Executive Session: Chair Roache stated the Board will enter Executive Session pursuant to Massachusetts
General Laws chapter 30A, Sec. 21(a)(3)to discuss strategy with respect to collective bargaining.
MOTION:Janice Phillips made a motion, seconded by Dave Kres to enter into Executive Session at
6:30PM. Motion approved 5-0 by roll call vote.
The Select Board moved to the Select Board Meeting Room to enter into regular session.
Call To Order: Chair Brian Roache called the open meeting to order at 7:02PM in the Select Board Room
located at 120 Main Street North Andover.
Select Board in Attendance: Chair Brian Roache, Janice Phillips, Laura Bates, Clerk Rosemary Smedile
and David Kres were present
Non-Board Members in Attendance: Town Manager Melissa Murphy-Rodrigues, Deputy Town Manager
Denise Casey, and Assistant Town Manager Laurie Burzlaff were present.
PUBLIC COMMENT
34 emails received prior to the meeting regarding the request to hang Pride banners on the Town Common.
Joe Hicks of 49 Bradstreet Road expressed his support for hanging Pride banners on the common.
NEW BUSINESS
PUBLIC HEARING -Joint petition of National Grid and Verizon New England to locate poles, wires
and fixtures alona and across Peters Street
MOTION: Ms. Phillips motioned to open the public hearing for the petition from Massachusetts Electric d/b/a
National Grid and Verizon New England, Inc. to locate poles, wires, and fixtures, including the necessary
sustaining and protecting fixtures, along and across Peters Street. Ms. Bates seconded. Motion approved
5-0.
Bryan Sathler from National Grid was present. Mr. Sathler stated it is work being done by the Mass DOT to
improve sidewalks, to add designated turn lanes, and to expand roads which will impact poles. Mr. Sathler
stated they are jointly owned poles. Mr. Sathler stated there are seventeen poles being relocated. Mr.
Roache asked if it was seventeen poles just on Peters Street or for all three areas. Mr. Sathler stated it was
for all three. Mr. Sathler stated there would be six on Waverly Road, five on Peters Street, and six on Hillside
Road. Mr. Roache asked if Mr. Sathler had a presentation that would be displayed to show what was going
on. Mr. Sathler stated no. Ms. Bates stated it appears they are moving the poles away so they can widen the
intersection. Mr. Sathler stated yes. Ms. Phillips asked when they expected the work to take place. Mr.
Sathler stated it is on the Mass DOT schedule. Mr. Sathler stated once they complete their work, they will be
able to do theirs. Ms. Bates asked if they will be doing the intersection work first. Mr. Sathler stated yes. Mr.
Roache asked if they need the poles relocated as a condition of their permits to move forward. Mr. Sathler
stated yes.

MOTION: Mr. Kres motioned to open the public hearing for the petition from Massachusetts Electric d/b/a
National Grid and Verizon New England, Inc. to locate poles, wires, and fixtures, including the necessary
sustaining and protecting fixtures, along and across Waverly Road. Ms. Phillips seconded. Motion
approved 5-0.
Mr. Sathler stated it will be six poles. Mr. Roache asked if all six poles were located within North Andover. Mr.
Sathler stated yes. Ms. Phillips asked if it will all happen at the same time as the renovations to the
intersection. Mr. Sathler stated yes. Ms. Smedile asked if they would have to coordinate because it is near
the area where three communities meet. Mr. Roache stated it looks like it is all within North Andover. Ms.
Bates stated 725 and 727 are single family homes as is 432 Winthrop. Ms. Bates asked if they were pushing
into their property. Mr. Sathler stated it should all be on the public way.

MOTION: Mr. Kres motioned to open the public hearing for the petition from Massachusetts Electric d/b/a

sustaining and protecting fixtures, along and across Hillside Road. Ms. Phillips seconded. Motion approved
5-0.
Mr. Sathler stated it will be six poles. Ms. Phillips asked if this was not starting for quite some time. Mr.
Roache stated he was under the impression it would not begin for another couple of years. Mr. Kres asked if
they had an idea of the general time of the year it will take place. Ms. Bates asked when they would actually
start. Ms. Murphy-Rodrigues stated they do not have the full design yet. Ms. Murphy-Rodrigues stated they
cobbled together a lot of years of tip money in order to make this project possible. Ms. Murphy-Rodrigues
stated they have had some flux with design, but these projects are usually a decade long.
Eric Loth of Lavender Circle asked if Mr. Sathler could speak about some of the poles and the distances they
will be moving. Mr. Loth stated he wants to ensure those poles will not impede his ability to develop the
property he owns. Mr. Loth expressed his opposition to just accept where these poles are going. Mr. Sathler
stated this is a long-term project so the scope is going to change over time, and this is something that would
be negotiated with the Mass DOT. Mr. Sathler stated they are going to ensure where the Mass DOT wants
the poles fits National Grid's scope and regulations.
Alex Loth from Bowden Capital Group stated there are some preliminary construction plans that the Mass
DOT sent him. Mr. Loth stated there is no underlying building on 190 Hillside to be able to determine where it
is in relation to the building. Mr. Loth stated the poles are not in the taking, and they are over the line into the
easement area.

