HomeMy WebLinkAbout1993-09-15 Conservation Commission Minutes CONSERVATION COMMISSION SEPTEMBER 15 1993 PRESENT George Reich Al Manzi Richard Milliard John Leeman Robert Mansour Kevin Foley Richard Doucette Administrator VIOLATIONS #18 Willow Street R Doucette provided an overview of the enforcement matter Atty R Hucksam represented Mr Mscisz and spoke on his behalf Should the Commission pursue the in3unction7 G Reich expressed concerns of additional ;filling of wetlands There was discussion as to whether the Commission wished to go forward or delay to allow Mr Mscisz to hire a wetland consultant Motion by J Leeman and seconded by K Foley to delay action on the injunction until the next meeting Some discussion ensued Motion by J Leeman and seconded K Foley to amend the motion to include a letter from Atty Hucksam indicating that no additional work would be done Vote 1-5-1 J Leeman in favor R Mansour abstained Motion failed Legal action will continue North Andover Estates (#242-58a J Mallett and J Nolan appeared R Doucette gave an overview of the recently discovered siltation of a wetland adjacent to this project and the lack of erosion controls on site J Mallett responded to the issues raised A Manzi presented his findings and silt which he found in the wetland which still remains R Doucette spoke of drainage ditches and check dams lot stabilization and Toll Brothers working too slow Tom Frangos responded R Doucette continued entrance sumps and sweeping John Nolan also spoke NACC should conduct a site visit Motion by A Manzi and seconded by K Foley to require an additional $10 000 for the silted wetland Vote 6-0-1 G Reich abstained NEW BUSINESS #350 Winthrop Avenue (#242-578) - Compliance Motion by P Tariot and seconded by R Milliard to grant the Compliance concitional upon the verification of a 1" chain link fence #1070 Osgood Street (#242-419) - Extension Jim Bourgeois from Tom Neve Associates represented this project Motion by J Leeman and seconded by P Tarlot to grant the extension Discussion of extending an expired order Chairman ruled question out of order since an expired Order of Conditions cannot be extended NACC 9/15/93 Page 2 Edgewood Life Care (#242-511 + 515 (utilities) ) - Extension Motion by K Foley and seconded by A Manzi to extend for one year Motion passed unanimously North Andover DPW - Ch 91 Emergency Permit R Doucette and G Perna spoke on the need to immediately remove sediment from the end of the water treatment plant's boat ramp Motion by P Tariot and seconded by R Milliard to grant an Emergency Certification Lot 2 Holly Ridge Road (#242-629) - Compliance No letter from a professional engineer Motion by J Leeman and seconded by K Foley to issue a Compliance upon receipt of a letter from a professional engineer Vote 4-2-1 A Manzi and G Reich against and P Tariot abstained Lot 3 Blue Ridge Road (#242-629) - Compliance As-Built plans do not show retaining wall Discussion of plan revisions Motion by R Milliard and seconded by A Manzi to issue the Compliance Vote 6-1, P Tariot against Lot 30B Bear Hill (#242- ) - Partial Compliance � Bill Crocker represented this pro3ect Motion by P Tariot and seconded by R Milliard to issue the Partial Compliance PUBLIC HEARINGS Hillside St /Meadowood II (#242- ) - Notice (Cont Steve Stapinski of Merrimack Engineering presented a revised sheet #3 There was discussion of possible impact of off site drainage Abutters Mr Hamel asked about the tailings and potential drainage impacts Mr and Mrs Kohl expressed concerns of off site drainage impacts and want a detention pond There was discussion of hiring an outside consultant to review the drainage impacts Mr Hamel stated the North Andover Business Park also drains into the same wetland Motion by P Tariot and seconded by G Reich to invoke chapter 178 11 Much discussion Vote 1-6 P Tariot in favor Motion by R Mansour and seconded by R Milliard to close the public hearing and issue a decision within 21 days Al Manzi no longer in attendance Phase III Sewer (#242- ) - Notice (Cont ) Phase III Sewer Pump Station (#242- ) - Notice (Cont Joanne Haracz of LEA presented plans for the same R Doucette expressed concerns over how Phase I and II were done Loaming and seeding took too long Phase II began without proper notification, or posting of bond with the Commission NACC 9/15/93 Page 3 J Haracz and G Perna responded to these concerns Abutter Mr Leone, as}ed about the pump station Motion by K Foley and seconded by R Milliard to close the public hearing and issue the decision within 21 days Vote 5-0-1 P Tariot abstained Lot E-1 (#60) Willow Street (#242- ) -
