Discussion George Farr appeared before the Board and stated the pro3ect is finished Tom Neve is looking into a compliance This item was placed on the agenda because the bond disappeared and was possibly withdrawn by Mr Farr Mr Farr can recall getting the bond G Reich wishes to have the bond re-posted Mr Farr was urged to seek a compliance by the next meeting A new bond will be required if a compliance is not requested by the 12/4 meeting English Circle (242-497) - Compliance Mr Pittochelli requested a certification of compliance and bond release Tom Laudani also spoke The Order of Conditions required a 25/50 no cut/no build The house on Lot 2 is 47 ' from the • wetland G Reich stated the plan needs to show the limit of grading C Schoene motioned to issue a compliance and grant a bond release contingent upon receipt of plans showing extent of grading in buffer zone, second by A Brewster The vote was 3-2-1 In favor C Schoene A Brewster and A Manzi Opposed P Tariot and G Reich R Milliard abstained Lots 3A & 4A Berry Street (242-550) - Modification Tom Neve represented the applicant to request a modification to install foundation drains in the 25 ' no-cut zone Upon motion of P Tariot and second by R Milliard the Board voted to grant the modification Bob Mansour abstained NEW BUSINESS Lot 16A (#191) Johnnycake Street - Partial Compliance P Tariot motioned and A Brewster seconded the motion to grant the partial compliance Passed unanimously Lot 42 Kittredge/Bear Hill (242-158) - Partial Compliance Ronald Cuscia represented himself requesting the partial compliance Upon motion by P Tariot and second by A Brewster the Board voted unanimously to grant the partial compliance Lots 6,8 & 10 Hidden Court Discussion of -he bond flood plain and wall in rear of property • Motion to issue the decision as amended The vote was 6-1 R Milliard opposed NACC 11/20/91 • Page 2 PUBLIC HEARINGS 1160 Salem Street - Determination (Cont ) Dick Barrett represented the petitioner The proposed addition has been moved further from the BVW Upon motion of P Tariot and second by A Brewster the Board voted to grant a negative determination with erosion controls Great Pond Estates (NACC #3) - Notice (Cont ) Mr Waites represented the applicant Elias Matathia and Farinon also appeared Revisions to the plan -culvert crossing has been redrawn No work in the wetlands -construction sequence submitted R Mansour had questions about the delineation We need to agree on a line Much discussion about disputed "wet areas" The applicant will show the disputed area on the plan R Doucette stated the delineation is inaccurate The construction sequence and revised plans were submitted today A continuance is needed to review this new information and agree on an accurate delineation Abutter Paul Moss questioned roadway width Discussion of whether or not to continue or close the public • hearing P Tariot moved to continue to public hearing to 12/4/ and R Milliard seconded 6 in favor G Reich, A Brewster, P Tariot C Schoene R Milliard and A Manzi 1 opposed R Mansour Mazurenko Farm Hunting Regulations G Reich announced procedure Petitioners will speak first then NACC will vote whether or not to reconsider the rules If this vote is positive those opposing the petition will speak Jim Smith Essex Council Sportsman's League and Walter Hoyt, NE Region of DFWL spoke The town shouldn't move ahead without a uniform plan Install safety zones to ensure abutters safety A Brewster voiced her safety concerns R Doucette stated a plan was done Mr Hoyt was obviously uninformed Certain restrictions could be in place as were discussed in the previous public hearing A Manzi asked if the town would lose possible acquisition funds if hunting was restricted Answer yes P Tariot askew if there are any towns with limited restrictions Answer Middleton and Westford had restrictions but these lands have been developed and now do not allow any hunting • NACC 11/20/91 • Page 3 C Schoene suggested discussing a compromise and difficulty of determining present uses A Manzi motion to reconsider the rules, R Mansour seconded Discussion Mike Campagna, hunter, stated he has never met anyone other than a hunter on the property R Mansour stated it is very difficult to enforce restrictions Motion failed 3-4 In favor of motion C Schoene, A Manzi and R Mansour Oppcsed G Reich A Brewster P Tariot R Milliard RESCO, Old Clark & Holt Rds - Determination Jim McIver and James Connolly Engineer represented RESCO and presented plans for two silos Henry Fink and R Doucette discussed an open file on this same project R Doucette stated applicant should pursue a compliance on the old file while the Commission reviews the new application i P Tariot motiored empower the site visit team to make a decision in the field Motion seconded by A Brewster Motion passed • Sutton Street Sunoco Station - Determination Atty Peter Shaheen represented the applicant Mr Orfanos of Enro Service Inc explained the project removal of soil and fuel tanks Upon the motion of P Tariot and second by R Milliard the Board voted unanimously to issue a negative determination with the following conditions - A hay bale erosion control barrier will surround all excavated soil A similar barrier will be installed along the river bank at the top of the slope - A tarp will cove the excavated soil pile overnight or during any precipitation - Any manholes on sight will be covered during I excavation/construction -The catch basin will be cleaned 40 High Street/North Andover Mills - Notice Jerry Foley and Joe Cushing represented the applicant The building is a proposed 70 000 sq ft building A portion of the pond (and associated wetlands) will be bridged by the building While BVW is not filled it is shaded and should be replicated Also the bank can be enhanced through plantings R Doucette presented an overview of wetlands impacts Discussion of wetland replication drainage system, erosion that may take place when vegetation dies off and bridge construction takes place Construction and demolition sequence is needed • Drainage needs to be installed to ensure flood control and pollution attenuation Final grades should be shown I NACC 11/20/91 Page 4 P.Tariot moved to continue the public hearing to 12/4/91 and R.Milliard seconded. Coventry I & II - Bond Seizure No representation. P.Tariot motioned to seize bond and R.Milliard seconded. Some discussion regarding the necessity of taking the bond and the appropriate uses of this bond. Vote was 6-0-1, A.Manzi abstained. Lots 1&2 Lacy Street - Notice Upon motion by P.Tariot and second by R.Milliard the Board voted to continue to 12/4/91. Lot 3 Marbleridge Road - Notice Motion by G.Reich and second by A.Brewster to continue to 12/18/91. DECISIONS Lot I Villa Way Motion by G.Reich and second by R.Milliard to accept the decision as amended. R.Milliard motioned to adjourn at 11: 55 p.m. second by A.Brewster.
