Kasprzyk, Acting Admin and Linda Dufresne Secretary MINUTES P Tariot and Carl Schoene motioned to accept the minutes of May 1, 1991 as amended, R Milliard seconded, motion carried Carl Shoene will revise minutes of June 19 Lot B-2 Dale Street (#242-515) -Compliance (Cont Steve Smolak requested a Certificate of Compliance and bond release A Kasprzyk noted that the house was constructed 60 feet from wetlands rather than the approved 70 feet as noted in Phil Christiansen' s letter Mr Smolak noted it was moved due to ledge A deck is proposed in the future which will require the filing of a Request for a Determination of Applicability P Tariot motioned to grant a Certificate of Compliance with the stipulation that the silt fence be removed any grade inconsistencies be rectified by hand and the area seeded and mulched prior to issuance A Brewster seconded Motion passed unanimously Lot 64 Haymeadow Lane (#242-413) -Modification to Plans Jeff Smith of Concrete Systems, Inc discussed his pre-cast concrete bridge products and requested that this product be used rather than aporoved cast-in-place steel and concrete bridge File number was wrong - final approved project was NACC #2 Pre- cast footings would eliminate the need for a coffer dam and would require two weeks work time (shorter than usual) Slightly larger impact =or center footing (plus or minus 8 sq ft ) but need much less for end footings Commission would approve the substitution if less wetland impact Applicant should come back with new construction sequence, detailed plans and the name of people responsible for various aspects of work Lot _24 Candlestick Rd (#242-453) -Certification of Compliance and Bond Release Ken DiRaffael was present to request a Certificate of Compliance and bond release Commision denied Request for Certificate since the wetland reolication area is not yet 75- revegetated with wetland plants A Brewster motioned to grant a reduction in the bond by $1 500 leaving $500 remaining P Tariot seconded Passed unanimously r 1 Lot #2 (#21) South Cross Road (#242-494) -Partial Compliance Pat Murphy requested a Partial Certificate of Compliance A Kasprzyk revieded findings of site visit some erosion in lawn at rear of drive, grading and clearing of some vegetation within 25 ' no-cut zone deck within 50' no-build zone, stock piled loam immediately ad3a=ent to wetland Commission denied request Pat Murphy will get developer to remove loam and Commission wil schedule a full site visit upon the loam removal i Lot 19A Bear Hill Rd (#242-158) -Partial Compliance George Schruender made a request for a Partial Certificate of Complaance P Tariot moved to grant a Partial Certificate, A Brewster seconded, passed unanimously Lote 1A, 1B, 1C Tarnpike St -Request for Determination-Continued Public Hearing Scott Giles explained new plan submitted July 8 with topography indicating all tzree houses outside a no-cut zone of 50 feet a portion of one Irive within 45 feet Septic systems have not been designed yet C Shoene requested a snow fence in some areas P Tariot motioned to issue a Negative Determination of Applicability wlzh conditions that erosion controls be installed at no disturbance zone of 50 feet with the one driveway exception • of 45 feet and additonal snow fence to be placed according to agent' s discretion near grading work A Brewster seconded, motion passed unanimously Lot 23A Forest St (#242-555) Notice of Intent-Continued Public Hearing Phil Christiansen represented applicant Moved house back 6 feet from wetland, put additional wetland boundaries on plan A Kasprzyk noted plans only received today need time to review and review new boundary in field Phil Christiansen presented copy of driveway easement Discussion ensued with comments from public Now 595 square feet of temporary wetland impact proposed Eric Nieche of 1253 Salem St (N Andover Realty Trust) asked questions regarding increase in run-off as Ellen Dewallaby of Lot 1 Salem St and Ed Shaw Commission voted to require applicant to shod no net increase in run-off from site Septic system approved application must be submitted as well as certified list of abutters and proof of notification, construction access and sequence new house corners should be stated in field P Tariot motioned to continue to August 7, R Milliard seconded Passed unanimously • i Coventry