HomeMy WebLinkAbout1994-01-19 Conservation Commission Minutes NACC MINUTES JANUARY 19, 1994 PRESENT George Reich Paul Tariot John Leeman Robert Mansour Al Manzi Kevin Foley Richard Milliard Richard Doucette, Administrator MINUTES Motion by R Milliard and second by J Leeman to adopt the minutes of January 5 1994 NEW BUSINESS Whippoorwill Estates (#242-548) - Extension Cheryl Dickerson requested an extension and provided a status report Motion by R Milliard and second by J Leeman to extend the OOC for one year from the date of expiration OLD BUSINESS #940 Great Pond Road ( 242-532) - Compliance R Doucette informed the Commission that the court hearing has been further continued to April The boulders have not been removed The bond has not been posted North Andover Estates (#242-585,600,675) - Update R Doucette gave an overview Wait until filter berm is done until signing any Occupancy Permits or allowing any new work as was voted at the last meeting Lot 15 Carriage Chase (#242-627) - Modification Motion by R Milliard and seconded by A Manzi to accept the revised plan dated 12/28/93 NEW BUSINESS (Cont Policies Discussion of draft policies should they be regulations or policies Decision to make 94-1 3 and 94-2 3 regulations Lot 25 Great Pond Road (#242-532) - Compliance The applicant appeared and requested a Compliance on his house R Doucette recommended that the Compliance be granted upon final inspection by the Administrator with regard to the monitoring well NACC 1/19/94 Page 2 North Andover Hills (#242-563) - Compliance Joe Cushing and Richard Kaminski appeared to request a Partial Compliance An As-Built plan was submitted and reviewed The building is done but the wetland replication must go through the summer Discussion of monitoring as required by one of the four modifications Motion by R Mansour and second by K Foley to issue the Partial Compliance subject to receipt of satisfactory monitoring reports The wetland replications is excluded from the Partial Compliance Vote 5-2 G Reich and P Tariot opposed Policies (Cont. ) Motion by A Manzi and second by K Foley to adopt 94-1 and 94-3 as policies (except 94-1 3 and 94-2 3 which will be adopted as regulations following a public hearing) Vote 6-1 R Milliard opposed #940 Great Pond Road (#242-532) - Compliance Motion by A Manzi and second by J Leeman to cease all work in the buffer zone until the bond is posted Vote 4-3 G Reich, R Milliard and P Tariot opposed Rea Construction - Discussion Letters from R Doucette to Ken Rea and responses from Ralph Joyce and Ken Rea regarding siltation of a stream A Manzi spoke for the Rea's, who could not attend due to a death in the family The new siltation control measures will be inspected in the Spring PUBLIC HEARINGS Lot 2 Johnnycake (#242-678) - Notice R Doucette presented a draft memo for the staff Motion by R Milliard and second by R Mansour to issue the memo DECISIONS Lots 5.6,,12.46 Salem St /Foxwood Discussion of bond Motion by K Foley and second by R Milliard to adopt the decision with a requirement of an Environmental Monitor and that the NACC be notified of any transfers of title G Reich motioned P Tariot seconded an amendment to raise the bond to $40 000 00 Vote 3-4, G Reich A Manzi and P Tariot in favor Amendment failed Vote on main motion to adopt decision passed unanimously i NACC 1/19/94 Page 3 Lot A Marbleridge Road Discussion on setback from wetland Motion by A Manzi and second by K Foley to adopt the decision as written Vote 4-3, G Reich, R Milliard and P Tariot opposed NEW BUSINESS (Cont Wetland Filing Fees Discussion of Town Manager's oversight of Wetland Filing Fee account Motion by R Milliard and second by P Tariot send the request for use of Wetland Filing Fees for tuition, to the Town Manager Motion failed Meeting ad]ourned at 10 00 p m George Reich, Chairman i
