MINUTES
Motion by R Mansour and second by A Manzi to adopt the minutes of
January 2 1994
OLD BUSINESS
Lyons Way (#242-557) - Appeals Court Decision
R Doucette provided an update The Conservation Commission has
prevailed in Appeals Court The local bylaw and the conditions
imposed by it ,were found to be valid The 25/50 buffer zone was
upheld This is a state-wide precedent
Lot 1 Dale Street (#242-543) - Discussion
R Doucette provided an update The DEP appeal will likely wait
until the Superior Court decides on the bylaw appeal
Campbell Fores= (#242-564) - Discussion
R Doucette provided an update Counsel is meeting with the
plaintiff today at a pre-hearing conference In light of the
Lyons Way decision, there may be an opportunity to settle

Lot 2A Equestrian Drive (#242-257 & 309) - Partial Compliance
Jim Bourgeois appeared with the current landowner to request a
Partial Compliance R Doucette stated that the subdivision OOC
(#242-257) is also part of the individual file (#242-309) The
subdivision file requires the submittal of an As-Built and the
recording of a conservation restriction on all wetlands This
work has not oeen done G Reich requested the recording of an
individual conservation restriction for this lot
Motion by R Mansour and second A Manzi to grant the P Compliance
contingent upon the receipt of proof of recording of a
conservation restriction and the submittal of an acceptable As-
Built Unanimous vote
Brook Farm (#242-452) - Extension
Motion by G Reich and second by P Tariot to extend for one year
Vote unanimous

Lot 30A Sugarcane Lane (#242-637) - Partial Bond Release
Bob Janusz appeared to request a partial bond release of $2, 000
for this lot A Partial Compliance was issued on 12/1/93
Motion by R Mansour and second by A Manzi to allow the partial
release Vote unanimous
Lot 27 Laconia Circle (#242-257 & #242-288) - Partial Compliance
Jim Bourgeois requested a continuance to the next meeting An
As-Built is also needed
Lot 64A Haymeadow (NACC #2) - Compliance
Pat Seekamp appeared to request a Compliance for this lot
Discussion of Compliance Motion by A Manzi and second by
R Mansour to issue the Certificate of Compliance contingent upon
receipt of proof of recording the OOC and a re-issued letter from
the Professional Engineer certifying compliance with file NACC
#2 Vote unanimous
Al Manzi no longer in attendance
Lot 32A Vest Way (#242-609) - Modification
Les Godin appeared to request a Modification He presented new
plans dated 2/25/94 Motion by P Tariot and second by R Mansour
to issue the Modification Vote unanimous
Lot 15 Carriage Chase
Mr Willner appeared and briefly spoke of his ongoing Special
Permit request

PUBLIC HEARINGS
Lot 61 & 108 Great Pond Road (#242-687) Notice (Cont
Jim Bourgeois submitted plans for his lot which was permitted in
the past The applicant has chosen to move the house farther
from the Lake and that is the sub3ect of this filing Discussion
of building near wetlands in the Lake Cochichewick watershed
Work is within 15 ' of the wetlands The applicant requested an
extension of two weeks Motion by G Reich and second by
R Mansour to continue to 3/16 Vote R Mansour, P Tariot and
J Leeman in favor G Reich and R Milliard opposed Motion

123 Eoxhill Road - Discussion
The Commission discussed the variance request before the ZBA and
expressed concarn of the possible creation of a sub-standard lot
in the watershed.
Lot 1, (#7) Libertr Street (#242-604) - Compliance
R.Doucette spoke on behalf of the applicant. Motion by P.Tariot
and second by R.Milliard to grant the compliance contingent upon
re-inspection by R.Doucette after the thaw.
lownMeetinct Warrant Articles - Discussion
The conservation commission has no articles. Individual members
may submit citizen petitions.
Riverways Grant
R.Doucette informed the commission that he has received the
$2 , 000 grant from the Division of Fish & Wildlife.
The meeting adjourned at 8: 50 p.m.
