MINUTES
A Brewster motioned to adopt the September 4 , 1991 minutes,
second by P Tariot, unanimous
OLD BUSINESS
Water Treatment Plant (#242-421) - Modification to Plans
Mr Finegan from Weston & Sampson represented applicant Error in
topography pretty uniform, but not completely Intake above floor
of lake Colored topographic lines on plan indicated elevations
done by recent survey Still no additional topo information
submitted Reiterated existing information submitted at last
hearing P Tariot concerned that there is not enough information
to be sure if area is silted or not R Milliard motion to accept
plans second by G Reich
A Brewster and P Tariot opposed The applicant should have
indicated errors in topo when first discovered three years ago
Tom Neve suggested as-buzlts be required now as well as soil
borings to hard bottom particularly around intake Soil borings
and as-builts up to intake structure requested A Kasprzyk to
inspect next Friday 9/27/91 when everything should be done
except taking silt out of Lake (which will wait until frost)
Lot #9 (#251) Dale St (#242-462) - Partial Compliance
David Giangrande of Design State Survey, Inc , represented
applicant P Tariot motioned to issue Certificate of Compliance
contingent on stabilizing soil and cleaning of culvert and
inspection and approval of Conservation Administrator Second by
A Brewster, passed unanimously

Applicant's representative had requested that public hearing be
continued P Tariot motioned to continue until October 2 1991

Lot #5 Willow St South 335 Contact East 242-457 s
Modification to Order
Steve Foster from Channel Building represented applicant A plan
for new wetland replication area submitted Driveway supposedly
not draining into wetlands Plan referenced in Modification
should be stamped P Tariot motioned to issue amended Order of
Conditions and to accept the proposed drawing as Amendment #1 and
to extend the Order of Conditions to November 19, 1992 subject to
the submission of a stamped plan and proper location of erosion
control R Milliard seconded, unanimous
245 Johnson Street - Determination
Anthony Lally, owner represented himself He presented plans to
expand a bathroom 8 'X12 ' A Kasprzyk stated an erosion control
would be needed along existing lawn area P Tariot motioned to
issue a Negative Determination of Applicability with the
condition that erosion control be implemented and approved by the
Administrator R Milliard seconded, passed unanimously
Lot #6 (#34) Liberty Street - Determination
Owner Roy Davey represented himself requesting to do some
landscaped on his property at the above address P Tariot
motioned to iss.ie a Negative Determination with condition that
haybales be used for erosion control and inspected by the
Administrator A Brewster seconded A Kasprzyk to check to see if
Certificate of Compliance was ever issued on this property
Motion passed R Milliard abstained
Lot #5A (#284) Salem Street - Determination
George Reich, owner represented himself, requesting permission
to install an above-ground pool with a deck No grading proposed
Deck would extend up to railroad tie retaining wall Fix railroad
tie retaining wall at rear Can drain into sewer system Mr
Fugere, Marbler_dge Rd who is an abutter stated he was not
opposed Mr Blanco also stated he had no problem
A Brewster invo} ed the Doctrine of Necessity since only three
Commission members could vote P Tariot motioned to issue a
Negative Determination with the condition that a silt fence be
placed along the wall near the proposed pool and pool water not
• to be discharged to wetland R Milliard seconded unanimous

Route 114 (S cf N A Mall) - Determination
Mike Schwartz of District 5, MDPW requested permission to extend
a sidewalk 3001 east of N A Mall on the north side of Route 114
Proposed sidewalk to be 4 1/2 ' wide made of cement A guardrail
would also have to be moved There would not be any work to
embankment Only area to be disturbed is 4 1/2 ' and erosion
control will be utilized P Tariot noted that a Determination had
been issued on wetlands adjacent to the proposed sidewalk (NACC
#1) R Milliara reiterated M Schwartz 's statement that the work
would not require disturbance to the slope since this did not
appear possible M Schwartz maintains that there will be no
disturbance of embankment Bob Carter, supervisor for project
submitted an old 1980 plan Steve Connolly, 420 Winthrop Avenue
(Rte 114) wants to know if replication is proposed, etc
Site visit scheduled for Wednesday September 25 at 6 15 P M and
MDPW must notify abutters (or will show why the State is not
required to)
P Tariot moved to continue public hearing (with applicant's
permission) to October 2 1991 R Milliard seconded, unanimous
Applicant signet an extension
Lot 30A Stagecoach Drive (#242- ) - Notice
Proof of abutter notification provided by Tom Neve A positive
Determination was recently issued requiring Notice of Intent
House pretty mich done but not final grading Bank has since
taken project over This plan is an interim plan if detention
basin fixed (raised) then provisions made (i a catch basin and
pipe) "future" labeled work is the contingency Everything else
proposed now in terms of regrading
Carl Litmen E74 Salem Street asked how it will affect his
property Water just runs through detention basin now should be
held there T Neve doesn't know if the detention basins were
constructed prooerly
Mr Galvagna of 664 Salem Street said there is a culvert beneath
the railroad which shouldn't have been constructed A Kasprzyk to
see if the Pines Order of Conditions has expired
P Tariot motioned to close and issue an Order of Conditions
within 21 days A Brewster seconded, passed unanimously
Lot #6 Pine Ridge Road 242- - Notice
T Neve represented applicant Site receives water from Bear Hill
Pine Ridge Road acts as a dam causing detention pond to be built
• 229 5 = 100 ' flood elevation Drainage easement prevents filling
of area in future Center line of driveway, limit of work and
house corners to be staked in field Topo/location of inlet

stream to be provided. P.Tariot motioned to continue to 10/2/91,
R.Milliard seconded. Passed unanimously.
Scheduled site visit for 6:45 P.M. Wednesday, October 25.
NEW BUSINESS
Lot #10A & #11A Boxford Street (#242-537) - Partial Compliance
No representative, no action.
Lot #61 Coventry Estates II (Newcastle) (#242-385) -Part. Comp
No representative, no action.
Lake View Office Bldg. (#242-4l9) n--Extension. Bond Reduction
Must re-establish erosion control prior to construction. P.Tariot
motioned to extend one year to October 4 , 1992 . No motion on
bond. R.Milliard seconded. Passed unanimously.
OTHER BUSINESS
R.Milliard to draft Stagecoach decision.
A.Kasprzyk to do Lyons Way.
Lot E Berry Street (#242-556) - Order of Conditions
Discussion of proposed conditions. A.Kasprzyk to take out
requirement of fertilizer in Condition #35 of boilerplate.
P.Tariot motioned to adopt the Order as amended, A. Brewster
seconded. 3 : 1 vote, R.Milliard voting against motion. Motion
passed.
P.Tariot motioned to adjourn at 10: 50 P.M. R.Milliard seconded,
unanimous.
