HomeMy WebLinkAbout1993-10-20 Conservation Commission Minutes North Andover Conservation Commission October 20 1993 PRESENT George Reich John Leeman Robert Mansour Kevin Foley Paul Tariot Al Manzi Karen Nelson, Director Richard Doucette, Administrator MINUTES Motion by J Leeman and seconded by K Foley to adopt the minutes of October 6, 1993 VIOLATIONS El Hefni Atty Carl Croce appeared The remaining plants have been planted Rictard Kaminski has been retained to prepare an "As- Built" plan The boulders have not all been removed as their removal could cause a greater impact The plan should be submitted by the next meeting The boulders can be removed in the winter when the ground is frozen No bond has been posted OLD BUSINESS North Andover Business Park (#242-193) - Compliance J Bourgeois appeared to continue the discussion of the compliance for file #242-193 The additional 2 500 s f of wetland replication has been constructed Motion by P Tariot and seconded by 3 Leeman to grant a Compliance conditional upon inspection of the new wetland replication area by Administrator once it is planted Vote was unanimous Lot 5 Cranberry Lane (#242-596) - Partial Bond Release Ben Osgood J2 requested a partial bond release Motion by J Leeman and seconded by K Foley to reduce the bond to $1 000 00 Vote 5-0-1 P Tariot abstained NEW BUSINESS Bio-fence - Presentation Mark Howland Chief Biologist appeared and presented information regarding a new erosion control material NACC 10/20/93 Page 2 Meadowood II (#242-672) - Modification Steve Stapinski and Tom Laudani appeared to request a modification to remove or modify conditions numbers 13 and 15 There was much discussion as to the setbacks and wording of these two conditions Motion by G Reich and seconded by A Manzi to modify condition #15 as follows a change "adjacent" to "abutting" b allow work to go forward on all lots except #6 and #7 until the independent analysis is approved by the NACC Vote unanimous Motion by G Reich and seconded by K Foley to modify Condition #13 to permit temporary work within 10 ' zone for swale construction and to change 30 ' no-construction to 26 ' Vote unanimous Scott Circle (#242-542) - Partial Bond Release Cheryl Dickerson appeared to request a partial bond release R Doucette recommended release of $8, 000 Motion by P Tariot and seconded by K Foley to release $5 000 for lot 3 and $2 000 for roadway Vote unanimous Lot 23A Forest Street (#242-555) - Compliance Paul Tricket appeared R Doucette gave an overview Motion by G Reich and seconded by R Mansour to issue the Compliance Vote 5-0-1, P Tarlot PUBLIC HEARINGS Lot 148 Blue Ridge Road - Determination Jim McDowell presented plans for a single family home in the buffer zone Motion by P Tariot and seconded by K Foley to issue a Negative Determination with erosion controls Vote 5-0-1 A Manzi abstained #400 Great Pond Road - Determination Atty Bailey and Bernie Paquin represented the landowner to request a determination for the construction of a sewer ejector station, sewer line and three parking spaces in the buffer zone Motion by P Tariot and seconded by K Foley to issue a Negative Determination with erosion controls Vote 5-0-1 A Manzi abstained #500 Great Pond Road - Determination Jim Bourgeois presented plans for a drainage swale from the existing to the wetland Edward Neiberger abutter spoke Motion by P Tariot and seconded by K Foley to issue a Negative Determination with erosion controls Vote 5-0-1 R Mansour abstained NACC 10/20/93 Page 3 Lot E-1 (#60) Willow Street (#242-575) - Notice (Cont_) Jim Bourgeois appeared to continue the discussion of adding new pavement drainage swale and sedimentation basins to an existing industrial site Discussion of snow removal Motion by P Tariot and seconded by J Leeman to close the public hearing and issue a decision tonight Vote unanimous #18 Willow Street (#242.- ) - Notice R Hucksam and Curt Young represented Mr Mscisz Revised plan submitted showing the location of white pines and the edge of fill Motion by P Tariot and seconded by K Foley to close the public hearing and issue a decision within 21 days Motion by P Tariot and seconded by A Manzi to issue a new Enforcement Order allowing work on the restoration plan to begin immediately OLD BUSINESS (CONT ) Meadowood II (#242-268) - Partial Bond Release Curt Young requested a partial bond release Motion by K Foley and seconded bj R Mansour to release $10 000 more $5 000 is to be retained Vote 5-1-0 G Reich opposed NEW BUSINESS (CONT Personnel Issue. The Commission discussed the continued delay in re-classifying the Administrator' s position The Commission will send letter to Martha Larson requesting to be placed on the November 1 agenda DECISIONS Lot E-1 (#60) Willow Street Motion by K Fo_ey and seconded by A Manzi to issue decision as rendered Vote unanimous Lot 14 Lancaster Road Motion by P Tariot and seconded by K Foley to issue the decision as rendered Vote 5-0-1, A Manzi abstained Lot 146 Blue Ridge Road Motion by K Foley and G Reich to issue the decision as rendered Vote unanimous Lots 4.35,36.43 North Andover Estates Motion by P Tariot and J Leeman to issue the decision as rendered Vote unanimous NACC 10/20/93 Page 4 #18 Willow Street Motion by A Manzi and seconded by R Mansour to issue the decision as amended Vote unanimous Meeting ad3ourned at 10 30 p m George Reich Chairman
