Conservation Commission Meeting Minutes

Meeting came to Order at: 7:05pm Quorum Present.
General Business

The applicant Kevin Grasso and Greg Hochmuth of Neve-Morin Group were present Ms
McKay stated at the last meeting the Commission felt that a modification with specifications for
the dock was necessary The applicant's representative (Neve) was notified A modification was
received for the Dock on 5/12/04 in the office Mr Manzi stated the record plan need to be in file
including the Dock before we can approve the COC Mr Hochmuth and Mr Grasso left the
office to place the Dock on the record plan Mr Hochmuth and Mr Grasso returned with the
Dock on the record plan Mr Hochmuth signed the plan A motion to issue the modification with
the Dock on the record plan was made by Mr Manzi, seconded by Mr Mahon Unanimous A
motion to issue the COC and bond release was made by Mr Manzi, seconded by Mr Mabon

The applicant Michael Phillips was present Ms McKay stated the applicant and the engineer
were notified to submit revised plans for compliance soon after meeting I did not receive any
new information until the day of the meeting Many changes, of which some required
modifications as mentioned on several occasions please see letter dated May 12, 2004 for
changes Revised plans show topo shots, all buffer zones, and are the correct scale to match the
Record plan A motion to issue the modification with letter dated May 12, 2004 was made by
Mr Manzi, seconded by Mr Mabon Unanimous A motion to issue the COC and bond release
was made by Mr Manzi, seconded by Mr Mabon Unanimous

Ben Osgood of New England Engineering was present Ms McKay stated the Order of
Conditions was issued in June of last year for the construction of a 2' high landscape retaining
wall within the buffer zone to a bordering vegetated wetland associated with Mosquito Brook
The condition# 51 required the installation of a picket style fence of a minimum of 4' in height
at the top of the wall The Commission requested the fence to prevent dumping beyond the wall
within the 25' no-disturb The applicant is requesting to modify this condition so that a 3-foot
chain link fence can be installed Mr Osgood stated the applicant would like to put the chain link
fence of Moot high the cost of a chain link fence is less costly The chain link fence will be
installed on top of the wall with cement insets to hold the fence up A motion to issue the
modification for condition# 51 change to 3-foot chain link fence was made by Mr Manzi,
seconded by Mr McDonough Unanimous

Ben Osgood of New England Engineering was present Ms McKay discussed some of the
history of the project The Order of Conditions issued on 9/26/01 for the installation of a house
addition, patio, septic tank and pump chamber within the buffer zone to a bordering vegetated
wetland A 25' no-disturb was not being maintained and is maintained as lawn The condition#
31 of the Order states, "The NACC finds a waiver of the 25' as justified in such waiver is hereby
conditioned that a dry set 2x2 stone wall will be constructed along a line that projects from an
easterly property line of the subject property The applicant is requesting a modification to this
condition, which would substitute a dense planting of evergreen trees or shrubs instead of the
wall A motion to deny the modification was made by Mr Manzi, seconded by Mr Mabon

The applicant Robert Gohn and Scott Giles of Giles Surveying were present Ms McKay stated
the Order of conditions was issued in April of 2002 for construction of an addition, an uncovered
deck and an above pool in the buffer zone to a bordering vegetated wetland The previous
Administrator granted an in house modification for minor grading changes to level the existing
grade behind the proposed work not to exceed beyond the approved limit of work An additional
in-house modification was granted to cantilever a section of the addition The 25' and 50'
setbacks have been met and project is in compliance with the Order The entire site is stable
There are no issues A motion to issue COC and bond release was made by Mr Mabon,
seconded by Mr Manzi Unanimous

The applicant Stephen Mann and Scott Giles of Giles Surveying were present Mr McDonough
read the legal notice Ms McKay stated the filing is for a 6-foot extension of an existing deck to
support a gable sunroom in the buffer zone to a bordering vegetated wetland The plans indicate
that 4 F diameter new sonotubes footings will be added to accommodate the new structure The
applicant has informed me that only 2 new sonotubes will be required, as the building inspector
confirmed existing are structurally sound to accommodate proposed No grading proposed The
wetlands are approximately 69' from the closest point and are upgradient to the proposed work
All the set backs are met as proposed Although minimal material and impact, erosion controls
are proposed I feel that erosion controls are not necessary for this particular project Conditions
should post-construction meeting and as-built plan The wetland line has been reviewed and
approved There are no issues A motion to issue a negative determination with conditions pre-
construction and post-construction was made by Mr Manzi, seconded by Mr Mabon

Kenneth Ahern was present Ms McKay stated she has met with the applicant to discuss items of
conservation relevance in this letter I felt that items 1,3, 5, & 9 were important items to address
The other items were either already addressed, not jurisdictional, or would already be
incorporated as part of the Order Additional erosion controls have been incorporated on the
revised plans The construction details and sequencing has been provided as requested Mr
Ahern stated the pipe would be installed under the driveway A motion to continue to May 26,
2004 for revised plans including storm water management was made by Mr Manzi, seconded by