Estates (#242-324) -Public Hearing re Bond Seizure Victor Hatem appeared one of principals of Coventry Development Corp also Mr Cristaldi He has met with Planning personnel and received list of concerns from D P W and home owners He agreed to submit a schedule and list of action to remedy situation to a technical review committee within two weeks Discussion ensued Joe Cushing representing Lexington Savings Bank indicated Lexington Savings is involved with Orchard Path not Coventry Estates with exception of lift station on Lot #1 P Tariot motioned that Coventry Development Corp must install hay bales at all drainage outlets and clean catch basins per Enforcement Order by 5 00 P M July 12 P Tariot motioned to continue hearing to August 7 R Milliard seconded Motion passed Lot 2 (#44) Oaks Drive-Public Hearing for a Request for a Determination Dennis Toomey propses an additon to an existing house in the buffer zone A Brewster motioned to issue a Negative Determination w-th erosion controls as a condition and reference to the plan R Milliard seconded Motion passed, P Tariot abstained Liberty Hills II (#242-486) -Enforcement Order George Secchiaroli stated that the Order was recorded 7/10/91, no proof submitted Septic system within 100 feet of wetlands in N Andover A Kasprzyk will check with Health Dept P Tariot motioned to lift Enforcement Order upon filing of the $4 000 bond and proof of recording the Order of Commitment, R Milliard seconded Unanimously passed Jerad Place Phase II , Lot 24 (#242-506) New Plans-insignificant change or modification to Order Jim Bourgeois of Neve Assoc stated that Jack Magee wants to buy Lots 24&26 Commission ruled that 25 foot buffer must be maintained Retaining wall must be moved so that it will be at least 30 feet from wetland New plans must be submitted within two weeks indicating such change P Tariot motioned to accept the changes in the plan revised 6/26/91 and accept the Modification of Order of Conditions, R Milliard seconded Motion passed Jerad Place Phase II , Lot 26 (Determination) -New Plans P Tariot motioned to Modify the Negative Determination to include • the plan date E/17/91 to be further revised to indicate erosion control along no disturbance zone, A Brewster seconded Motion passed z Merrimack River Trail Cathy Hirsch of Merrimack River Watershed Council would like to help initiate a trails committee to install trails along the river already owned by Town which runs from the boat ramp to Haverhill Appalachian Mountain Club can help in 1991 but no guarantee for 1992 Commission supports her efforts and Administrator will help answer any questions regarding filings but will not loin committee Expenditures/Subscription Commission allowed A Kasprzyk to attend next MSMCP meeting in Greenfield on 7/17/91 regarding wildlife habitat evaluations Commission requested A Kasprzyk to appropriate funds from filing fees to pay MACC dues Reviewed legal costs regarding Great Pond Estates Lot 61 Newcastle (#242-385) -Discovery Applicant must request a Partial Certification of Compliance with as-builts etc and submit a new filing for additional work proposed on lot Lot 4 (#2125) Turnpike St (#242-541) -Enforcement Order Ed Plugis did not appear as required A Kasprzyk indicated he had fixed erosion control as best he could and he had indicated he had no funds to complete work or post bond Commission requested A Kasprzyk discuss with Town Counsel and investigate a lien on proprty, make sure Order of Conditions recorded Lot E Berry St (9242-549) Notice-Decision Discussion P T3riot motioned to issue Order of Condition to deny pro3ect as discussed, R Milliard seconded Motion passed unanimously Dryad & Belfast Streets (4242-548) -Decision Discussion A Bre,aster motioned to issue Order of Conditions as amended G Reich seconded motion passed unanimously Lot 11 (#100) Tucker Farm Rd (#242-435) -Certificate of Occupancy Applicant requested Certificate of Occupancy sign-off but has not posted $2 000 bond on recorded Order of Conditions etc Commission indicated entire bond must be posted prior to sign- off Lot 41 Candlestic} Rd (#242-506) -Partial Compliance Tabled since there has been work within 25 feet of no-cut zone Lot 53 Blue Ridge Rd. (#242-453) -Partia1 Compliance No action-wrong file number. Determination issued on lot, not Order of Conditions.
