February 11,2004
Members Present: Scott Masse, Chairman, Albert Manzi, Jr, Vice Chairman, John J Mabon,
and Joseph W Lynch, Jr
Members Absent: Deborah Feltovic, Sean McDonough, and Beth Wescott
Staff Members Present: Alison McKay, Interim Conservation Administrator, Donna Wedge,
Conservation Secretary
Mr. Manzi arrived at 7:45
Meeting came to Order at such time, as Commission now had a quorum
General Business
242-1045, Extension, 675 Chickerin2 Road, North Andover High School (North Andover
School Committee)
Fred King of Schofield Brothers was present Ms McKay said that the Order of Conditions was
issued on 3/1/01 and expired on 3/l/04, respectively An amendment to the Order had just been
approved at the last hearing The work under the Order included the construction of a new high
school, associated drainage, and parking facilities and athletic facilities The site construction is
well underway, the budding is complete, drainage is in place, roadways are complete, replication
has also been completed The final project completion date is scheduled for May of 2005 Mr
King has been working to refresh all of the wetlands flags on the site and to replace those
missing by field survey by a qualified wetland scientist Because the resource areas within the
project lmuts are extensive, more time would be needed to adequately complete this requirement
and for staff to perform a full project review Mr Lynch felt it was important to replace any
deteriorated erosion controls prior to the issuance of the extension Ms McKay added that
monitoring reports have indicated that wetland markers had been installed, but that had
apparently been removed, which should also be addressed A motion to continue to the February
25, 2004 meeting was made by Mr Manzi, seconded by Mr Mabon Unanimous

Nancy Alibrandi was present Ms McKay discussed the project The Order of Conditions was
issued on 8/l/01 for construction of an inground pool, concrete retaining wall, timber retaining,
associated grading, pool sheds, drainage swale, a boulder wall along the 25' no-disturb and
restoration and revegetation of the 25' no-disturb A modification was issued on October 10,
2001 for the replacement of the concrete retaining wall with a versalok wall and the placement of
the timber wall with a boulder retaining wall This has been satisfactorily completed The
restoration area has completed two growing seasons and plantings have been successful
Hancock Associates certified that an inspection of the drainage grate had been conducted and
that the grate was free of accumulated silt and debris, as required in the OOC Wetland markers
are also in place Monitoring reports have been submitted, the as-built plan is in conformance
with the approved plan, and the site is stable A motion to issue the COC and release the bond
was made by Mr Mabon, seconded by Mr Lynch Unanimous
Enforcement Order Ratification

A motion to ratify the enforcement order was made by Mr Lynch, seconded by Mr Mabon
Unanimous
MACC Conference
The Commission held a brief discussion about winch Commission Members would like to attend
and be available to attend the conference in March
5 minute recess.

Michael Phillips, the applicant, was present Mr Masse stated that he was working with the
Applicant and that the applicant had requested a continuance to the next hearing A motion to
continue to the February 25, 2004 meeting was made by Mr Manzi, seconded by Mr Mabon

Gene Crouch of VHB was present Ms McKay discussed that a letter from the president of
NorthMark Bank was received confirming that agreements have been executed amongst the
parties of the development project concerning drainage, the site plan and the landscaping plan A
motion to issue a decision in 21 days was made by Mr Manzi, seconded by Mr Mabon
Unanimous

No one was present The applicant had requested a continuance to the meeting of 2/25/04 Mr
Masse and Albert Manzi recused from voting No Quorum to vote Continue to the February 25,
2004 meeting
242-1234, 88-90 Farrwood Avenue (Sorkin)(Neve-Morin Group) (Cont. from 1/28/04)
John Morin of Neve-Morin Group was present Ms McKay stated that during the wetland
review, she requested that the erosion controls be extended along the fence line near the rear
corner of the building# 90 The erosion control extension has been added to the plan and Ms
McKay added that she had spoken with the contractor for the immediate implementation Since
the last meeting, staff reviewed and approved the wetland line with Greg Hochmuth of Neve-
Morin Staff recommended a change in the location of one flag and the addition of 1 more flag
These changes have been executed and revised plans have been submitted A significant pile of
at least 1,000 s f in size and with a height of greater than 6 ft of landscaping material was
discovered during the review just beyond the fence to the north west of the property (beyond
WF100A) Alison stated that the area was within the 25' no disturb and very close to the
resource area She recommended conditioning clean-up measures and a more aggressive
mitigation-planting plan as conditions to the Order She also indicated that the administrative
penalty as required in the Enforcement Order had been paid by the requested deadline The
applicant had also submitted a letter along with the payment The Commission had some
discussion regarding the contents of the letter, of which they had concern about Mr Morin
stated that the letter was sent with no knowledge to Mr Kaminski or himself Mr Lynch said it
was clear from known documents that the applicant should have know that wetland resource
areas existed on the property Mr Lynch said that the limits of the debris behind the fence
should be identified to determine whether or not the area was within the Heritage Green property
boundary or if the material was off property Mr Morin said he would try to verify the property
boundary by survey, if necessary A motion to contmue to the February 25, 2004 meeting was
made by Mr Lynch, seconded by Mr Manzi Unanimous
A motion to adjourn the meeting at 8:30pm was made by Mr. Manzi, seconded by Mr.
Lynch.
