HomeMy WebLinkAbout1991-12-04 Conservation Commission Minutes t NORTH ANDOVER CONSERVATION COMMISSION DECEMBER 4, 1991 PRESENT George Reich, Chairman Paul Tariot Alison Brewster, V-Chair Carl Schoene Robert Mansour Al Manzi Richard Doucette, Admin MINUTES Paul Tariot motioned to approve minutes from November 6 as emended Al Nanzi seconded Passed Paul Tariot motioned to approve minutes from November 20 as amended Richard Milliard seconded Passed OLD BUSINESS Lot 1 Village Way (#242-561) - Discussion Discussion of misinformation in NOI variance and special permit needed but not noted and NACC not advised that it was in the watershed Discussion of ability to move house 20 ' more P Tariot motiored to Modify Condition #16 to provide a 451/701 no disturbance, ro construction zone and acknowledge that new information was received requiring the NACC to reconsider their decision The vote was as follows 5-0-1, R Mansour abstained Motion passed Lot 1A Winter &t Ongoing violation The violator has not complied with the Enforcement Order since he has not filed a notice of intent There was discussion as to the steepness of slopes and whether or not work was done in a wetland The Commission will conduct a site visit on 12/14/91 P Tariot motioned to halt legal action once NOI is filed second by A Brewster Unanimous vote Butterfield. 224 French Farm Road Ongoing violation Commission will conduct a site visit on 12/14/91 Luz , 145 Bradford St Ongoing violatLon Commission will conduct a site visit on 12/14/91 NEW BUSINESS Lot 15 Granville Lane (#242-486) - Extension P Tariot motioned to issue a Partial Compliance, seconded by A Brewster Motion passed unanimously NACC 1214191 page 2 Liberty Hills II (#242-486) - Extension Discussion of Enforcement Orders Work has not progressed as well as the Commission would have liked The wetland replication has not been planted The applicant promised to work with us better in the future P Tariot moved to issue an Extension to May 28 1991, second by R Milliard Unanimous vote PUBLIC HEARINGS Great Pond Estates (4NACC-3) - Notice (Continued) Bruce Waite Discussion of re-flagging and cul-de-sac shortening Laurel Farinon Presented revised plans R Milliard motioned to close and issue a decision within 21 days, second by P Tariot Unanimous vote North Andover Mills (#242- ) - Notice (Continued) Joe Cushing presented revised plans showing drainage system Discussion of drainage system P Tariot motioned to close and issue a decision within 21 days of receiving demolition / construction sequence and revegetation plan, C Schoene seconded Unanimous vote Lot 1 (42) Lacy Street (#242- ) - Notice (Continued) Jim Bourgeois presented plans Dumping in wetlands and work in the buffer zone was done prior to the filing and discovered by the NACC at the site visit These issues have not yet been resolved G Reich would rather not issue a decision until the site is cleaned up R Milliard motioned to continue A Brewster seconded Discussion of whether to zontinue or close Motion carried Lot 11 Hidden Court - Determination Vince Turano and Paul St Hillaire appeared before the Board P Tariot motioned to issue a Negative Determination with a condition of using hay bales, second by A Brewster Unanimous vote Regulations and Fees under the Wetlands Bylaw Discussion A public hearing is planned for 12/18/91 Discussion of filing fees P Tariot motioned to utilize the filing fees to defray Commission expenses for this fiscal year only Vote went as follows 2-5 G Reich and P Tariot for A Brewster C Schoene, R Milliard R Mansour and A Manzi against Motion failed NACC 12/4/91 Page 3 Ostherr Variance The ZBA has recently granted a variance in the watershed district to allow for the creation of a substandard lot (l acre) as compensation for a financial hardship claimed by the applicant. The hardship was based on an alleged loss of property value from the construction of the water treatment plant. Discussion followed regarding increased residential development in the watershed and the possibility of further degrading the public water supply. There appears to be little legal grounds for such a variance. P.Tariot motioned to ask the Board of Selectmen to authorize the use of Town Counsel to appeal the Ostherr variance. R.Milliard seconded. The vote went as follows; 5-1-1, P.Tariot, R.Milliard, C.Schoene, A.Brewster, R.Mansour were for, G.Reich was against and A.Manzi abstained. motion passed.