Ms. Murphy-Rodrigues stated the Board could choose to continue the public hearing to their next meeting.
Ms. Bates asked if it could be for all three of them. Ms. Murphy-Rodrigues stated yes.

Commuter Rail Feasibility study presentation
Staff Planner, Zach Melcher, and David Nelson from Jacobs Engineering were present. Mr. Melcher stated
they have been working on this project with Jacobs since January of last year. Mr. Melcher stated this project
was funded through ARPA and a state earmark. Mr. Nelson mentioned the four topics the Town of North
Andover was particularly interested in. Mr. Nelson discussed the background of the MBTA Commuter Rail.
Mr. Nelson stated there has been no service to North Andover since 1974; before that time there was 113
years of service. Mr. Nelson discussed the background of the MBTA Haverhill line. Mr. Nelson stated this is
the line this service would be on and would run from North Station to Haverhill. Mr. Nelson discussed the
station siting. Mr. Nelson stated there are three land use clusters in the community along the Merrimack
River. Mr. Nelson stated there is a residential and commercial, which was where the train station had been.
Mr. Nelson stated the next block is industrial. Mr. Nelson stated it is the water treatment plant, the airport,

and some businesses that are largely anchored. Mr. Nelson stated there is a smart growth district. Mr.
Nelson stated in collaboration with the Planning Department, they looked at a station being on the Osgood
landing site. Mr. Nelson stated half of the property has been developed. Mr. Nelson stated the focus is now
on the section where the railroad abuts the transit oriented development zones. Mr. Nelson stated that this
property at the north end of the Osgood site is subject to wetlands protection. Mr. Nelson stated the
southwestern edge of the site is preferred. Mr. Nelson stated they are looking to put a station that goes
between the solar farm and the railroad. Mr. Nelson discussed the station design. Mr. Nelson stated they
have developed a station design that would meet the MBTA standards, the Americans with Disabilities Act,
and conform to all state and local regulations. Mr. Nelson stated the estimated cost would be $55 million
including a 40% contingency. Mr. Nelson discussed railroad infrastructure. Mr. Nelson discussed the
completion of the double track project. Mr. Roache asked if this graph shows the number of trains. Mr.
Nelson stated yes. Ms. Bates asked as the number of trains increased, ridership increased. Mr. Nelson
stated yes. Ms. Bates asked where he thinks the commuters are going from this area. Mr. Nelson stated they
are either driving to Lawrence or Andover. Mr. Nelson discussed the railroad operations. Mr. Nelson
discussed ridership forecasts. Mr. Nelson stated the MBTA has not collected data since 2018. Mr. Nelson
stated there would be approximately 500 travelers passing through the station. Mr. Nelson stated if all of the
housing were to be built in the site area, it would pick up another 330 additional boardings. Mr. Nelson
discussed the project benefits. Mr. Nelson discussed the path to implementation. Mr. Nelson stated if it is
something that the MBTA and Mass DOT decides to do, they will pay for it. Ms. Smedile asked if Mr. Nelson
made comments on the idling area or is that still in Bradford. Mr. Nelson stated it is in Bradford. Mr. Roache
asked if something gets green lit, how long would the project take. Mr. Nelson stated allow a decade. Ms.
Bates stated the double track would improve service to this area. Mr. Nelson stated yes. Mr. Nelson stated it
would increase it to 40 trains a day, which would shorten a commuter's travel. Ms. Phillips stated if it
shortens their travel, people would be much more inclined to use it. Mr. Nelson stated the MBTA is moving
forward with improving service to be able to serve more different types of trips.
Save North Andover Wildlife presentation
Carol Disney, Chair of Save North Andover Wildlife, and Dr. Nancy Cottrill were present. Ms. Disney
discussed what the best things were about North Andover. Ms. Disney stated they are dedicated to reducing
the class of a poison being used in town that is sickening and killing wildlife and pets. Ms. Disney stated the
class of poison in question is second generation anti-coagulent rodenticide. Ms. Disney stated these poisons
are in the ubiquitous bait boxes found all over town. Ms. Disney stated there is an unintended effect of
SGARs is secondary poisoning to wildlife. Ms. Disney stated they advocate for a process called integrated
pest management. Ms. Disney stated they reduce the rodent population in three ways: exclude, starve, and
target. Ms. Disney stated they are asking the Board to consider regulating SGARs on North Andover
municipal property and make this practice an official policy. Denise Dion discussed her experience with a bait
box. Janet Foley discussed her experience with a bait box. Ms. Disney stated they formed this group in
January and have done a few public education events. Mr. Roache stated having more independent studies
would be warranted. Mr. Roache asked if other town departments had weighed in. Ms. Murphy-Rodrigues
stated they have not sent us anything formally. Ms. Disney stated the North Andover Improvement Society
has written a letter of support. Mr. Roache asked for additional research. Mr. Roache stated if they are not
using the poison on municipal properties right now, was that a conscious decision, was it an economic
decision. Ms. Murphy-Rodrigues stated that on the town buildings, they use traps. Ms. Murphy-Rodrigues
stated it is only the schools right now that are using the poison because there was a major problem in
schools this year. Ms. Murphy-Rodrigues stated they would have to think through other ways to mitigate that.
Ms. Murphy-Rodrigues stated if this was something that they were trying to roll out townwide, it would have
to be a bylaw passed at Town Meeting. Ms. Disney stated the other towns who passed these regulations did
not go to Town Meeting. Ms. Murphy-Rodrigues stated they can make policies for their own municipal

