Partial Compliance Petitioner Leah McDonough requesting a partial compliance R Doucette provided an overview The Compliance was issued in 1986 and was evidently not recorded by the applicant Upon motion by P Tariot and second by R Milliard the Board unanimously voted to issue the Partial Compliance North Andover Wetlands Regulations - Discussion • Commission reviewed draft wetlands regulations Public hearing planned for early 1992 Non-Criminal D_sposition Statute Tickets - Discussion Format for tickets was discussed Input from the Police Chief, Town Manager District Court and Town Counsel will also be sought NEW BUSINESS Lot 3 ,4 ,5 So Bradford Street (#242-519) - Compliance Mr Bardascino, the owner requested a compliance R Doucette gave an overview of the pro3ect R Milliard motioned to grant a partial bond release of $9, 000 and hold $1, 000 Second by P Tariot Motion passed unanimously A compliance was not issued at this time Lot 28 Tanglewood Lane - Determination A letter has aeen submitted from a Mr DeNuccio requesting a compliance Thomas Evangelista represented Kevin McCann prospective buyer R Doucette provided an overview - while the plan shows no work in wetlands the order of conditions has some additional conditions that indicate a culvert was placed in a wetland crossing on this lot Mr Evangelista stated that there was a culvert cn the property No certification or as-built plan from an engineer has been submitted as required by the notice C Schoene motioned to deny second by A Brewster Motion passed N � Agricultural License for Mazurenko Farm - Discussion Proposed agricultural license agreements were distributed for NACC comment PUBLIC HEARINGS Lot 3 Marbleridge (#242- ) - Notice (to be continued) The applicant is seeking the assistance of an engineer and requests a further continuance to 1/8/92 Commission voted to continue to 1/3/92 Lots 1 & 2 Lac,i Street (#242- ) - Continued Jim Bourgeois represented Mr Follansbee Site is now cleaned up Fill material das placed by the tenant to fill the pot holes No info was presented as to the origin of the fill material as requested at the last meeting Motion by P Tariot and second by A Brewster to close and issue a decision within 21 days of receipt of information as to the origin of the fill and the removal as required by Administrator Motion passed Lot 1 Old Village Lane - Determination P Tariot abstained since he is an abutter Mr Tariot reserved his right to speak as an abutter, not as a commission member Ben Osgood, Jr represented the General Store Trust Mr Osgood • described the property There is some wetland vegetation but no apparent connection to a water body R Doucette and A Brewster visited the site and discovered a possible connection to a water body The NACC will do a site visit Various abutters attended Marie Geggis was concerned with the flow of water onto Village Lane from driveway Barbara Dillon asked if filling of land would affect drainage of her land Paul Tariot also questioned drainage of Old Village Lane R Milliard motioned to continue to 1/8/92, second by A Brewster The vote went as follows 4-0-1 Cyr Recycling ex Recreation Center - Determination R Doucette represented the North Andover Trails Committee The proposed project is to locate 2 sections of a trail along the top of a stone wall The stone wall passes through BVW The wall will be rebuilt to be more stable and passable Motion by P Tariot and second by A Brewster to issue a negative determination Passed unanimously Campbell Forest (#242- ) - Notice David Jordan represented the applicant and presented the plans 1 1st crossing- 1070 s f of BVW filling 2 2nd crossing- 1500 s f of BVW filling 3 3rd crossing- 220 s f of BVW filling • 4 4th crossing- 1080 s f of BVW filling Less shoulder width 5 Cross intermittent stream no BVW for driveway 6 8 point source discharges one right at wetland edge, one within 20 ' six others as far away as possible Replacement of culvert under Campbell Road (2) - 4 'X2 ' box culverts will replace (1) 18" culvert This should alleviate flooding that is caused by flow off Campbell Forest property C Schoene voided concerns of flooding and discharge of matching peak flows CBA filling and steep slopes to wetlands and lack of flood detention Dave Jordan suggested the Commission hire an independent consultant to review the drainage study P Tariot asked if enlarging the culvert at Campbell Road could dry up wetlands D Jordan answered groundwater will not be altered and wetland will not be affected P Tariot asked if there could be more filling for house lots D Jordan said there would be no need for additional filling R Milliard asked about 1 1 slopes on road shoulders D Jordan describe slopes and method of riprap placement G Reich asked if these plans reflected the Determination issued earlier by the NACC to determine the exact wetland edge D Jordan stated that the applicant accepted the Determination R Doucette if there is any connection between the wetland resource area on Lot 10 and the larger wetland D Jordan wil- show the connection on plan - the Notice indicates haybales and silt fence while the plans show only one barrier The NACC will ask for both Please submit one plan with roads Lot lines topo and wetlands Applicant agreed - A PRD plan was discussed with the applicant almost a year ago yet none was submitted R Doucette will ask the Planning Board to request that one be submitted D Jordan stated that the soils might not support SSDS for PRD - applicant to consider asking for a Planning Board waiver from maximum road grade to lessen buffer zone impacts - the proposed lack of flood detention could alleviate local flooding as part of this project but (a) might add to future flooding downstream and (b) would not attenuate stormwater pollution - look into a waiver from the centerline radius to bring the roadway away from the wetlands as it nears Campbell Rd - Floodplain is a wetland and should be indicated as such on the plan - Applicant shculd flag crossings and roadway for NACC review - Wetland habitat assessment needed? Bank impacts"> - Endangered species habitat found nearby - No need to fill any wetland resource area for lots? D Jordan stated no Abutters Fundeklian - Roadway impact near Hagelin Meyer - The NACC should hire an independent consultant - EIR needed (RPD-not likely to pass thresholds) - Hydro study takes lot development into account? yes - Discussion of pond. Mary LaChapells - Started water overflows onto Salem Street - Who will guarantee she will not be flooded - goes not believe the brook will take more flow Goodwin - Discussion of culvert at Campbell Road Dave Jordan stated the culvert will still flood to el. 101, just below pavement. C.Schoene discussed increase of runoff. Dave Jordan and R.Doucette discussed increased rate vs. volume. Motion by P.Tariot and second by A.Brewster to continue to 1/ / 2 . Mass D.P.W. Route 114-Turn ike Street - Determination Motion by P.Tariot and second by R.Milliard to issue a. Negative Determination with condition to use haybales. DECISIONS Great Pond Estates ACC- 3 R.Milliard moved to adopt. Great Pond Estates as amended. Second by A.Brewster. North Andover Mills 242- 3 Motion by R.Milliard and second by A.Brewster to adopt No.Andover Mills as amended. Motion passed 3-2 . P.Tariot and C.Schoene against.
