The final siting of any structure, roadway, driveway and related
improvements shall be submitted to the Town prior to any building
permit, or site improvements are undertaken, The Board places this
condition on the application before us, in order to provide a degree o
flexibilityto the final on-site construction of the project and to
allow Town Staff the ability to determine if the final development plan
adheres to Town Bylaws or requirements and to the purposes, intent and
technical requirements of this application before us , Any issue hic .
Town Staff feels is in violation of this decision and appropriate Town
Bylaws or Regulationsr shall be submitted to this Board for
clarification and definitive ruling.
As you know, an extreme urgency exists concerning the approval of
these revisions due to financial matters . Please process this request

I have briefly reviewed the revised plans for Hickory Hill

Subdivision. I have the following comments*
1. These revised plans must be submitted to the Conservation
Commission with a letter from the engineer providing an overview
of the proposed revisions. The Commission will either choose to
modify its original approval or require a new filing,.
2 * 1 would like to discuss the specific design features of the
stormwater management system with the engineer. I will then
recommend changes.
3 . That will happen with the proposed conservation/agricultural
restrictions that were part of the previous approval?
4 , 1 would like all work on the wetland crossing to be complete
before any modifications or additional approvals are granted.
This includes learning and seeding of the shoulders at the
crossing to prevent erosion. This also means an inspection and
cleaning of all culverts and catch basins.
5 . The wetland replacement areas (2) should be inspected by the
applicant and documentation of this provided to my office.

Dear Members of the Planning load
You have asked for an opinion with regard to a proposed
modif ioation to the Hickory Hill Estates Planned Residential
Development PR The development was approved originally under
Section 8,, 5, 6oC of the North Andover Zoning By-law as a H ite
planned PR 11 , with all units located on one lot. The developer now
proposes to create individual lots for each of the PRIG units 'in
accordance with Section 8 e 5. .D of the By-law, The Board has asked
the following two questions in regard to this modification
I Does the applicant need to submit a formal def snit .ve
subdivision application to legally create the lots a
shown on the modified site plan?
The 'down bylaws allow for ANR approval on private ways
and ways not constructed up to town standards with the
attachment of a covenant and establishment of a bond to
provide security for construction of the roadway. is
this a viable alternative to the f ormal subdivision
application?
My answers to your questionsare as follows.
1. In my opinion, the applicant needs to submit a definitive
su
bdivision sion lan application in conjunction with the PRD
modifications, for either simultaneous or subsequent review and
approval the Planning Board in accordance with the Subdivision
Control. Law, G.L. c. 41, § 1K et sect. In Amy opinion, the proposed
division of the PRD tract is not exempt from the approval
requirements of the Subdivision Control. Law, as the proposed lots

do not front on any street within the exempt categories described
under c. 41f 81-Le
The information you have provided to me concerning the Hickory
Hill Estates P D indicates that the private way shown on the
development plans does not qualify pursuant to any subdivision
exemptions of G. L. c. 41, §81L since the way is not a public way,
a way shown on a previously approved subdivision plan, or a way in
existence when the subdivision control law came into effect in the
Town.. 'therefore, in my opinion, the proposed modification to
divide the PRD tract into individual lots is subject to the
Planning Board' s review and approval under the Subdivision Control.
Lair.
n my opinion, Section 8 . 5. of the Zoning By-law clearly
differentiates between "site planned PI Ds" , i*e. , those P D I s which
are approved under a site plan review process, and "subdivision
PR Ds" .. 'he submission requirements and the design standards are
different for each of these P D types. Site plan P D submissions
must meet the requirements of Section 8. 3 of the By-law (Site Plan
Review) and need meet no minimum lot size, frontage or setback
requirements, while subdivision submissions must meet the
requirements for a Definitive Subdivision Plan under the Planning
Board' s Rules and Regulations and must comply with specified
minimum lot size, frontage and setback regulations,. Also, the
minimum open space requirement differs for the two P D types.
While the differentiation in the Zoning By-law between site
planned P D's and Subdivision P D' s does not in .itself subject a
subdivision P D to approval under the Subdivision Control. Law, it
is my opinion that to the extent that a proposed P D subdivision
involves the division of the P D parcel into two or more lots,
necessitating the creation of a new way to serve those lots, such
a P D necessitates approval under the Subdivision control. Law.
2 . In my opinion, the "by-law" (actually a Subdivision
Regulation) to which you refer, does not apply to ANR endorsement
of a plan creating new lots within the Hickory Hill Estates P D.
s explained above, there are no existing "ways" which would
support ANR endorsement. In my opinion, the last paragraph o
Section 5 of the Subdivision Regulations applies only to the three
types of ways described in G.L. c. 41, § 1.L and is thus
inapplicable to the Hickory Hill Estates P D.
If you have any additional questions in regard to this matter,
please do not hesitate to contact me.

Order of Conditions on April 18, 1991 because they were told that

Notice of Intent.

I read the Planning Board' s letter to Dan Long regarding the
peclal permit PRD modifications - Hickory Hill dated March 8,
1991 and noted on page three theboard' s support of condition
10D, residential sprinkle.rs.
We believe the Planning Board' s support in the installation o
residential sprinklers in the Town of North Andover has been a
Positive approach, to fire prevention in the community.
Given the fact that the Planning Board must review specifications
for public safety, it is within -their scope to require this
condition.
Since the town has voted against the expansion of Fire Department
services y the defeat of the override questions for the construction
of station 3 and since the department is presently running under-
staffed due to unfilled or unfunded positions, the installation
of residential sprinklers becomes oven more important in providing
ire protection.

We appreciate the support and we would be willing at anytime
to present a fall explanation of the residential sprinkler
program if it is necessary in the board' s opinion.

Dear Chris:
Attached find pans for controlling the ground water and
surface runoff which we have experienced this past winter and
spring on the East side of Hickory Dill Road.
s we discussed, this appears to be the best solution; I
believe this drain will address the icing issue as well a
provide positive off-street drainage in the spring.
s you requested, we will start this work by June 1, 1992,
and complete it by June 30, 1.9 9 2 .
For your information, we will not request occupancy permits
for homes being built on the East side of Hickory Hill Road
until this work has been completed,

Per my letter to you on April 30, 1992 regarding the dra inage
on the East side of HickoryHill Road, all work was complete
n July 16, 1.992 .
Attached is an As-Built plan of the new drain for your
records, as well as a copy of the original correspondence,
As the plan indicates, we also installed 1.3 pear endicu la
slope drains, at selected locations, as an additional
precaution.
