Dear Chris:
Please accept this letter as an update regarding Boston
Brook. The plans the Board recently -signed are not recorded and
shall reside in any office until -such time as Mr. Farr and Dr.
Smith -can come -to terms regarding the conveyance of the
property into Miano Realty - Trust. Attorney Hart, Attorney
Grimley and I have been in constant communication to effect the
sane -and -whale we are hopeful that contractual novations will
e forthcoming, T cannot give you any precise time frame.
will continue to hold the plans and warrant that I will
not record the same without attending to the 'down' e interest in
securing the construction of the wars.

Bear Chris:
Please accept this letter to address some of the concerns
made by members of your Board, The question is raised that
11w at if" the detention basin t wetland replication areasr etc.
are violated at any time during the construction or anytime e in
the future.
I point out that the Special Permit approved by your Board
is conditional and vests in the Conservation Commission, in
addition to their statutory standing and their order o
Conditions, a power exercised by the Conservation Commission
during and prior to construction, Please refer to Paragraph 16
authorizing the Commission to participate in the issuance o
building permits and occupancy permits, Additionallyr the
jurisdiction of the Commission is not terminated by the
completion of the project, The Commission continues in power
and if at any time in the future any change is made not in
compliance with the present Order of Conditionsr then the Town
has standing to require a new filing and enforce its local and
state regulations in the sane manner they would in any wetlands
violation situation.
While I recognize the Tanning Board' s desire to establish
control over areas not directly within their jurisdictions I
believe you have done o by the terms and conditions set in
your Special Permit which supplement and reinforce the
statutory powers already vested in the Conservation
Commission. Kindly advise if I may provide any further
reassurance regarding this matter.

Re: Boston Brook Estates
Dear Mr. Perna:
The Division of Public works has reviewed the revised plans of the
proposed Boston Brook subdivision and P. , . Most of our comments in our
letter of June 12, 1989 have been incorporated In the revised plans, however,
the following items have not been addressed:
1. The public roadway does not conform to the D.P.W. standard
roadway cross-section.
2. Show the headway and complete finish contours on the
plan view of the bridge detail.
. The eight inch gate valve and hydrant branch near the
intersection of the public and private road should be
installed on the public section of the roadway.
. Install the hydrant on the north driveway at the end of
the water main.
In addition, we have the following comments to rake
1. The requirements in the subdivision control rules regarding
installation of street trees should be enforced in the
subdivision portion of this development.
2. The sewer main and appurtenances within the P.R.D . should
conform to the D.P.W. rules and regulations for the
installation of gravity sewers in order to facilitate
any potential future connection to public sower extensions.
3. Permits for connection to town utilities will not be granted
until a complete set of endorsed plans with up-to-date revisions
is on file in the office of the Division of Public Works,
