HomeMy WebLinkAbout1993-07-07 Conservation Commission Minutes CONSERVATION COMMISSION JULY 71 1993 MINUTES ATTENDANCE J Leeman, G Reich A Manzi R Milliard K Foley B Mansour P Tariot R Doucette (Administrator) MINUTES Motion by Paul Tariot seconded by Kevin Foley to adopt the minutes of June 16 1993 as amended Motion passed unanimously OLD BUSINESS #10 Tucker Farm Rd R Doucette discussed a violation reported on Tucker Farm Rd The homeowner has placed fill from his property across the street on the road shoulder next to the wetland A violation notice was issued and the soil has been seeded and mulched #940 Great Pond Rd (#242-656) R Doucette and P Tariot gave an update on the status of the criminal complaint Lot 10A Boxford St (#242-537_) G Reich noticed a violation at #257 Boxford St R Doucette inspected the site from the road and spoke with the homeowner on the phone The cutting of the lawn has extended into the no-cut zone The Commission will take no further action #18 Willow St R Doucette discussed this ongoing violation and input received from Town Counsel P Tariot motioned and John Leeman seconded to seek an injunction against the landowner Vote 5-1-1 A Manz. opposing K Foley abstaining NEW BUSINESS Lot 2 Coventry Estates (#2L2-524) - Compliance B Barrett requested a Certificate of Compliance A letter and As- Built were submitted from Scott Gales P Tariot motioned R Milliard seconded to issue a Certificate of Compliance Motion passed unanimously Lots 24A 25A 26A Forest St (#242-580 581 , 582) - Compliances B Barrett requested compliances Phil Christiansen s letter certifying substantial compliance was discussed G Reich motioned K Foley secondea to issued the compliances Vote 6-0-1 J Leeman abstained 7/7/93 minutes Page 2 Whipporrwill Estates (#242-542) - Modificati S Giles and C Dickerson (landowner) appeared to request a modification to approve a slightly different roadway layout B Mansour felt that a new public hearing might be needed The plan should show erosion controls topography and extent of filling of ILSF Plan will be revised P Tariot motioned J Leeman seconded to continue this to 7/21 Motion passed unanimously Bradford St & Stevens St Water Line (#242-522) - Compliance Great Pond Rd Water & Sewer Line (#242-517) - Compliance J Finnegan of Weston & Sampson requested compliances R Doucette stated that there is a drainage problem on Bradford St as a result of the water line installation P Tariot motioned G Reich seconded to issue a compliance on the Great Pond Rd pro]ect but to seek input from the DPW prior to issuing a compliance on the Bradford St /Stevens St proaect Motion passed unanimously I Lots 2 3 4 Sullivan St (#242-588) - Partial Compliance J Grifoni requested a partial compliance The letter and As-Built plan from P Christiansen was presented P Tariot motioned A Manzi seconded to grant the partial compliances upon receipt of the original plans Motion passed unanimously Lot 6 Bridle Path 4242-17) - Partial Compliance P Tariot motioned R Milliard seconded to issue the partial compliance PUBLIC HEARINGS Lots 24A 31A Vest Way (#242-605 608) - Notices A Manzi motioned, R Milliard seconded to close the public hearing on these Vest Way lots Motion passed unanimously G Reich motioned P Tariot seconded to issue the decision as written to deny these pro3ects Motion passed unanimously Lot 1 Forest St - Determination J Barbagallo presented plans for a single family home P Tariot motioned J Leeman seconded to issue a negative determination with erosion controls placed at 25 ' from the wetland Motion passed unanimously #100 Laconia Circle - Determination Albert Webster (pool contractor) and Mrs D Angelo (landowner) presented plans for a pool K Foley motioned seconded by A Manzi to issue a negative determination with erosion controls to be placed at 20 ' Motion passed unanimously 7/7/93 minutes Page 3 Lot 34 Lancaster - determination outside the buffer zone. S.Giles presented plans for a home R.Milliard motioned, B.Mans,our seconded, to issue a negative determination. Motion passed unanimously. Lot 36Determination S.Giles presented plans for a home. P.Tariot motioned, R.Milliard seconded, to issue a negative determination with erosion controls placed at 501 from the wetland. #316 Johnson St. - Determination Les Godin presented plans for a septic system 701 from the wetland. This project is in the Lake Cochichewick Watershed. Discussion of the potential need for a special permit from the Planning Board. G.Reich motioned, P.Tariot seconded, to issue a negative determination. Vote: 3-3-1, P.Tariot, B.Mansour, R.Milliard opposed, J.Leeman abstained. Motion failed. R. Doucette suggested locating all the active area away from the wetland and the reserve closer to the wetland, thus creating a 901 setback from the active area to the wetland. Motion by A.Manzi, seconded by K.Foley, to issue a negative determination with a 901 setback from the wetland and the issuance of a variance by the BOO. Motion passed unanimously. Lot 24A Tan qL1ewoC'd _C#242- Continued Notice driveway Pat Seekamp presented plans for a home with a wetland crossing. Discussion of the need to cross the wetland and the possibility of alternative access. The landowner has an adjacent lot which does provide a link to Rocky Brook Estates. P.Tariot motioned, K.Foley seconded, to close the public hearing and issue a decision within 21 days. Motion passed unanimously. Calzetta Site SchoolC_#242- - NgLi_ce Martin Kretch presented plans for the school which was approved 4 years ago. The permits have lapsed. Discussion of wetland filling and replication. P.Tariot motioned, A.Manzi seconded, to close the public hearing and issue a decision within 21 days. Vote: 6-1, B.Mansour opposed. Lots A B.0 Marbl idae Rd. (#242- Notice M. Rosati presented plans for 2 homes in the Watershed. There was discussion about lot lines and the sewer line. A special permit and variance are also needed from the Planning Board and Zoning Board respectively. P.Tariot motioned, K.Foley seconded, to close the public hearing and issue a decision within 21 days. Motion passed unanimously. 7/7/93 minutes Page 4 Lot 4 South Cross (#242- 1 - Notice Pat Murphy and S Giles submitted plans for a single family home with a driveway crossing over a wetland There was discussion regarding the sizing of the culvert under the driveway, potential for non-wetland access and the location of the driveway The plan will be revised and calculations will be submitted to size the culvert Abutter V Mandry expressed concerns about the septic system and drainage P Tariot motioned R Milliard seconded to continue this hearing to 7/21 Motion passed unanimously G Reich relinquished the Chair to R Milliard G Reich abstaining Lot 5A Salem St - Determination G Reich presented plans for an above-ground pool and deck in the buffer zone A Manzi motioned K Foley seconded to issue a negative determination with erosion controls DECISIONS #351 Willow St P Tariot motioned K Foley seconded to issue the decision as written Motion passed unanimously Meeting ad3ourned at 10 40pm George Reich Chairman
