Conservation Commission Meeting Minutes
March 24, 2004
Members Present: Scott Masse, Chairman, and Albert Manzi, Jr ,Vice Chairman, John J
Mabon, and Sean F McDonough
Members Absent: Joseph W Lynch, Jr , Beth Wescott, and Deborah Feltovic
Staff Members Present: Alison McKay, Conservation Interim Administrator, Donna Wedge,
Conservation Secretary
Meeting came to order at: 7:10pm Quorum Present.
Beaver Warrant on Town Meeting May 10, 2004
David Rand was present Mr Rand discussed the Beaver problem and how he set up Beaver
Study Committee but nothing was done The selectman took over and Ray Santilli has the Health
Department and Conservation Department giving out 10 day permits to breach the dams The 10-
day permit depends on how many beavers the homeowner is dealing with if the homeowners
have to hire a trapper it is very expensive about a$ 1000 The warrant is to see if the town would
approve 30 day permits Mr Rand just wanted to discuss this with Conservation Commission in
case they might want to make any changes

Lot 277 & Lot 278 Cotuit Street the applicant needs to hire West Environmental for soil testing
New house on Blueridge Road, the house is very high on the hill the house is 250 feet away from
wetland area this is non jurisdictional The Zoning Board of Appeals issued a decision to install a
12-inch pipe at the catch basin and 8 x 8 splashguard This could be a problem with run-off into
the wetland area Mr Manzi discuss this with the Planning Department they have slope in their
By-Law Mr Manzi stated this is only jurisdictional when the run-off is flowing into the
wetlands

Mr Manzi stated the monitoring reports are not correct no issue as of yesterday and only three
weeks of work in the replication area left The Order of Conditions expired in October of 2003
Mr Masse requested Leah Basbanes to fax a memo to the Conservation Commission for us to
review Ms McKay stated she did a site walk on March 19, 2004 some of the erosion controls
have been repaired but not around the whole site Ms McKay stated the applicant has been very
proactive in the process of having the replacement of the erosion controls Mr Mabon the run-off
from the street they should be installing they're curbing in the parking lot Mr Mabon they
should file an NOI for the replication area Mr Manzi stated do we know if the stormwater
management drainage is working no The applicant will set an escrow account of $ 2,500 to hire
Lisa Eggleston to review how the stormwater management system is working or not A
requirement will be an as-built stormwater management system plan If not in compliance will
seize the bond money

Ben Osgood of New England Engineering was present Mr Osgood stated the septic system is
outside of the resource area but the grading will be in the buffer zone This was the only place we
could place the septic system Ms McKay stated revised plans were submitted showing the play
area location Additional revised plans were submitted with minor change to a pipe diameter
associated with the septic design A motion to issue a negative determination with conditions
was made by Mr Manzi, seconded by Mr Mabon Unanimous

No one was present The applicant is dealing with DEP and to submit engineered signed plans
A motion to continue to April 14, 2004 meeting was made by Mr Mabon, seconded by Mr

Leon Wilkins and Judy von Kummer were present Ms McKay stated the garage addition is
proposed on an existing lawn area and no grading is being proposed The 50' and 25' setbacks
are being met Erosion controls have been adequately located on the plan The site is located in
an estimated habitat and was sent to Natural Heritage for review The wetland line was reviewed
and approved The fax from Natural Heritage was received late day on March 24, 2004 review
stated work would not harm any estimated habitat A motion to issue a decision in 21 days was
made by Mr Manzi, seconded by Mr Mabon Unanimous

William Dufrense of Merrimack Engineering,the applicant Robert Duffy and Frank Todd of
Frank Todd& Associates were present Mr Manzi read the legal notice Ms McKay stated the
Notice of Intent is for construction of an inground pool, associated patio, walls, cabana, grading
and utilities in the buffer zone to a bordering vegetated wetland The dwelling previously
permitted under old filing known as Sideri Place (242-339) The wetlands are more extensive
now than they were under the old filing Several changes were made to the rear wetland line
Merrimack Engineering is working on revising plans to reflect changes The 50' and 25'
setbacks are being met as proposed Soil stockpiling area should be shown on the plan Mr
Manzi stated this is a structure and would have to meet the 50 feet no-build zone including the
soil stockpiling are out of the 50-feet no-build zone Mr Mahon has concerns the back wash of
the pool we need to see and plan with the specs of the filtering and back wash of the pool need to
be include with the revised plans A motion to continue to April 14, 2004 meeting was made by
Mr Manzi, seconded by Mr Mabon Unanimous