buildings, but they are not in charge of the school buildings. Ms. Murphy-Rodrigues stated the Board should
hear from the Health Department. Ms. Phillips asked if there is legislation in the state. Ms. Disney stated yes.
Ms. Phillips thanked Ms. Disney for the work she is doing to educate others.
OUT OF ORDER: Vote to approve collective bargaining agreement between the Town of North
Andover and NEPBA Local 102 Communications Officers
MOTION: Ms. Phillips motioned to approve the collective bargaining agreement between the Town of North
Andover and NEPBA Local 102 Communications Officers for the period of July 1, 2025 through June 30,
2028. Mr. Kres seconded. Motion approved 5-0.
Vote to hang pride banners around the Town Common
Ms. Murphy-Rodrigues stated they have the American flags up for Memorial Day, and they typically leave
them until Flag Day. Ms. Murphy-Rodrigues stated they are asking to put the Pride banners up on June 15th.
Ms. Phillips stated going forward, there is not really any reason, they cannot have both flags and banners on
those polls. Ms. Murphy-Rodrigues stated they will ensure all flag protocol is followed. Ms.
Murphy-Rodrigues stated she will check in with DPW.
MOTION: Ms. Phillips motioned to approve the Pride banners at the Town Common in conformance with flag
protocol and based on DPW availability for a period of no less than two weeks in the month of June. Ms.
Bates seconded. Motion approved 5-0.
LICENSING
MOTION: Ms. Smedile motioned to open a meeting of the North Andover Licensing Commission. Ms.
Phillips seconded. Motion approved 5-0.
PUBLIC HEARING -Application from S&P Management LLC d/b/a Vicacino for a change
officers/directors/LLC managers, change of ownership, pledge of collateral and change of d/b/a at
220 Sutton Street
MOTION: Mr. Kres motioned to open the public hearing for the application from S&P Management LLC d/b/a
Vicacino for a change of officers/directors/LLC managers, change of ownership, pledge of collateral and
change of d/b/a at 220 Sutton Street. Ms. Smedile seconded. Motion approved 5-0.
Attorney Jonathan Rossi was present. Mr. Rossi is present on behalf of S&P Management LLC. Mr. Rossi
stated they are going through a structure change. Mr. Rossi stated one of the members of the LLC is being
bought out by two new members. Mr. Rossi stated the LLC is staying intact and continues to own the liquor
license. Mr. Rossi stated there are two new managers for the LLC not the liquor license itself. Mr. Rossi
stated the other changes include changing the d/b/a from Bueno Bistro to Vicacino and to the pledge
involved due to the buyout. Mr. Rossi stated S&P Management will remain as the owner of the liquor license.
Ms. Bates asked if it was common for the liquor license owner to only have a small percentage. Mr. Rossi
stated yes.

