Compliances Jim Bourgoeis and R Doucette provided an overview Motion by R Mansour and R Milliard to issue all compliances NEW BUSINESS Sutton Pond Condominiums (#242-648) - Compliance Motion by P Tariot and R Mansour to issue the Certificate of Compliance Vote unanimous Osgood Mill Condominiums (#242-414 - Discussion John Nolan appeared R Doucette gave an overview The oil/gas traps were never installed although Tom Neve certified that the work was properly completed and a Certificate of Compliance was issued Motion by P Tariot and R Mansour to issue an Enforcement Order to require work be finished by January 5th meeting Vote unanimous North Andover Estates (#242-585) - Discussion Jack Mallett gave a progress report Recent rainstorm caused a failure of the erosion controls Various remedial measures were discussed Perforated riser pipe in the detention basin(s) extensive mulcaing R Doucette presented two violation notices and tickets which were issued yesterday, one to Toll Brothers and one to Elm Service Corp Al Manzi presented pictures which he took over a week ago which showed siltation prior to the recent rainstorm R Mansour stated that the pro3ect should be shutdown while all the necessary remediation is completed Motion by P Tariot to issue an Enforcement Order to cease all work by anyone on the site until the siltation issues are addressed A Manzi seconded and offered an amendment that the silted wetlands and %aterways be cleaned up prior to the restart and that the bond be increased to the original $60 000 (now $40 000) R Doucette wan=ed to know if all work means stopping all work NACC 12/1/93 Page 2 even interiors at buildings and lots outside the buffer zone Since the lots (even those outside the buffer zone) have contributed to the siltation J Leeman asked if the Toll Brother's bond could be increased P Tariot said yes, all work R Doucette stated it can be increased John Nolan stated shutting down work will slow completion and compliances Jack Mallett state work relating to stabilization should be allowed to continue A Manzi withdrew increased bonding amendment to the motion by P Tariot Vote on motion by A Manzi was unanimous K Foley motioned an amendment to exclude from the Cease and Desist Order any work directly relating to stabilization and an engineering plan should be developed to address the stabilization issues P Tariot seconded the amendment Vote unanimous The vote On P Tariot's motion was also unanimous Lot 30A Sugarcane Lane (#242-637) - Partial Compliance Jim Bourgeois appeared to request a Partial Compliance G Reich stated the applicant should replant first No Compliance issued I Lot 19A Jerad Place (#242-576) - Modification Jim Bourgeois appeared to request a modification to build a single driveway Motion by K Foley to accept plan dated 11/23/93 as a modification Vote unanimous Lot 6 Pine Ridge Road (#242-558) - Bond Release Ben Osgood appeared to request a full bond release Motion by P Tariot and seconded by to grant a compliance once a letter from a Professional Engineer is received stating that the property is in compliance with the Order of Conditions Vote unanimous Rocky Brook (#242-392) - Partial Bond Release No show, no action taken PUBLIC HEARINGS Clark Rd /Pencor - Determination (Cont M Lemasny presented plans showing a wetland delineation R Doucette discussed the flagging and the plant plots Discussion of bank definition and delineation Discussion of Determination of Applicability Motion by P Tariot and J Leeman to issue a Positive Determination accepting the delineation, except for flags #AA17 through #AA26 which shall be move 20 ' and to connect flag #BB26 to #BB30 Vote 6-0-1 G Reich abstained Lot 2 Johnnycake (#242-678) - Notice (Cont ) Ben Osgood Jr appeared and submitted a letter addressing concerns raised by the NACC at the last hearing 1 As-Built for subdivision was submitted NACC 12/1/93 Page 3 2 Total filling of wetland estimated at 63,900 s f 3 Excess filling for the entire subdivision - plans submitted Applicant agrees to remove excess fill on lots 14B 53 and 47 since they own these lots 4 Capacity of pipes under proposed driveway was addressed 5 Greater than 1 1 wetland replacement can be done 6 New wetland discovered an showed (somewhat) on the plan B Osgood requested a continuance of four weeks Motion by K Foley and seconded by P Tariot to continued the public hearing to January 1994 and that abutters be renotified Vote 6-0-_ R Mansour abstained #1070 Osgood Street (#242-679) - Notice (Cont ,1 Jim Bourgeois submitted new plans with a revised wetland line R Doucette discussed the wetland delineation G Reich discussed 0/14 no disturbance/no construction zones Motion by K Foley and seconded by R Milliard to close the public hearing and issue a decision with 21 days Vote 6-0-1, P Tariot abstained Al Manzi was no longer in attendance Lots 5,6, 12 1, 46 Salem St /Foxwood (#242- ) - Notice Steve Stapinski presented plans for a subdivision One wetland crossing with 2 850 s f of fill and 3 565 s f of replication The project includes 46 lots 5 of which are in the buffer zone All meet 50 ' no construction zone P Tarlot discussed -lot numbers -detail sheets for crossing still in progress -any wetland across Salem St I> -questioned different cn figure on pg 7 of the drainage analysis Answer due to soil types (ABC) R Milliard asked how do you get to the west side of property prior to crossing? Answer Molly Town Road K Foley had concerns with selling lots off after approvals R Doucette had concerns with erosion control He asked that a plan be submitted showing phasing of site work Abutters Mr Dombrowski had concerns about his pond drying up Mr Cyr questioned the 30' retaining wall He also stated the drainage plan can't work He also had concerns about flooding near Salem Street Steve Stapinski stated there is a 0% increase in the post development rate of runoff from both outlets Mr St Cyr had drainage concerns also Mr Bringert had concerns with drainage and who will maintain the swale Motion by K Foley and seconded by G Reich to continue the public hearing to December 15 %ote unanimous NACC 12/l/93 Page 4 NEW BUSINESS (CONT Stevens Crossing (#242-649) - Partial Bond Release Tom Laudani appeared to request a Partial Bond Release of $9, 500 Motion by R Milliard and seconded by R Mansour to grant the partial release Vote unanimous DECISIONS Lot 38 Lancaster Road Motion by R Mansour and seconded by G Reich to issue the decision as written Vote unanimous Lot 44 Lancaster Road Motion by P Tariot and seconded by K Foley to issue the decision as written Vote unanimous The meeting ad3ourned at 11 50 p m George Reich Chairman I I
