 systems could be
designed for the site, Thence is not enough data to determine exactly
at this time.
It is not the responsibility of the Health Dept. to design
subdivisions , we review proposals that developers submit. If 'you
want to determine exactly how many units of Coven.tional homes could
e built here and an estimate is not satisfactory, you will have to
require a subdivision plan that conforms to zoning regulations an
includes soil tests and individual septic designs which have been
approved by the Health Dept. This will require extensive additional.
testing. At this point I cannot give you any figures for development
density that are any more accurate than my original estimate, which
I still support. I did not take zoning requirements .n.to, account
when I formed the estimate.
In conclusion, if the estimate is not acceptable, the only
alternative is to conduct additional soil tests and design a
conventional subdivision. I am sorry my estimate caused so much
confusion and regret being placed in this position.
Concerning the proposed system itself, I have re3eoted the
design because of several serious flaws which will have to be
redesigned. The engineer is awaiting word on how many units he
will be allowed before submitting a new design, a move which I
agree with.

I have been asked to calculate the number of buildable lots
that could have been built on this 28 acre property. After review-
ing it tests, wetland borders and topographic plans, I estimate
that up to twenty one sates could be found for single family sized
septic systems. This means I approve a development density of up
o twenty one units: 3 single family conventional homes on lots
1 , 2 - and, -3 and up to 18 units of clustered 3 bedroom townhouses on
lot
As yet, no septic system plans for the site have been approved,
but the engineer is developing a plan for a large system to serve
the clustered units.

The proposed leaching system involving two leaching trench systems
located at the northerly her end of the site has not changed from u r July
14p 1989 submittal .. Based on your input, we have revised the wastewater
collection system.. There will be two pump stations ion and associated
septic c tanks serving each end of the development. Plows from pump

In response to your other comments we offer the following :
-� An above-ground motor control cabinet will contain pump on-off
switches , power shutdown light and generator connection switches ,
10 kw generator will be housed at each station site in case of
power outages
The leaching reaches are interconnected and have surface vents M
Plan sheet contains a note detailing the contractor' s requirement for
field pressure testing of the pump chambers and septic tanks to insure
that these structures will be water-tight .
We have eliminated the emergency overflow tank' from the site and
detail plans and are proposing the use of an Oran 10 kw portable
generator . This generator will e stored in a common space area in Unit
No. 18 and the condominium association will contract with a maintenance
company to operate the generator in case of power outages .

linear feet of frontage can Salem Street in order to provide the
roadway access to the residential units . This will combine two
frontage lots owned by George Farr into one lot on Salem Street
south of our proposed roadway .. sheet No, 1 of the 4 lot
subdivision l a now has the perimeter shaded in order to
highlight the property.
2 , TYPICAL BUILDING ELEVATIONS - we have prepared architectural
elevations of the � 3 and 4 unit townhouses for your review.
3 , PERSPECTIVE PLAN FROM SALEM STREET - Two she ohes has been
submitted that illustrates the anticipated view of this
development looking from Salem Street. There will he a 500 foot
horizontal separation from these existing homes to the Boston
Brook Estate8 units . All mature trees will be preserved along
the brook and the bank leading o the proposed units thus
reducing the visibility 'to these existing homes throughout all 4
seasons.

this rov i s i ors based on the following reasons:
1 . This foot road allows the two pr i vate driveways off
Partridge Drive to extend between existing wetlands on the site
vegetated wetlands to the west and the Boston Brook to the
east i ng any adverse impacts o these natural res rces
2 , Extending his roadway an additional 100 feet allows the
cul-de-sac to be positioned at the top of an existing l •
This will eliminate any major regrading in thecul-de-sac and also
allow better visibility for automobiles in this rite rect i ors ,
3 . This subdivision roadway alignment 0 public road and two
private drives) was chosen based on a review of several
preliminary road sketches for this development . Input leading to

The Division of public works has previewed the revised plans of the
Boston Brook subdivision dated April 28, 1989 and have the following comments
to made
1. The cross-section of the roadway as designed is unacceptable,
Our typical cross-section requires 26 foot wide pavement, 8 foot
wide shoulders at a ' slope and 2 to I side slopes. Any
slopes greater than 2 to I should be rip-rapped.
2. The bridge detail is incomplete. The finish grading is not
shorn completely in the areas adjacent to the box culverts,
giving the appearance that they are not backfilled. As shown,
wingwal.l.s are obstructing the two outer box culverts.
The entire area over the bridge should be backfill.ed to a
grade which maintains a standard cross-section. Headwall
should be instal.l.ed at the same grade at the roadway and
wingw l.l.s shod match the grade of the side slope.
8. The Flared ends of the 86" culvert on the east side of
the bride does not extend far enough to meet the proposed
finish contours.
4. The drain in the public roadway should be located near the
edge of pavement, not at the centerline, with manholes off
the road wherever possible. A catch basin to catch basin
configuration may be used to facilitate installation.
. It is unclear where property lines exist or if the town
. .w. is wider than 50 feet, If the , .w. is 50 feet
wide, the intersection with the street line of Salem St.
shall have a transition radius of 30 feet.

Since our last meeting substantial progress has been made
with the Board of Health, The proposed system has gone through
extensive review with respect to technical compliance with
Title 5 standards and the necessary adjustment8 made as
suggested by Mr. Graf.
We scheduled a 10 :00 A.M. meeting with Mike on February
2 l 1989 at which time a comprehensive analysis of all soil
tests will be reviewed. It is expected that the Board of Health
will submit recommendations shortly thereafter.
Actor inglyr further deliberations with your Board at this
time are premature. Please accept this letter as authority to
exceed any statutory time constraints that may be working
against you until the date of your next regularly scheduled
meeting.

Your Applicant consulted extensively with the Board o
Health on the above cited development and Mr. Graf offered the
observation - that unit owners in the condominium may at various
times in the future install garbage disposal appliances in
their units without knowledge of the Town and/or Condominium
Organization. Mr. Graf feels that this would substantially
impact the efficiency of the septic system and, acc rd .nglyr we
offer the following to deter and enforce against such
circumstances.
Each unit deed shall contain the following language:
"This conveyance is made subject to Paragraph �
Section r of the Condominium Bar-Laws with
respect to the installation and/or maintenance of
garbage disposal appliances or other such systems in
the unit conveyed herein. 11
This clause in the deed would run with the title of the
unit and establish conclusively that the unit owner took title
with knowledge of the provisions in the By--Laws with respect to
garbage disposal systems. While theBy-Law ro isi s are
themselves binding, the unit deed serves to emphasize the
following provision,
The By-Laws shall contain the following enforcement
procedure:
'Each individual unit owner is prohibited - from the
installation, maintenance, and/or use of a garbage
disposal appliances for the - purposes of grinding
household garbage or waste and causing the same to
flow into the common sewerage and waste disposal
system installed in the condominium.. it . is
acknowledged that such garbage disposal substantially
deters from the efficiency of the sewerage disposal
system, . reducing its life, and resulting in
maintenance problems. The Board of Trustees has
authority to impose fines - for the ]reach of this
clause in the amount of actual damages shown t
result therefrom, or in the amount of $lrOOO .00
whichever shall be the greater . The Board of Trustees
shall have the power , and authority to compel the
removal of such garbage disposal appliances by the
enforcement procedures for breach of the Condominium
By-Laws set out in Paragraph hereof. "
