Great Pond Road (#242-260)-Expired Order Continued at request of applicant AT&T Merrimack Valley Works (#242-417)-Compliance Peter Ba3or represented the applicant He noted that all numbered items have been completed with the exception of those listed in Mr Heinze's i-etter dated July 24 1991 P Tariot motioned to amend the Order of Conditions to delete items 14 16 through 14 20 and 14 29 and 14 30 R Milliard seconded, unanimous A Kasprzyk revaewed a portion of the site and will contact Mr Bajor to complete the site visit The Commission will not issue the Certificate until the next scheduled meeting (September 4, 1991) Lot #3 (#28) Rock Road (#242-21)-Partial Compliance Atty Tony Menard of the Law Offices of J Gibney P O Box 358 Sudbury MA 01776 represented the seller Brief discussion of site location and history of pro]ect P Tariot motioned to issue a Partial Compliance, R Milliard seconded unanimous NACC - August 21 1991 • Page 2 Lot #30 Stagecoach Lane (#242-294)-Enforcement Order/Expired Order Tom Neve represented Summit Bank owner of the lot T Neve explained history of site and how the Order of Conditions for the lot (#242-294) has expired as well as the Order of Conditions issued for the sub-division (#242-236) T Neve requested that the Commission issue an Enforcement Order allowing the grading to be completed He proposes to regrade the front lawn to allow water to drain into the existing detention basin P Tariot pointed out a discrepancy in the slope of the detention basin over what was originally proposed Much discussion ensued regarding who is responsible for the detention basin and when the issue will be resolved A Kasprzyk will check the status of the detention basin with the Planning Board The Commission will require a new Notice of Intent filing rather that issuing an Enforcement Order to finish the proposed work 4 PUBLIC HEARINGS #267 Chickering Road (99 Restaurant)-Determination David Lanzoni and Bill Merry represented applicant A Kasprzyk explained that the wetland area is very questionable, perhaps regulatable on_y under the bylaw Bill Merry signed an extension of the public tearing to September 4, 1991 Commission scheduled a site visit for Wednesday August 29 1991 at 6 30 or 7 00 P M Julia Warchol an abutter recalled the area before development occurred anc has concern regarding flooding Michael Archidiacono, another abutter was concerned regarding new wetland regulations P Tariot motioned to continue the public hearing to September 4 R Milliard seconded unanimous Lots 6, 8 & 10 Hidden Court-Determination (Cont ) Scott Giles represented the applicant C Schoene felt that there was a problem issuing a Negative Determination when so much grading has occurred on the lots as well as work within the 25 foot no-cut zone He recommends a Notice of Intent submission, with 100 year flood elevations etc P Tariot motioned to issue a Positive Determination R Milliard seconded unanimous Lot E Berry Street - Notice of Intent Phil Christiansen represented the applicant Notice was denied at the last filing because the Commission wanted the house further North and less work directly adjacent to wetland Current submission includes two alternatives 1 house in back involves much buffer zone impact and permanent wetlands crossing 2 same as before in front but no lawn adjacent to stone wall on • South side of louse and a reduced lawn out back - kept a small lawn over septic tank NACC - August 21, 1991 Page 3 Impact to wetland bordering vegetated = 960 sq ft with house in back, as well as 42 ' of bank (21' of culvert twice) R Milliard would consider other alternatives as well but he isn't sure what they would be He is unsure whether viable solutions have been presented yet P Tariot motioned to continue to September 4, R Milliard seconded uananimous Lot #3 (#240) Marbleridge Road - Determination Mr Cavallaro the owner was present Culverted brook opened up by applicant C Schoene explained that you cannot work within wetlands without prior approval P Tariot motioned to close the hearing and empowered the site visit committee to issue a decision on Wednesday August 28 R Milliard seconded, motion unanimous Lots #5-8, 14 Hickory Hills Estates (#242-474)-Part Comp Bond Release Al Shaboo represented the applicant Brief discussion P Tariot motioned to grant the Partial Certificate of Compliance and / related bond releases C Schoene seconded, unanimous 5 DECISIONS Lot 23A Forest Street P Tariot motioned to accept Order of Conditions as amended C Schoene secorded unanimous Intersection of Cotuit & Dartmouth Sts -Determination- Site Visit on E-14-91 P Tariot motioned to issue a Negative Determination with erosion control as a condition the Administrator must supervise the onset of work and the machinery must work from the channel A Brewster seconded Vote was unanimous Members present were Paul Tariot Alison Brewster Carl Schoene and George Reich R Milliard motioned to adjourn at 11 00 P M , seconded by P Tariot passed unanimously eorge Reich Chairman Adopted on September 4, 1991 •
