MINUTES
Motion by P Tariot and seconded by J Leeman to adopt the minutes
of September 1 and 15 1993
VIOLATIONS
#18 Willow Street
Rick Hucksam represented Mr Mscisz The site has been evaluated
by Wetlands Preservation Inc and site plan has been developed to
proceed with a restoration plan Kurt Young presented the plan
and Wetland Restoration plan (10/6/93) The Commission expressed
concerns about the delineation since hydric soils are present
throughout the site including above the delineation The
commission needs to see the hydric soil line and the
Administrator needs to review the aerial photos The NACC will
require a Not-ce of Intent and will not allow the restoration
under an Enforcement Order
Hillside Road
R Doucette gave an overview of a violation observed on Hillside
Road The violation includes the grading of land ad3acent to
and in a Bordering Vegetated Wetland Mr Analloro appeared and
explained that he was harrowing his field He stated that he had
done this in the past The landowner will be required to file a
Request for a Determination to determine the wetland edge The
Administrator will assist the landowner in the delineation
North Andover Heights (#242-642)
D Cygan of Wetlands Preservation and N Menino (general
contractor) appeared R Doucette and D Cygan provided an
overview The erosion controls failed in a heavy rain an silted
in a wetland Also no progress reports had been submitted and
the work had not been done in strict conformance with the
construction sequence The wetland replacement area has been
completed the site is now in conformance
OLD BUSINESS
Lot 18 Candlestick Road ( 242-575) - Partial Compliance
Ed Rauseo presented an As-Built and requested a Partial
Compliance The driveway shoulder is too close to the wetland
(81 ) Re-plant no-disturbance zone under an Enforcement Order
The NACC delegated authority to the Administrator to issue a
Partial Compliance upon planting

Jim Bourgoeis appeared and discussed the compliance issues at the
North Andover Business Park To be discussed further on
10/20/93
PUBLIC HEARINGS
Lot 1 Forest Street Extension - Determination
Joe Serwatka of Hancock Survey Inc presented plans for a single
family home and sewer line in the buffer zone Motion by K Foley
and A Manzi seconded to issue a Negative Determination with
erosion controls Vote was unanimous
Lot 145 Blue Ridge Road - Determination
Jim McDowell presented plans for a single family home in the
buffer zone Motion by K Foley to issue a Negative Determination
with erosion controls Vote 4-0-1 P Tariot abstained
Lot 1 (#585) Dale Street - Determination
C King presented plans for an addition to an existing home
Motion by P Tariot and seconded by A Manzi to issue a Negative
Determination with erosion controls if necessary Vote was
unanimous
Lot E-1 (#60) willow Street (#242-575) - Notice (Cont )
Jim Bourgeois T Neve Assoc presented revised plans for
repaving an existing industrial parking lot Discussion of catch
basins, drainage etc Motion by P Tariot and seconded by
J Leeman to continue to 10/20/93 Vote 4-0-1 A Manzi abstained

Lot 146 Blue Ridge Road (#242- ) - Notice
J McDowell presented plans for a single family home in the buffer
zone Motion by P Tariot and seconded by J Leeman to close the
public hearing and issue a decision within 21 days Vote was
unanimous
Lot 14 Lancaster Road (#242- ) - Notice
J McDowell and Al Manzi presented plans for the improvement of an
existing farm road The existing road is in a Bordering
Vegetated Wetland and is impassible due to wetness at certain
times of the year The project replaces the existing original
soils with crushed stone R Doucette stated that this was an
existing agricultural use not a new limited project A new
culvert should be installed also Abutter Jack MacElheny asked
about his land nearby Motion by P Tariot and seconded by
J Leeman to close the public hearing and issue a decision within
21 days Vote 3-0-1 A Manzi abstained

North Andover Estates (#242-642)
R Doucette and Jack Mallet discussed the ongoing mitigation
measures The site is in conformance but needs construction
maintenance
PUBLIC HEARINGS
Lots 4,35.36 & 42 North Andover Estates (#242- ) - Notice
Tom Frangois and Jack Mallett presented plans for four single
family homes in the buffer zone Bill Casale 111 Rea Street
has concerns about flooding on his land The driveways need to
be firmed up with stone Discussion of the slumping in the rear
of some lots John Nolan and R Doucette discussed allowing work
to continue tc stabilize all lots while the NACC is drafting the
Order of Conditions Motion by P Tariot and seconded by A Manzi
to close the public hearings and issue a decision within 21 days
VIOLATION
Coventry Estates (#242-324)
R Doucette gave an overview of the issues Sand and gravel have
filled up a catch basin and drainage outlet Silt has entered
the wetland Motion by G Reich and seconded by P Tariot to issue
an Enforcement Order to Shawmut Bank and seek bids to clean the
drainage system out

No show no action
Lot 28A South Bradford Road (#242-591) - Partial Compliance
R Doucette requested the issuance of a Partial Compliance
Motion by P Tariot and seconded by G Reich to issue a Partial
Compliance
NEW BUSINESS
Conservation Land - Discussion
R Doucette ga%e an overview New beaver activity has flooded
more land and a trail A portion of the land is now
inaccessible The Administrator would like the Commission to
decide between relocating the trail and trapping the beaver
Motion by A Manzi and seconded by G Reich to trap the beaver who
constructed the new pond Vote 2-1-1 P Tariot against and
J Leeman abstained
