MINUTES
Motion by P Tariot and seconded by K Foley to adopt the revised
minutes of March 16 and April 20, 1994 Passed 4-0
VIOLATIONS
Sandra Lane
Steve Gilboard appeared R Doucette provided an overview of a
violation, leaves have been dumped adjacent to the wetland
R Doucette recommended removal of leaves within 10 ' of the
wetlands Conservation Administrator will assist the landowner
in delineating at 10 ' zone where leaves will be removed Motion
by P Tariot and seconded by K Foley to remove leaves from 10 '
buffer Vote 4-0-1 R Mansour abstained
Andover Sportsman's Club
Steve Erickson appeared to discuss a wetland violation discovered
in Harold Parker State Forest Many yards of fill have been
placed in the bordering vegetated wetland The Andover
Sportsman's Club will file a Notice of Intent by June 1
Discussion of whether or not to issue a Violation Notice Motion
by G Reich and seconded by P Tariot to issue a Violation Notice
Vote 4-2 J Lynch and K Foley against
Sargent School
R Doucette gave an overview of the violation sand/silt in the
stream off site brush in wetland more erosion controls
Foxwood
R Doucette gave an overview Steve Stapinski and Tom Laudani
appeared S Stapinski gave a progress report and discussed
erosion controls T Laudani also spoke New measures are being
installed to filter the fine soil particles
OLD BUSINESS
Bake In Joy (4242-647) - Modification
Jim Bourgoeis appeared to request a modification to the parking
and freezer expansion which was approved last year Discussion
of truck traffic P Tariot had concerns regarding possible

future expansion of the pavement at the northwest corner of the
freezer Motion by K Foley and seconded by A Manzi to issue a
modification to accept the revised plan
Merrimack River Source to the Sea - Discussion
Mike Goriansky appeared to discuss the MRWC's Canoe expedition
along the full length of the river
Osgood Condominiums (#242-380) - Compliance
R Doucette gave an overview Motion by P Tariot and seconded by
K Foley to issue a Compliance upon receipt of a letter from a
professional engineer
Great Pond Rd /Stevens St Land - Discussion
Motion by P Tariot and seconded by K Foley to accept land
donation Unanimous vote
PUBLIC HEARINGS
Lot ILA Sharpners Pond Road RDA
Motion by P Tariot and seconded by G Reich to issue a positive
determination if no letter is received requesting an extension
Forest St /Sharpners Pond Road - (#242- ) - Notice
C White submitted revised plans Grading has been tightened up
on lots 6 and 8 Input received from National Heritage Program
Motion by P Tariot and seconded by A Manzi to close the public
hearing and issue a decision within 21 days Vote unanimous
_Lots 20A Laconia Circle (1242-686) - Notice
J Bourgoeis presented revised plans showing less front yard
setback narrower house and a 9 ' setback from the house to the
wetland The Commission expressed concerns that a "for sale"
sign is on the lot but the applicant stated this house was to be
constructed as his primary residence There were also concerns
as to the poss_bility of building any house of that size (60X24)
and keeping the construction activity outside the wetland
R Doucette still opposes the project and recommended closing the
public hearing Abutters Bob Lavoie represented abutters
(Nichols) and submitted copies of a recent memo from the Sandra
Starr Health Administrator to Bob Nicetta Building Inspector
opposing the Board of Health variance Karen Nichols also spoke
Motion by P Tariot and seconded by J Lynch to close the public
hearings and issue a decision within 21 days Vote unanimous
Christmas Tree Estates Detention Pond (#242- ) - Notice
Applicant failed to properly notify the abutters at the last
hearing Motion by P Tariot and seconded by K Foley to reopen
the public hearing and continue to May 18 Vote unanimous

Applicant failed to properly notify the abutters at the last
hearing Motion by P Tariot and seconded by K Foley to reopen
the public hearing and continue to May 18 R Doucette
recommended avoiding pine trees near the detention basin
Seven Oaks Subdivision (#242- ) - Notice
Revised plans submitted by Phil Christiansen Revisions were
requested at the April 20 meeting have been done Motion by
P Tariot and seconded by K Foley to continue to May 18 Vote
unanimous
Heritage Estates (#242-589) - Notice
John Soucy of the Merrimack Engineering presented the site plans
once again and submitted the cut and fill sheet J Lynch asked
about soils Mark Jacobs presented results of soils analysis
(see 5/9/94 report) Observed holes only went about half as deep
as the cuts on the site plan P Tariot asked about soils
analysis The site-specialist analysis does not corroborate the
SCS soil survey The report arrived only yesterday A Manzi
discussed filtering fine soil particles during construction
R Doucette stated the site-specific investigation has only been
done on this site We don't know what information a site
specific investigation would yield on those other sites This
site could be as erodible as those other sites D Walsh stated
there is not a lot of earth to move on this site (30 000 yards)
R Doucette disagreed R Mansour asked if the houses were real
houses or "envelops" L Getty responded P Tariot and J Leeman
moved to continue to 5/18 for 1 additional soil tests and 2
covenant language 3 a new 1"=100 ' scale plan Vote unanimous
Wetland Regulations
R Doucette presented revisions to regulations Discussion of
vernal pools Motion by P Tariot and seconded by K Foley to
continue to June 1
OLD BUSINESS
Lot 7 & 8 Rocky Brook and Lot 22 Wintergreen
R Doucette recommended the issuance of a Compliance
Motion by P Tariot and seconded by R Mansour to issue the
Compliance Passed unanimously