The applicant David Smolag and John Murphy of Merrimack Engineering were present Ms
McKay stated the plans revised showing 100' buffer The revised plans included stockpiling area
enclosed by erosion controls The revised plans include both hay bales and silt fence The
treeline has been corrected on the revised plans Upon approval, recommend plantings in the
maintained 25' no-disturb between flags 2-7 There are no remaining issues A condition would
be planting plan and removal of yard waste A motion to issue a decision in 21 days was made by
Mr Manzi, seconded by Mr Mabon Unanimous

The applicant Donald Cyr and Scott Giles of Giles Surveying were present Ms McKay stated
the specific enhancement plantings and procedures would be incorporated into the Order
Revised plans show correct erosion control placement Revised plan also calls out a distance
from the wall to the resource area as requested The wetland line has been reviewed and
approved with changes as depicted on the revised plan Mr Giles stated the off set is 2-feet to 2-
feet Mr Manzi stated the stonewall is in the 50-feet no-build area, an alternative analysis and

The applicant Judy Reilly and John Murphy of Merrimack Engineering were present Ms
McKay stated the stream stats were submitted indicating intermittent status The new plans have
been submitted at the same scale, but included several different sheets with various details An 8
1/2 x 11 proposed landscape layout plan was submitted The plan is too small and does not appear
to offer any useful planting information within the buffer zone I recommend in accordance with
the Town Planner's recommendation that a detailed, full size landscaping plan be submitted The
plan should include only indigenous, non-invasive species and a much more intensive planting
scheme within any previously maintained lawn within the 25' no-disturb Typographical grading
errors were noted on the plans No work is being proposed in the 25' no-disturb However, I
recommend plantings within the 25' to the southeast corner of the property I have included
copies of the Town Planner's lst Planning Board review comments of the Commission I feel that
that many items need to be addressed if not already mentioned The siltation fence is proposed
and located on the plan Mr Manzi stated this area is a previously disturbed in the 50' no-build
zone The terrace patio a stone walkway is in the 50'no-build The Commission was viewing the
plan with the applicant A motion to continue to May 26, 2004 meeting to address issues was
made by Mr Mabon, seconded by Mr Manzi Unanimous

Joseph Serwatka was present Ms McKay stated the revised plans include all buffer zones and
both include haybales and silt fence The authorization letter from Town(DPW)to perform work
on the roadway was submitted as requested Timothy Willet, Water& Sewer Superintendent,
states that a curb stop and curb box at the property line, instead of a cap with 4"x 4"riser shall be
installed at each house in the service location He also states that the contractor secures a street
opening permit from the DPW office prior to any work These additional requirements can be
included as conditions in the Order A motion to issue a decision in 21 days was made by Mr

Ms McKay stated the filing is for the installation of a replacement of a septic system and
associated grading within the buffer zone to a bordering vegetated wetland Construction work
will remain outside of the 100-foot buffer zone The septic and pump chamber will be located 90
feet away from the resource area The wetland line has been reviewed and approved The
applicant would like to repave the existing driveway under the same filing There are no issues
here A motion to issue a decision in 21 days was made by Mr Manzi, seconded by Mr Mabon

Ms McKay stated the filing is for the construction of an addition to an existing single-family
dwelling, associated grading, and driveway expansion in the buffer zone to a bordering vegetated
wetland Proposed grading changes are not shown on the plan, although are indicated in the
filing The project complies with the 25' and 50' setbacks The erosion controls are proposed in
suitable locations The wetland line has been reviewed Several changes were made in the field
and the engineer was notified The revised plans have been submitted reflecting the changes
There are no more issues A motion to issue a decision in 21 days was made by Mr Manzi,

Patrick Seekamp of Seekamp Environmental Consulting, Inc , Paul Slazik of Capital Group
Properties, William Perzom the lawyer for Capital Group Properties were present Mr
McDonough read the legal notice Ms McKay stated the re-filing is for the construction of a 43-
unit senior housing facility with associated driveways,parking area, stormwater management
system, grading and appurtenances within the buffer zone to a bordering vegetated wetland and
associated Riverfront and Bordering Land subject to Flooding (BLSF) of the Shawsheen River
Mr Seekamp states there is an aggressive plant Japanese seedling these plants need to be
removed The area out back Mr George will be installing a walkway and planting trees The
swale is being worked on The site is 80% to 85%completed site work around grading for the
plantings the Enforcement Order to stabilize the site to keep any silt run-off from happening Mr
Seekamp the flexibility of the plantings right next to building there would be natural group of
plantings Mr Perzom stated the old order is still being reference to the new order at some point
in time we need to clean up the deed on the property Mr Manzi states there is 4 areas agreed
should be stabilized seeding, stormwater structures and the curbing installed Ms McKay states
revised plans need to be submitted details on the stockpiling area, wall detail Mr Masse states 4
items need to be completed this will leave 15% of the work is to be completed, addressing the
curbing, the walkway, pathway, and pedestrian bridge Mr Seekamp states the work will be
concentrated on stabilizing the site The site is to be cleaned up and plant some shade area for the
river wildlife near the riverfront the enhancement of the shading would help the wildlife Mr
Slazik the stormwater structures are 90%completed the catch basins have filter fabric which
keeps the sheet flow down An Abutter Mr Talbot of 50 Jetwood Street states all the trees were
cut down and left open hill, which could be hazard for children Mr Manzi states the applicant
would be planting screen planting that was a requirement that the applicant had to cut down the
