Modiffication to the Definitive Subdivision Approval

The Planning Board herein approves this request to modify the Definitive nitive Subdivision known as mite
Birch n, to modify Condition 6 � of the Definitive Subdivision Conditional Approval. The f
modification will eliminate the requirement of constructing a sidewalk on Cherise Circle, The
application was submitted by Daniel Betty, J ' Development, 12 Rogers Road, Haverhill, MA, dated
May 13, 19
Findings of Fact:
1, Cherise Circle is a o' cul-de-sac servicing six 6 homes,
2. A sidewalk exists on White Birch Lane which separates Chese Circle from Bradford Street,
3. Four of the six residents on Cherise Circle submitted letters to the Planning Board requesting that
the sidewalk be eliminated.
. A.group of large trees on the western side of Cherise Circle will be preserved.
. An amount equal to the cost of constructing the sidewalks will be donated to the Town of North
Andover Sidewalk Fund to be used to construct sidewalks elsewhere in the Town where deemed
necessary by the Planning Board and the Division of Public Works.
Conditions; :
1. prior to the release of the final security held forthe VVhite Birch II Definitive Subdivision an
amount equal to the cost of constructing the sidewalks as detern .ned by the Plannin Board with
input from the Division of Public Works must be donated to the Town of North Andover Sidewalk
Fund,
Decision;
Given the above Findings of Fact and Conditions the Planning Board herein agrees the waive
Condition 6 � of the Definitive Subdivision Conditional Approval for ate Birch 11 thereby
mi
elinating the requirement of constructing sidewalk on Cherise Circle in return for a donation to the
Town of North Andover Sidewalk Fund equal to the cost of constructing the sidewalks,
