7 59 P M B Mansour - 7 58 P M MINUTES R Milliard will review July 17 minutes before next meeting OLD BUSINESS Lot #41 Candlestick Rd (#242-506)-Partial Compliance (Cont) Tom Neve the applicant's representative noted that work encroached intD 25ft no-cut zone He proposed enlarging the no- cut zone to the rear of the lot to offset this work R Milliard would prefer not to put future encumbrance on the lot D Stanley agreed G Reich stated sod isn't preferred due to maintenance -le was also concerned with precedents A discussion followed regarding the additional stipulation of an increased no- disturbance zone R Milliard motioned to issue with condition that Partial Compliance be granted seconded by D Stanley G Reich and A Brewster voted no C Shoene abstained The motion was not carried A Brewster offered a modified motion to include an encumbrance G Reich seconded the motion the motion carried Lot #4A (4216) Raleigh Tavern Lane (#242-181) -Compliance (Cont) Tom Neve reviewed his letter and plan The work completed is not exactly to plan but is in compliance with Order of Conditions D Stanley motioned to issue a Certificate of Compliance A Brewster seconded the vote was unanimous Page 2 August 7, 1991 Minutes (Cont 1 Coventry Estates (#242-324)-Band Seizure (Cont) J Cristaldi the applicant reviewed the Work Schedule letter addressed to the Planning Board D Stanley stated that he is pleased that things are progressing C Shoene feels that while erosion is a ma]or concern the rest can wait a little A Kasprzyk agreed that no new erosion and no further impacts are occurring A Brewster noted that as-builts are needed for the Conservation Commission as well as the Planning Board Action was drepped to seize the bond for now The Conservation Commission will review the schedule Butcher Boy (#242-473)-Discussion - Erosion Control Modification Bob Parker reviewed the Order of Conditions and the modification the applicant would prefer Filter fabric is to be used at the catch basins instead of hay bales The detention basin will not be used as a sedimentation basin D Stanley motioned to issue a Modification to Order of Conditions P Tariot seconded B Mansour abstained the motion carried ® McLay's (#242-277) -Discussion of Enforcement Order Tom Neve stated nothing has been done yet P Tariot motioned to file a criminal suit B Mansour seconded A Brewster abstained The motion carried 6-0-1 A Kasprzyk will send a letter to Mr Kaltz PUBLIC HEARINGS Lot #1 Hawkins Lane-Request for Determination of Applicability T Neve represented George Farr Boston Brook flows through lot N-S The house and septic system are outside the buffer zone but the driveway is in the buffer zone P Tariot mentioned there is bordering land sub3ect to flooding 2 1 driveway and still no work in 25 foot no cut zone Tom Neve stated that usually haybales are hacked by silt fence Tim Ragonese (36 Hawkins Lane) stated that the house will be constructed on ledge- blasting7 Six feet will come off the top but 14 feet down for cellar D Stanley motioned to close and issue a decision within 21 days Erosion contro_ must be according to plan and the wetland line must be re-established Alison Brewster seconded unanimous vote Page 3 August 7, 1991 Minutes (cont Hidden Court-Lots 6 8 & 10 - Request for Determination S Giles must send in proof of abutter notification Previous Order of Conditions was 25 feet no-cut, 50 feet no-build haybale along no-cut line Check when Order of Conditions for Coventry II expires P Tariot requested a site visit R Mansour wants finished grades on plan C Schoene stated that the project is on sewer A 100 foot buffer zone is needed on the plan and final grades are required the wetland line must also be re- established A site visit is scheduled for next Wednesday August 14 at 6 OOPM P Tariot motioned to continue to August 21, 1991 A Brewster seconded the motion motion was carried Interstection of Cotuit and Dartmouth Sts - RDA Proof of notice submitted Robert Dion explained the work to be done to fix erosion Anne Kasprzyk explained the conditions and offered to supervise the work G Henderson from Andover is to do work Frank Stewart and Mark Bove discussed flooding on Dartmouth St Neighbors agree that there is a flooding and erosion problem D Stanley's motion to issue negative finding with A Kasprzyk to supervise was withdrawn C Schoene motioned to close hearing and do site visit Wednesday August 14 1991 at 6 45PM and to empower the Commission members attending the site visit to issue a decision A Brewster seconded the motion the vote was unanimous GLSD - John Ford / Request for Determination Atty John Ford represented the GLSD Along the bank of the Merrimack River the existing sewer line is encased in cement and rip-rapped The plan does not show wetland lines easement plans provided Maintenance cutting has already occured-this an "after the fact" filing The Conservation Commission must be notified when, where and how future maintenance cutting will occur A motion by P Tariot to issue a Negative Determination with condition that future cutting will require a Determination of Applicability prior to cutting A Brewster seconded the motion the vote was unanimous i Page 4 August 7 1991 Minutes (Cont ) 23A Forest Street (#242-555)-Notice (Cont ) Phil Christiansen represented the applicant The old wetland line has been taken off the plan Two of the houses have been built on the six originally proposed lots The proposed house has been moved somewhat to provide a buffer R Mansour stated that cross hatching on plan beyond the haybale line should be fixed A Kasprzyk stated it should be a maximum of about 15 feet wide The forced main pipe is 4 ' deep Stone and gravel will be placed in a filtration trench along the driveway The driveway will be gravel There will be a 25 foot no-cut zone Eric Nieztche wants to go over the calculations for the infiltration rates Commission should be particular about the sewer in wetlands P Tariot motioned to close the Public Hearing and issue a decision in 21 days (August 28, 1991) seconded by D Stanley and A Brewster vote was unanimous NEW BUSINESS (CONTINUED) Lot 1 Hillside (242- )-Partial Cert of Compliance Mike DiBitetto is the applicant P Tariot motioned to issue a Partial Certificate of Compliance and to transfer the bond B Mansour seconded the vote was unanimous Lot 6 Christian Way (#242- )-Partial Cert. of Compliance Al Shaboo explained they need the Certificate right away The Commission can keep the bond for now until all the grass is well- established P Tariot motioned to grant a Partial Certificate of Compliance and to remove the Enforcement Order A Brewster seconded the vote was unanimous The bond will be returned when all areas within the 100 ' buffer zone are well established with grass Lot 1 Dale Street (242-421) -Modification of Plans A Kasprzyk to check on DEP status Water Treatment Plant (#242-421)-Modification of Plans More information is needed for the next meeting -Where does red 10/88 line come from? -Need elevations to the end of the pipe from 200 ft to the end of the intake structure -What are elevations now? Weston & Sampson representative should attend the next meeting I Page 5 August 7, 1991 Minutes (Cont Lot B Great Pond (#242-260)-Extension No action taken There was no representation The Commission cannot extend order of Conditions if it has already expired The applicant can re-file or the Commission could issue an Enforcement Order to finish Lot E Berry Discussion The Commissior would like to see alternatives in the future submission Lot 3 Johnnycake (#242-115)-Partial Compliance Lift Enforcement D Stanley motioned to issue a Partial Compliance and lift the Enforcement Order A Brewster seconded the vote was unanimous D Stanley motioned to adjourn A Brewster seconded the motion the vote was unanimous Meeting adjourned at 10 50 PM Peoge each Chairman Approve
