MINUTES
Motion by R.Milliard and seconded by K.Foley to adopt the minutes
of December 1, 1993 .
OLD BUSINESS
#940 Great Pond Road (1242-656) - Discussion
Atty. Croce submitted a letter from himself and a plan from
Richard Kaminski showing wetlands and other site features.
Discussion of boulders to be removed and the posting of the bond.
North Andover Estates (#242-585, 600,675) - Discussion
Jack Mallett and John Nolan, Phil Christiansen, Phil Catone and
Joe O'Brien appeared. R.Doucette provided an overview of the
stabilization process. Jack Mallett discussed the three page
addendum to the Enforcement Order. P.Catone spoke of site work.
P.Christiansen spoke about detention/retention basin and riser
pipe. A.Manzi questioned P.Christiansen about springs, hay bales
need to be changed/maintained as needed, sod on lot 10/11 is
sliding, eros--on/siltation on old access road. R.Doucette
discussed siltation in front of Jefferson Office Park and
utilities. P.Tariot asked about Toll Brothers/MA Limited Land
Corp. K.Foley asked about an overall plan from a Professional
Engineer. G.Reich discussed the intention to record the
Enforcement Orders against all property not occupied. A.Manzi
stated lot 10 needs more stabilization prior to an occupancy
Permit. G.Reich stated the whole site needs more stabilization
prior to any Occupancy Permits. P.Tariot stated Toll Brothers
lack of attendance is not helpful in the process of lifting the
Enforcement Order. J.Nolan spoke about signing the occupancy
Permits and lifting the Enforcement Orders on lots outside the
buffer zone. The Enforcement Order will remain in effect.

R Doucette spoke for the applicant and requested a Partial
Compliance from the subdivision Order of Conditions Motion by
P Tariot and seconded by K Foley to issue a Partial Compliance
Vote unanimous
Lot 25 (#42) Tanglewood Lane (#242-657) - Partial Bond Release
R Doucette spoke for the applicant and requested a Partial Bond
Release R Doucette requested the bond release Motion by
R Mansour and seconded by P Tariot to release $2, 000 Vote
unanimous
Rocky Brook (#242-392) - Partial Bond Release
Peter Breen requested a Partial Bond Release All roadwork is
done Work on lots needs additional filing R Doucette
requested a release Motion by J Leeman and seconded by P Tariot

Revised plan submitted as required Motion by P Tariot and
seconded by R Milliard to close and issue the decision within 21

Lots 5.6,12.46 Salem St IFoxwood - Notice (Cont
Les Godin submitted revised plans showing new swale on lots 47-
49 Plan also shows an added bench terrace to intercept runoff
Soil test pits have also been done The soils are
clay/sand/loam/gravel near the bottom and sandy loam above
better than anticipated P Tariot stated his concerns about
lowering peak rate of runoff by 30- and drying up wetland along
Salem St Tom Laudani spoke about meeting with the Dept of
Environmental Management The drainage system near Molly Towne
Road will be slightly changed Table this temporarily Return
later in the evening

Bond seizure discussion Motion by K Foley and seconded by
R Milliard to continue to January 5 Vote 6-0-1, P Tariot

Scott Giles submitted plans for a single family home close to the
wetland Steve D'Urso flagged the wetland R Doucette stated
the delineation needs to be reviewed The transition zone is
very gradual and poorly defined Waiver request is needed
R Doucette- indicated that the work is too close to the wetland
Seek ZBA side setback variance and discuss lot line change with
the abutter Motion by K Foley and seconded by P Tariot to
continue to January 15 Vote unanimous

R Doucette discussed the alteration of a stream bank while the
perc tests were done Motion by P Tariot and seconded by A Manzi
to issue an Enforcement Order to restore the stream bank before
all other work Vote 6-1, R Milliard against
Lot B Great Pond Road (#242-587) - Modification

Lot 6C (#80) Patton Lane (#242-207) - Partial Compliance
Motion by P Tariot and seconded by R Milliard to issue a Partial
Compliance Vote 6-1, R Mansour against
Lot 6 Bruin Hill Road (#242-448) - Partial Bond Release
Phil Christiansen and Jim Grifoni appeared to request a Partial
Compliance P Doucette questioned the detention pond partially
on lot 6 no grass, silt fence/wetland location and house within
50' of the wetland Phil Christiansen submitted an As-Built
The house was built to the Septic Plan which pushed the house
further back Motion by P Tariot and seconded by R Milliard to
grant a limited partial Compliance for the house and driveway
after the posting of a $4 000 bond and proof of recorded drainage
easement Vote 6-1 G Reich against

Lot 7A Candlestick Road (#242-574) - Partial Bond Release
R Doucette recommended release of $3000 when accumulated silt is
removed from erosion controls and slopes are mulched Motion by
P Tariot and seconded by R Milliard to issue the Partial Bond
Release under the stated conditions Vote unanimous
Lot 15 Carriage Chase Road (#242-627) - Discussion
H Speicher represented the Wxllners and submitted a revised plan
R Doucette gave an overview of the appeal and litigation The
revised plan shows 15/32 no-distance/no-construction zones The
original OOC required 25/32 The landowner will need a setback
variance to move the house closer to the street Discussion of
deed restriction G Reich polled the Commission with regard to
the no-construction zone Discussion of removing the sun
room/lap pool and therefore meeting the 25 ' no-disturbance zone
Motion by G Reich and seconded by K Foley to modify the OOC to
accept this as a minor modification for the purposes of a
settlement
Motion by R Mansour and seconded by R Milliard to amend to
require a 20 ' no construction zone Vote on amendment 5-1,
P Tariot opposed
Motion by P Tariot and seconded by K Foley to amend to extend the
wall by 15 ' along the 20 ' no-construction line