MOTION: Mr. Kres motioned to open the public hearing for the application from Elbridge Leland 11 of Marble
Ridge Farm LLC d/b/a Marble Ridge Winery for an on-premises Farmer Winery Pouring Permit at 11
Mableridge Road. Ms. Smedile seconded. Motion approved 5-0.
Brig Leland and Ally Procopio were present. Mr. Leland discussed the application. Mr. Leland stated they are
requesting the opportunity to extend their service and offerings. Ms. Procopio discussed a brief overview of
the winery operations. Ms. Procopio stated they are requesting approval to serve full glasses of wine on site.
Ms. Procopio stated they have a team of 23 TIP certified employees. Ms. Procopio stated to compliment their
wine offerings, they serve a variety of food options. Ms. Procopio stated they serve a variety of non-alcoholic
beverages and mocktails. Ms. Procopio stated they are in the process of expanding their food space. Ms.
Procopio stated their public hours are on Friday 4pm to 9pm, Saturday 1 pm to 9pm, and Sunday 1 pm to
6pm. Ms. Procopio stated their clientele is typically not a college age student. Mr. Roache asked if approved
tonight, how quickly will they be up and running. Ms. Procopio stated as soon as the ABCC allows.
Nancy Leland of 270 Great Pond Road expressed her concern with the limited information within the
application. Ms. Leland discussed her concerns regarding traffic, vehicles parking out in the field, and what it
will look like if food trucks begin pulling in there. Ms. Leland discussed concerns that there should not be
outdoor activities concluding at 9pm. Ms. Leland stated she would like to know what is happening with the
inside events and what time those will end. Ms. Leland stated as a residential neighborhood, they should
have the opportunity to voice their concerns as a neighborhood. Ms. Leland stated there should be
restrictions put into their permit. Ms. Murphy-Rodrigues stated those issues would be through their
entertainment license, which they do not have. Ms. Murphy-Rodrigues stated their permit does restrict them
in hours to end at 9pm. Ms. Murphy-Rodrigues stated there were no zoning violations found. Ms.
Murphy-Rodrigues stated every year they have the same hearings and people are able to come to the public
hearing and speak about their concerns regarding the application. Ms. Murphy-Rodrigues stated, in the
moment, if there is a license violation, the police should be called. Ms. Leland asked what about the parking
in the field. Ms. Murphy-Rodrigues stated they can bring this up to the building department, but they did sign
off saying there were no violations. Ms. Murphy-Rodrigues stated she can have both the building department
and conservation go out and look at the parking.

Brig Leland and Ally Procopio were present. Ms. Procopio stated they received approval to participate in the
Farmer's Market this year. Ms. Procopio stated they are requesting to sell bottles of wine as well as samples
at the Farmer's Market once a month beginning on June 22. Ms. Procopio stated all of their staff members
are TIP certified. Ms. Procopio stated they have done this at other community Farmer's Markets. Ms.
Procopio stated they do not anticipate any issues, but if something does arise they would work cooperatively
with the Farmer's Market and local authorities. Mr. Leland stated it is a pleasure to participate in the Farmer's
Market.
Janice Phillips recused herself.
Mr. Kres asked if they have ever had that happen at the Farmer's Market or similar. Ms. Bates stated no.
MOTION: Mr. Roache motioned to approve the application from Elbridge Leland ll of Marble Ridge Farm
LLC for a farmer's market seasonal alcohol permit at 120 Main Street, rear parking lot on June 22, July 20,
August 17, and September 14, 2025. Ms. Smedile seconded. Motion approved 4-1 recused.
Application from Burtons Grill of North Andover LLC d/b/a Burtons Grill for a change of
officers/directors/LLC manaaers at 145 Turnpike Street
Attorney Margot Gillis was present. Ms. Gillis stated she is representing the applicant. Ms. Gillis discussed
the application. Ms. Gillis stated this change is administrative and will not affect day-to-day operations. Ms.
Gillis stated there are currently five LLC managers, and the proposal is to remove three of the five.
MOTION: Ms. Smedile motioned to approve the application from Burtons Grill of North Andover LLC d/b/a
Burtons Grill for a change of officers/directors/LLC managers at 145 Turnpike Street. Mr. Roache seconded.
Motion approved 5-0.
Application of Mitchell Schneir of Acatan Coach, LLC for a livery license at 366 Forest Street
Mitchell Schneir was present. Mr. Schneir discussed the application. Mr. Schneir stated he opened Acatan
Coach as a ride share and limousine service. Mr. Schneir stated he has been doing this for 3-4 months now.
Mr. Schneir stated he has car service for assisted living and independent living. Mr. Schneir stated he
charges a very discounted price for them. Ms. Bates asked if it was just him driving. Mr. Schneir stated yes.
Mr. Roache asked if he was operating out of his home. Mr. Schneir stated yes. Mr. Roache asked if there
was a fleet of vehicles at his house. Mr. Schneir stated no.

livery license at 366 Forest Street. Ms. Phillips seconded. Motion approved 5-0.

