MINUTES
Motion by R Villiard and seconded by J Leeman to adopt the
minutes of October 20 1993
OLD BUSINESS
#18 Willow Street (#242-676) - Modification
R Doucette prodded an overview Mr Mscisz asked to reduce the
bond Much discussion R Doucette recommended reducing the bond
to $500 Motion by J Leeman and seconded by G Reich to reduce
the bond to $500 as long as R Doucette oversees the work
Brooks School ,#242-655L - Bond Reduction
Frank Marino presented a progress report and requested a bond
release R Doucette recommended half the bond be released
Motion by P Tariot and seconded by R Milliard to release half the
bond Vote unanimous
NEW BUSINESS
Lot 1 (#t9) Holly Ridge Road (#242-597) - Compliance
Motion by P Tariot and seconded by J Leeman to grant the
Compliance Unanimous
VIOLATIONS
Phase II Sewer Line (#242-547)
R Doucette proiided an overview of siltation of streams flowing
into the Lake Discussion of appropriate action Discussion of
the possibility of issuing a ticket Motion by G Reich and
seconded by P Tariot to issue the ticket if R Doucette feels it
is necessary Vote 5-0-1 J Leeman abstained
Boxford Site Visit
R Doucette gave an overview of the violation and discussed his
memo of October 26 G Reich will contact the chair of the
Boxford Conser,.ation Commission

R Doucette provided an overview Scott Giles requested a Partial
Compliance for #242-461 and a full Compliance for #242-646
Motion by P Tariot and seconded by R Milliard to issue the
Compliances Vote unanimous

Discussion of ongoing application for a criminal complaint
Merrimack River Boat Ramp (#242-540) - Extension
Motion by G Reich and seconded by R Milliard to issue a extension
for one year Vote unanimous

R Doucette stated that an independent review has not been
submitted yet

R Doucette request a Partial Compliance from the subdivision
Order of Conditions Motion by P Tariot and seconded by
R Milliard to issue the Partial Compliance Vote unanimous

R Doucette and R Mansour gave an overview Motion by P Tariot
and seconded by R Mansour to issue a Compliance Vote unanimous
Cullen Forest Cutting Notice
Discussion of Compliance with the Bylaw R Doucette will contact
the landowner and request more detail
Rea Street - Discussion
Motion by G Reich and seconded by P Tariot to send a memo to the
Building Inspector to inform him that the NACC would like to be
involved in future permitting of the gravel pit
Oates Property/Town Farm Access - Discussion
K Foley left a message with the homeowner to discuss the no
trespassing signs and the gate
Route 114 Sunoco
R Doucette provided an overview of the diesel spill

1010 Johnson Street - Determination
R Cookson appeared and showed plans for drainage work done on his
property Discission of drainage and soil stabilization Motion
by P Tariot and seconded by R Milliard to issue a Negative
Determination with erosion controls and the planting of grass
Vote 5-0-1 Vo=e unanimous
Lot 2 Johnnycake Street - Notice
Ben Osgood Jr presented plans for a single family home with a
driveway wetland crossing K Foley questioned the 1 1
replication it's usually more P Tariot stated that there is no
compliance on the subdivision and no As-Built has been submitted
to the NACC He also stated that the applicant must re-notify
the abutters the legal notice was advertised incorrectly
B Osgood stated there has been an As-Built drawn and it shows
there was some additional filling of wetlands P Tariot stated
the applicant ras landlocked himself B Osgood stated he had a
permit to cross the wetland but it expired
R Milliard discussed the construction near the erosion controls
G Reich questioned the cumulative wetland filling B Osgood did
not know how much R Doucette will try to determine the
cumulative filling G Reich stated if there is no Compliance on
the subdivision. the Board should not issue any permits until the
subdivision OOC is complied with
R Doucette indicated that all of the flag numbers were off by
one The delineation needs some minor changes There was excess
filling for preāious subdivision some of the filling was done on
this lot Tterefore the construction on this lot is not
presently in ccmpliance with subdivision OOC Other access has
been attempted =o avoid crossing wetlands this was unsuccessful
Ken Brown voiced his concerns of delineation
Rich Lowe stated his concerns of flooding and wildlife
Muriel Brown as{ed what percentage of trees will remain
Mr Donaldson had some concerns with the septic system
Joanne Perry questioned the drainage calcs
Catherine Jennings asked if bonds can protect abutters
Motion by P Tariot and seconded by K Foley to continue the public
hearing until November 17
G Reich discussed the Compliance for the subdivision
B Osgood stated there will be a dispute if the NACC requires a
Compliance on the subdivision OOC
Vote was unanimous on the motion to continue

#1070 Osgood Street (#242-419) - Compliance
Jim Bourgeois presented plans for a restaurant G Reich
questioned lack of "No-construction" zone and almost no "No-
construction" zone J Bourgeois stated most of the site work was
completed under the previous (expired) file R Doucette stated
the work is too close to the wetland A site visit is needed
New drainage calcs are also needed
Motion by K Foley and seconded by G Reich to continue the public
hearing to 11/17

A Cormier requested that the bond be segment with the work
Discussion of construction sequence
Motion by R Mansour and seconded by K Foley to segment the bond
$25 000 will be required at this time No work will progress
past station 7+0±
