HomeMy WebLinkAbout1991-05-15 Conservation Commission Minutes .f Minutes of 5/15/91 Conservation Commission Meeting Present George Reich Alison Brewster Richard Doucette Carl Schoene Paul Tariot Administrator Don Stanley Richard Milliard LOT 60A HAYMEADOW RD (#242-263) REQUEST FOR COMPLIANCE J McQuilkin requested a compliance on lot 60A from an earlier file The pro-ect was built to file #242-413 and this file has received a compliance George Reich motioned to grant the compliance Richard Milliard seconded, motion carried LOT 31 COVENTRI ESTATES (#242-514) REQUEST FOR COMPLIANCE R Barrett requested a compliance A compliance was originally requested last fall but was rejected by the Administrator due to unstable slopes The slopes are now stable George Reich motioned to issue a certificate of compliance on file #242-514 A Brewster seconded motion carried LOT 21 NEWCASTLE ESTATES (#242-385) REQUEST FOR COMPLIANCE The Administrator requested Mr Barrett's presence to present plans for lot 21 Newcastle Although the Order of Conditions requires that this lot file a RDA, Mr Barrett's plans show all work outside tte buffer zone There was discussion as to whether an area indicated as a wetland (#18) on the Newcastle plan was indeed a wetland The NACC will visit the site The Administrator will attempt to determine if #18 on the plan was determined to be a wetland by the NACC originally LOT 13 WINTERGPEEN (#242-438) REQUEST FOR COMPLIANCE Dave Temchulla requested a compliance for lot 13 Wintergreen The slope to tte rear of the house has been unstable in the past but seems to be stable at this time The compliance will state that stabilization of the slope will be a continuing condition after the compliance is issued George Reich motioned to issue a compliance R Milliard seconded motioned carried SHANNON LANE (#242-279) REQUEST FOR EXTENSION J McGarry and D Zaloga requested an extension There was some discussion regarding the replication area G Reich motioned to grant an extension to 8/22/92, R Milliard seconded, motion carried DEERFIELD LANE (#242-348) REQUEST FOR EXTENSION J McGarry and D Zaloga requested an extension There was some discussion regarding the flooding problem that took place last fall R Doucette has spoken with P Christiansen regarding this and elevations will be taken of the flooding on the Lincoln's property to determine if flooding has occurred at a higher elevation than was determined by P Christiansen's calculations A Kasprzyk discussed the no-cut zone on lot 3 G Reich motioned to grant a one year extension, D Stanley seconded Vote 4-2 in favor of granting the extension Motion carried WILLOW PLAZA (#242-277) DISCUSSION Tom Neve presented his letter regarding flooding problem on McLays He now represents the McLays This issue will be discussed in detail on June 5 GREAT POND RD WATER AND SEWER PROJECT (#242-517) ENFORCEMENT ORDER ISSUED An Enforcement Order was issued by the Administrator for unstable slopes, erosion and siltation, lack of response to a phone call and a letter Mr John Hume of Weston and Sampson Engineers appeared and submitted a construction schedule that would deal with these issues All work should be completed by the end of the month RIDGEWOOD CEMETERY ENFORCEMENT ORDER An Enforcement Order was issued by the Administrator for filling of a wetland w_thout an Order of Conditions Gayton Osgood represented the Cemetery Association The cemetery staff are now dumping their excess fill in another location The Administrator will meet with Gayton on site to determine how much material needs to be renoved WATER MAIN REHAB DETERMINATION OF APPLICABILITY - CONTINUED PUBLIC HEARING Paul Rullo of Weston and Sampson submitted notifications to abutters The Public Hearing had been continued due to the lack of notification originally Don Stanley motioned to close the public hearing and issue a decision tonight A Brewster seconded G Reich abstained, motion carried 1780 OSGOOD ST - TROPEANO CONSTRUCTION NOTICE OF INTENT - CONTINUED PUBLIC HEARING Tim Tanner represented Tropeano Construction Revised plans were submitted The sewer line has been moved into the pavement all erosion contro.,.s are shown, the addition has been downsized from 30 X 40 to 30 X 30 The Administrator noted that one 30 ' measurement is incorrect It scales off to 35 ' G Reich motioned to close the public hearing and issue a decision within 21 days of receipt of revised plans showing the correct size addition R Milliard seconded Motion carried LOT 2 LIBERTY ST NOTICE OF INTEUT - CONTINUED PUBLIC HEARING P Christiansen represented the applicant The house and • driveway have been staked The distance from the driveway to the pond was again discussed NACC members wished to visit the sit R Milliard motioned to continue to the public hearing to June 5 G Reich seconded motion carried LOT 30 ANNE ROAD NOTICE OF INTENT - CONTINUED PUBLIC HEARING Scott Giles presented 5/9 revised plans C Schoene and R Doucette discussed the wetland line The current delineation (created by the Commission's review) is 5-15 ' higher than the original delineation The applicant accepts the new line and has redesigned the septic system to accommodate it The delineation procedure was discussed and the Administrator presented a swamp white oak leaf (Quercus bicolor) to the NACC The applicant's representative felt that these oaks were red oak Two abutters expressed concerns regarding a no-cut zone along the edge of the wetland and the septic system C Schoene and R Doucette referenced the previous filing (#242-339) This Notice of Intent showed a narrow house more that 60 ' from the original wetland line R Milliard motioned to close the public hearing and issue a decision within 21 days G Reich seconded Motion carried DRYAD AND BELFPST STS NOTICE OF INTENT - PUBLIC HEARING P Christianser represented the owners The work proposed is to construct Dryad St The cul de sac is adjacent to BVW and fills a portion of the shawsheen river floodplain A recharge area controls street runoff Six house lots are proposed Only 1 • house will likely be within the buffer zone R Doucette noted that without scil tests the viability of the recharge area is in question The wetland line is very confusing due to the disturbed nature of the land It was once a loam and gravel operation G Reich motioned to continue to June 5 R Milliard seconded moticn carried The NACC will conduct a site visit LOT E BERRY ST NOTICE OF INTENT P Christiansen represented the applicant J Philbin This project proposes a house in the buffer zone with a force main leading to a septic system in the rear of the property The force main crosses under a stream twice There was some discussion regarding the delineation Only a 3 ' no-cut zone is shown adjacent to the house The NACC requested the following (a) Re-establish the flagging (b) Submit a construction sequence for the stream crossing (c) Turn the house to create a greater setback (d) Check zoning setback from the side lot line Abutter Mr Hamilton has concerns re water R Milliard motioned to continue to June 5 A Brewster seconded motion carried LOT 16 DALE ST NOTICE OF INTENT - PUBLIC HEARING The applicant has requested a continuance (tentatively) to June • 5 A Brewster motioned to continue G Reich seconded motion carried 1780 OSGOOD ST. (#242-153) REQUEST FOR COMPLIANCE Tim Tanner requested a compliance on the previous order of Conditions. The latest revision of the plan, which was referenced in the Order, cannot be located. R. Milliard motioned to grant a compliance referencing the 4/20/82 revision. G. Reich seconded, motion carried. DECISIONS : WATER MAIN REHAB D. Stanley motioned to issue a negative determination with erosion controls. R. Milliard seconded. G. Reich abstained. PHASE II SEWER LINE G. Reich motioned to adopt the decision as amended. R. Milliard seconded. Motion carried. LOT 3A AND 4A BERRY T. G. Reich motioned to adopt the decision as amended. D. Stanley seconded. Motion carried. Decision will be issued when a file is issued.
