HomeMy WebLinkAbout1994-03-16 Conservation Commission Minutes NACC MINUTES MARCH 16 1994 PRESENT George Reich Al Manzi Kevin Foley Paul Tariot Richard Milliard Richard Doucette, Administrator MINUTES Motion by A Manzi and second by R Milliard to adopt the minutes of March 2 1994 OLD BUSINESS North Andover Estates - Update Paul Webber, Toll Brothers, came and introduced himself to the Commission The condition of the subdivision with regard to erosion control was discussed A Manzi expressed concerns about the past performance of Toll Brothers and others Mazurenko Farm Agricultural License - .Annual Report R Doucette submitted the annual report on the Mazurenko Farm Agricultural License Richard Rogers and George Barker appeared and discussed Yheir farming practices R Doucette discussed the issue of haying impacts on the bobolink population More study will be done on this issue Board of Health Variances G Reich discussed the Conservation Commission's previous vote to sue the Board of Health and asked the Commission to reconsider Motion by G Reich and second by K Foley to rescind the motion to sue the Board of Health Vote 2-3 Motion failed NEW BUSINESS Draft Erosion Control Bylaw - Discussion Discussion of draft Discussion of the need for this Bylaw and the possibilitz of revising existing Earth Removal Section of the zoning bylaw instead Motion by P Tariot and second by A Manzi to table and not submit study and possibly re-submit at the Town Meeting Vote unanimous PUBLIC HEARINGS Sutton Pond Condos - RDA Carol Veratti represented the applicant Motion by P Tariot and second by K Foley to close the public hearing and issue a NACC 3/16/94 Page 2 Negative Determination with erosion control as needed Vote unanimous Lot 4 Forest Street - RDA C White submitted plans for a single family home just outside the buffer zone R Doucette amended approval and indicated that the delineation may be 10' of rear flag #110 Motion by P Tariot and second by R Milliard to issue a Negative Determination Vote unanimous Lot 2OA Laconia Circle (4242-686) - Notice (Cont Tom Neve presented plans for a single family home which will fill approximately 500 s f of wetlands This project was previously permitted but the permit expired Mr Pellegrini, landowner, spoke on the reasons for not acting on his permits in 1985 K Foley engaged in a discussion of a potential setback variance from the street P Tariot discussed the septic system RPD- delineation is off between flags A3A and A6A, would not receive approval Need to see a real house Abutter Irene McCarthy expressed concerns regarding increased runoff Motion by P Taraot and second by A Manzi to continue to April 20 -real house (narrower) -re-delineate -revise septic -to ZBA, seek 10 ' front setback variance -look at 1 5 to 1 wetland replication ratio -roof drains should be directed into dry wells to minimize excess runoff Lot 61/108 Great Pond Road (#242-687) - Notice (Cont Tom Neve presented plans for a single family home in the watershed This is the same plan that Jim Bourgeois presented at our last meeting John Leeman spoke This plan has more paving Motion by P Tarxot and second by R Milliard to close the public hearing and issue a decision within 21 days Vote unanimous Al Manzi no longer in attendance NEW BUSINESS Draft Power Boat Bylaw Motion by G Reich and second by P Tariot to submit a warrant article reading "to see if the Town will vote to prohibit the use of internal combustion watercraft on Lake Cochichewick This prohibition does not apply to public watercraft for emergency or maintenance purooses " dote unanimous 1 NACC 3/16/94 Page 3 Lot 23 Fox Hill Road Discussion of memo written by Richard Doucette and Kathleen Bradley-Colwell to the ZBA and the removal of that memo from the ZBA files by the Town Manager DECISIONS Lot 61/108 Great Pond Road Motion by P Tarlot and second by R Milliard to deny Vote 3-1 The meeting ad]ourned at 10 00 p m George Reich Chairman