Maged Makheal was present. Mr. Makheal discussed the application. Mr. Makheal stated he has another
restaurant in Westford. Mr. Makheal stated he has a lot of experience working in restaurants. Mr. Makheal
stated he found this location and would like to make it the best for the North Andover residents. Ms. Bates
asked if it would be pizza, subs, etc. Mr. Makheal stated they will have Greek pizza.
MOTION: Mr. Kres motioned to approve the application of Mariachi Inc. d/b/a Supreme House of Pizza for a
common victualler license at 162 Sutton Street. Ms. Phillips seconded. Motion approved 5-0.
Application from Nate Chase of Saltbox Cidershop LLC for a farmer's market seasonal alcohol permit
at 120 Main Street. Rear parking lot on June 15, July 13, August 10, and September 7, 2025
Nate Chase was present. Mr. Chase discussed the application. Mr. Chase stated they are based out of
Haverhill, MA and make dry ciders and sparkling cider. Mr. Chase stated they will be at Haverhill Farmer's
Market and are hoping to be at North Andover's Farmer's Market. Mr. Roache asked if they had a storefront.
Mr. Chase stated no. Mr. Roache asked where people could find them. Mr. Chase stated at the shops and
restaurants they distribute to. Mr. Kres asked where in Haverhill they were located. Mr. Chase stated North
Broadway. Mr. Chase stated there will be samples and straight selling. Mr. Chase stated he is TIP certified.
Mr. Roache asked if the alcohol would be consumed in his presence. Mr. Chase stated yes. Mr. Kres asked
how many people would be at his booth. Mr. Chase stated just himself and possibly his wife. Mr. Kres asked

MOTION: Mr. Roache motioned to approve the application from Nate Chase of Saltbox Cidershop LLC for a
farmer's market seasonal alcohol permit at 120 Main Street. Rear parking lot, on June 15, July 13, August
10, and September 7, 2025. Mr. Kres seconded. Motion approved 5-0.
MOTION: Mr. Kres motioned to close the meeting of the North Andover Licensing Commission. Ms. Smedile
seconded. Motion approved 5-0.
CONSENT ITEMS
A. Accept donations to the Youth Center for the children summer shows
B. Accept donations in the amount of$4,585 to the Festival Committee for Sheep shearing
C. Accept donation to the library in the amount of$5,000 from the Friends of the Stevens Memorial

MOTION: Mr. Kres motioned to approve consent items A-D. Ms. Bates seconded. Motion approved 5-0.
E. Accept grant in the amount of$180,000 from Eversource and National Grid for an Energy
Manager consultant
Mr. Roache asked if they were creating a new position as part of this. Ms. Murphy-Rodrigues stated they
funded this position as part of ARPA. Ms. Burzlaff stated they are hiring a consultant. Ms. Murphy-Rodrigues
stated they put the position out several times and found that the funds available were nowhere near enough.
Ms. Murphy-Rodrigues stated they gave the money back and wanted to go a different route. Ms.
Murphy-Rodrigues stated they were one of three communities that received this grant. Mr. Roache asked if
they hire a contract employee for three years and then they reimburse. Ms. Burzlaff stated they are hiring
them and have a vendor contract. Ms. Burzlaff stated they bill the Town like a normal vendor. Ms.

MOTION: Ms. Bates motioned to approve the Open Session minutes of May 7, 2025 and May 13, 2025 as
presented. Mr. Kres seconded. Motion approved 5-0.

Ms. Smedile wished everyone a Happy Father's Day
Ms. Phillips mentioned how great of an event Sheep Shearing was.
Ms. Phillips mentioned the SOS overnight party.
Ms. Phillips congratulated all of the North Andover graduates.
Ms. Bates thanked the Patriotic Observance Committee for the Memorial Day Parade and service.
Mr. Roache mentioned the Flag Retirement Ceremony.
Mr. Roache mentioned that the field of honor will end on Flag Day.
Mr. Roache mentioned Pride and Popsicles.
Ms. Phillips mentioned when the Farmer's Market will start.
TOWN MANAGER'S REPORT
Ms. Murphy-Rodrigues mentioned that the Bike Rodeo will be cancelled. Ms. Murphy-Rodrigues mentioned
the 2024 water quality report is on the town website. Ms. Murphy-Rodrigues mentioned they have confirmed
the Independence Day fireworks are going to be July 6. Ms. Murphy-Rodrigues mentioned that Pat
McGravey's civics class received a commendation. Ms. Murphy-Rodrigues stated Firefighter Deschenes'
services will be held on Friday.
