License - Annual Report George Barker- 8 acre hay field Would like to mow field on Bradford Street yearly R Doucette does not concur Richard Rogers- 12 acre alfalfa field Renovate field soon and secure hay rake Scott Circle - Extension Request for an extension under the Bylaw Motion by P Tariot and seconded by R Yilliard to grant the extension #115 Bonny Lane - Violation - Update R Doucette gave an overview The landowner has responded to the letter sent to him NEW BUSINESS 13 Lancaster St (#242-592) - Modification Paul St Hillaire appeared to request a modification to move the driveway Motion by A Manzi and seconded by P Tariot to grant the modif icaticn Lot 3A Coventr-y Lane - (#242-583) - Compliance Bill Barrett appeared to request a compliance Motion by P Tariot and seconded by R Milliard to grant the compliance Prescott Village (#242-80) - Compliance Motion by P ^ariot and seconded by A Manzi to grant the compliance Lot 23A Forest Street (#242-555) - Partial Bond Release Motion by P Tariot and seconded by R Milliard to release $4 000 of the bcnd OLD BUSINESS Coventry Estates I (#242-324) - Use of Seized Bond Motion by P Tariot and seconded by R Mansour to contract to Appleton Vote 0-7, all opposed Seek 2 more bids NACC 1/20/93 Page 2 PUBLIC HEARINGS Lot 22 Pine Ridge Road (#242- - Notice Jim Bourgoeis presented plans for a single family home The permit to construct a home on this lot has expired This Notice of Intent is for a home in a different location on the lot it is very close to wetlands The following abutters expressed their concerns Ms Varoutsos stated that winter was a bad time to delineate Mr Spinezolla asked about the waiver request Ms Varoutsos also stated there appears to be more disturbance to construct the previous home Motion by P Tariot and seconded by R Milliard to continue the public hearing to 2/3/93 Lot 43 Candlestick Road - (#242-646) -_Notice Jim Bourgoeis presented plans for a single family home The Commission feels that the plan is not legible The slope to the wetland is not as is shown on the plan It is a terrace Motion by R Mansour and seconded P Tariot to issue a Positive Determination on the Request for Determination Continue the public hearing to 2/3/93 to submit new plans which are legible and show existing condition #351 Willow Street - (#242-647) - Notice Jim Bourgoeis presented plans for an addition to Bake 'n Joy Foods Discussion of compliance with original file The work previously done is not in compliance with the original OOC (#242- 317) in an area where grading exceeded the approved limit of work from 5 to 25 feet Discussion of addition and parking which is the subaect of the new Notice of Intent Proposed work requires grading 5' from a wetland and building 35 ' from wetland Discussion of the possibility of moving the proposed parking Discussion of drainage and the new Local Regulations which require upland stormwater management Abutter Mr Prochniaks expressed his concerns of the building being built Concern of lighting and noise Mr Caron thinks this will be built too close to abutting private landowners Mr Schwind was also concerned with the expansion G Reich wants a plan only showing existing conditions to discuss compliance J Bourgoeis agreed R Doucette stated that no bond was ever posted ($6000) Motion by P Tarrot and seconded by A Brewster to continue the public hearing and compliance discussion to 2/3/93 NEW BUSINESS Willow Street Extension (#242-484) - Compliance Motion by P Tariot and seconded by A Brewster to grant the compliance Vote 6-0-1 K Foley abstained NACC 1/20/93 Page 3 Lot 44 CAstlemere Road (#242-255) - Partial COAT)Iianq R.Doucette gave an overview. Motion by P.Tariot and seconded by A.Manzi to grant the Partial Compliance. Conservation Fees Discussion of merits of a change to the Bylaw. Motion by P.Tariot and seconded by A.Brewster to re-submit request for legal services to the Town Manager. Vote 5-2, G.Reich and R.Milliard against. EXEMIVE SESSION Lot I Dale Street - Litigation Discussion Discussion of litigation strategy. DECISIONS North Andover Heights Motion by P.Tariot and seconded by A.Manzi to issue the decision as written. Vote 6-0-1, R.Milliard abstained. Lqts, 25 St 27 Candlestick Road Motion by, A.Manzi and seconded by R.Mansour to issue the decision as written. Unanimous. Holt Road/Rte. 125 Motion by R.Mansour and seconded by A.Manzi to issue the decision as written. Unanimous. Woodland Estates Motion by P.Tariot and seconded by G.Reich to issue the decision as written. Unanimous.
