Motion by P Tariot and seconded by R Milliard to adopt the
minutes of 7/2,/93
OLD BUSINESS
Coventry Estates Drainacle Analysis
Tom Neve repor.ed on his review of the detention basin near Dale
Street The basin is too small T Neve has designed the
largest pond oossible within the easement Much discussion
Tabled until next meeting to review some additional designs
Lot 7A Candlestick Road (#242-574) - Violation
This matter was continued from the last meeting Jim Grifoni and
Phil Christiansen responded to the Violation Notice R Doucette
gave an overview of the issues Discussion of the compensation
area Tabled to the next meeting after meeting to enable
applicant to research file and determine requirements for
"replication" area

Scott Giles requested a Compliance and submitted As-Built
Motion by P Tariot and seconded by R Milliard to grant the
Compliance
Lot 28A South Bradford Street (#242-623) - Compliance
Scott Giles requested a Compliance and submitted As-Built
Motion by P Tariot and seconded by R Milliard to grant the
Compliance

Lots 3&4 Bradford Street
Mike Rosati from Marchionda Assoc and Dave Kindred presented
plans for two single family homes accessed by a common drive over
an existing gravel road through the wetland Maximum of it 000
square feet of BLSF to be disturbed 4 200 is permanent
(driveway) Submit wetland assessment as required by DEP policy
statement Abutter Else Pouliot expressed concerns of flooding
as a result of this pro3ect Abutter Driscoll commented as
well Motion by P Tariot and seconded by J Leeman to continue to

Joe Quinn requested a Partial Bond Release of $2 000 Motion by
R Milliard and seconded by K Foley to grant a Partial Bond
Release of $2, 000
Whipoorwill Park (#242-542) - Modification
Scott Giles presented revised plans Plan now shows topo lines
and SSDS Motion by P Tariot and seconded by K Foley to issue a
Modification citing the revised plan
Lot 2 (292) Salem Street (#242-527) - Compliance
Tom Neve presented an As-Built plan and requested a Compliance
The compensatory flood storage area was not done The 15 ' no-cut
zone was violated The As-Built shows 2 ' The wetland was to be
protected by a conservation restriction it has not A deed
restriction restricting fertilizers pesticides and herbicides was
to be recorded it has not R Doucette is to speak with Mr
Fugere and Planning regarding flood storage Tom Neve is to
provide the Commission with two easements and to replant the no-
disturbance zone Continue to 8/18
#40 High Street (#242-563) - Modification
Joe Cushing and Dan Chevis presented data relating to increased
runoff and ground water monitoring Discussion ensued Motion
by K Foley and seconded by R Milliard to issue the Modification
with the condition that the monitoring continue once per month
until the Commission agrees that there is no further disturbance
of soil then twice a year after that
Lot 1 Village Way (#242-561) - Compliance
Scott Giles presented an As-Built and a letter and requesting a
Compliance Motion by P Tariot and seconded by J Leeman to grant
a Compliance

Lot 5A Berry Street (#242-584) - Compliance
Jim Bourgeois from Tom Neve Associates requested a Compliance
Motion by P Tariot and seconded by K Foley to grant the
Compliance contingent upon the receipt of a letter from a
Professional Engineer certifying compliance with the OOC
Lot 4C Forest Street (#242-594) - Compliance
David Kindred and Mike Rosati appeared to request a Compliance
Motion by P Tariot and seconded by R Milliard to grant the
Compliance

Motion by R Milliard and seconded by P Tariot to grant the
Compliance upon an inspection by R Doucette and the receipt of a
revised As-Bui-t Vote 4-0-1, G Reich abstained
Lot 13 Lancaster (#242-631) - Compliance
Scott Giles submitted a letter and an As-Built Motion by
R Milliard and seconded by P Tariot to grant the Compliance
Lot 16 Lancaster (#242-632) - Compliance
Scott Giles submitted a letter and an As-Built Motion by
R Milliard and seconded by P Tariot to grant the Compliance
Lot 52 Blue Ridge (#242-624) - Compliance
Scott Giles presented an As-Built and letter requesting a
Compliance Motion by K Foley and seconded by R Milliard to
grant the Compliance Vote 4-0-1 P Tariot abstained
Lot E (#60) Willow Street - Discussion
Jim Bourgeois and Greg Wiech appeared to discuss an existing
industrial building Discussion of Compliance on the overall
North Andover Business Park OOC (*242-193)
DECISIONS

Motion by P Tariot and seconded by R Milliard to issue the
decision as written Motion passed unanimously
Lots A.B.0 Marbleridge Road
Motion by G Reich and seconded by K Foley to issue the decision
as written Motion pass unanimously
El Hefni discussion NACC will not prosecute Atty Croce if he
plants trees in the disturbed BVW
