HomeMy WebLinkAbout1991-07-21 Conservation Commission Minutes MINUTES OF NACC JULY 17 1991 PRESENT George Reich/Chair Alison Brewster/Vice-Chair Paul Tariot Richard Milliard Carl Ehoene Donald Stanley Linda Dufresne Sec'y Anne Kasprzyk Act Admin MINUTES Paul Tariot motioned to accept June 19, 1991 minutes as amended, Richard Milliard seconded motion passed Paul Tariot motioned to accept July 10 minutes as amended A Brewster seconded unanimous ODL BUSINESS, Chestnut Green (#242-243)-Compliance (Cont ) Brian Sheehy of Kebb Properties was present as well as Dr John Mallet Lengthy discussion ensued regarding whether the replication area is successful Dr Mallet contends that Spring, Summer and Fall are separate growing seasons and although clover is a FACU species its presence in the replication area is satisfactory and should be included as a wetland species in calculating 75% wetland plant species coverage Dr Mallet provided the above information in a letter dated July 16, submitted at the hearing Dr Mallet submitted indicator status of species as requested in Anne Kasprzyk's letter of June 24 1991 but did nct provide sample plots indicating percent cover of wetland species A Kasprzyk will check with DEP regarding growing season and the use of FACU species in a replication area issue will be continued until the August 21 hearing at the request of the applicant NEW BUSINESS, LOT #5 (#489) SHARPNER'S POND ROAD (#242-386)-COMPLIANCE Judith Dolan former owner of land requested Certificate of Compliance Linda Galvin is now the owner C Schoene indicated that culverts must be cleaned P Tariot motioned to issue the Certificate cf Compliance subsequent to notification and verification of the proper maintenance of the culverts R Milliard seconded Passed unanimously • Page 2 / NACC JULY MEETING #125 SALEM STREET (#242- )- DETERMINATION-PUBLIC HEARING Walter Demers homeowner, explained landscaping was done in buffer zone A Kasprzyk explained a filing was required after the fact and that erosion controls have been properly installed P Tariot motioned to issue a Negative Determination with erosion control condit-on A Brewster seconded Passed unanimously LOTS #6B & #9A BOXFORD STREET (#242-537) - PARTIAL COMPLIANCE Dave Kindred requested Partial Certificate of Compliance A Kasprzyk explained that a previous request was made and withdrawn Renediation work has since taken place P Tariot motioned to issue Partial Compliance A Brewster seconded Passed unanimously F Tariot motioned to reduce the bond by $7,000 leaving $6, 000, R Milliard seconded Motion passed unanimously LOT #44 STAGECOACH ROAD (#107) (#242-544)- PARTIAL BOND RELEASE Joe DiMartino owner Commission denied request since there is some question as to whether work has occurred within 15' no-cut zone Applicant noted that R Doucette had approved erosion control placement A Kasprzyk will call R Doucette and the Commission will schedule a site visit SHARPNERS POND ROAD (#242-546) - POSSIBLE VIOLATION A Kasprzyk will contact applicant to have him fix erosion control Will issue Enforcement Order if not rectified in a timely fashion LOT #25 GRANVILLE LANE (#242-160)- COMPLIANCE George Farr as applicant A Kasprzyk had completed and okayed the site visit an3 had no problems P Tariot motioned to issue Certificate of Compliance R Milliard seconded Motion passed unanimously DISCUSSION OF POLICY RE LETTERS FOR CERTIFICATE OF COMPLIANCE Put on agenda at request of Scott Giles not in attendance Reviewed state regulations Letters from professional engineers or surveyors nust indicate whether or not the pro]ect is in accordance with the Order of Conditions as well as the plans Any discrepancies must be pointed out LOT #3 JOHNNYCAKE STREET (#242-115)- PART COMP /BOND RELEASE Continued to August 7 1991 at request of applicant FOR U & COMPLIANCE SIGN-OFF POLICY P Tariot motioned to accept the Draft Form U and Compliance Sign- off procedures as Commission Policy R Milliard seconded Motion passed unanimously • Page 3 / NACC .DULY 17, 1991 MERRIMACK RIVER TRAILS P Tariot motioned to endorse the endeavors of Cathy Hirsch, of Merrimack River Watershed Council, to create a trail system along the Merrimack River R Milliard seconded D Stanley abstained Motion passed with five in favor and one abstention BMP'S - NANCY SULLIVAN (EPA) P Tariot will give Nancy Sullivan feedback on this OTHER BUSINESS G Reich will pursue new commission members Commission will perform site visits on Wednesday, July 24 at 6 00 P M at Lot #44 Stagecoach Lane to be followed by South Cross Road and Lot #23A Forest Street P Tariot motioned to issue an Enforcement Order to GLSD if they do not file within 10 days of notice R Milliard seconded Motion passed unanimously P Tarlot motioned to issue another Enforcement Order regarding Liberty Hills II ordering applicant to stop all work seconded by D Stanley Motion passed unanimously P Tariot motioned to ad]ourn at 10 00 P M , R Milliard seconded Motion passed unanimously eorge Rei h Chairman Approved August 21, 1991 •
