HomeMy WebLinkAbout1994-05-18 Conservation Commission Minutes NACC MINUTES MAY 18, 1994 PRESENT: George Reich Joseph Lynch Paul Tariot Kevin Foley Al Manzi, Jr. Deborah Feltovic Richard Doucette, Administrator MINUTES Motion by P.Tariot and seconded by K.Foley to adopt the minutes of 5/11/94 . OLD BUSINESS Gt. Pend Rd. 4j Stevens St. - Donation of Land R.Doucette represented this donation of land. It is not in the Lake Cochichewick Watershed. No motion for re-consideration. The Commission will still accept the donation. NEW BUSINESS Fox Mill Great Pond Road Ken Crouch appeared (as an individual) to propose the acquisition of a 3/4 acre parcel of land. R.Doucette recommended visiting the site prior to the next meeting. P.Tariot expressed concerns about using such a large portion of the conservation for such a small parcel, particularly considering the potential need for these funds elsewhere in the watershed. Also, P.Tariot has concerns about using funds for such purchases to "bail out" a landowner from a bad land deal . K. Foley and G.Reich also spoke. Massachusetts Electric John Vartaniar. of Mass. Electric presented a proposal to install a new electric line and transformer. Frank Marino also spoke and presented plans. R. Doucette recommended allowing the work with no permits. Motion by P.Tariot and seconded by J.Lynch to consider this work exempt. Vote unanimous. #280 Salem Street (#242-155) - Partial Compliance Motion by P.Tariot and seconded by K.Foley to grant a Partial Compliance. Vote 5-0-1, G.Reich abstained. streamlining Policy Statements - Discussion The commission reviewed the draft policy statement and provided input to Ann Marie Tucciarone. Elections Chairman G.Reich, Vice-Chair K.Foley. Motion by P.Tariot and seconded by A.Manzi to adopt the slate. Vote unanimous. NACC 5/19/94 Page 2 PUBLIC HEARINGS #1063 Salem Street - Determination Gene Willis appeared to present plans for a single family home in the buffer zone Motion by P Tariot and seconded by A Manzi to issue a Negative Determination with erosion controls Abutter Robert Holleran spoke and wanted to inform the Commission that the land was used as a dump G Willis will have a dumpster on site Motion by P Tariot seconded by A Manzi to issue a Negative Determination with erosion controls Motion passed unanimously White Birch II Det Pond (#242- ) - Notice (Cont ) Motion by P Tariot and seconded by K Foley to close the public hearing an issue a decision within 21 days Vote unanimous Seven Oaks Subdivison (#242- ) - Notice (Cont ) Motion by P Tariot and seconded by K Foley to close the public hearing and issue a decision within 21 days Vote unanimous Heritage Estates (#242-589) - Notice (Cont ) Submitted new plans with house locations on two lots (lots 1&2) within 50 ' of a wetland Submitted new 1"=1001 scale plan Submitted additional soil data dated 5/12/94 and cover letter dated 5/18/94 Woodbridge/Paxton soils on high elevations Sutton series on lower elevations M Jacobs discussed the new soils data J Lynch spoke about the soils data R Doucette stated that a Special Permit is still needed P Tariot discussed seeps and erosion K Foley addressed setbacks A Manzi asked about soil/erosion control Motion by P Tariot and seconded by A Manzi to close and issue a decision within 21 days of the application to the Planning Board for a Special Permit Vote unanimous Lot 10A Pine Ridge Road (#242- ) - Notice (Cont 1 Ben Osgood Jr presented plans for a single family home in the buffer zone R Doucette questioned the role of the Professional Engineer who stamped the plan Also, additional information is required on the Notice of Intent The wetland line is accurate J Lynch asked about steep slopes and riprap G Reich mentioned the closeness of the work to the bordering vegetated wetland It is less than 10 ' Abutter, J Leeman asked about moving the driveway T Leonardy asked about the driveway also S Clerk asked about increased flow Motion by P Tariot and seconded K Foley to close the public hearing and issue a decision within 21 days Vote unanimous Lot 2 Blue Ridge Road (#242- ) - Notice (Cont-I Phil Christiansen and Jim Grifoni presented plans for a single family home in the buffer zone with a driveway crossing the wetland R Doucette suggested a "limit of work" line and erosion NACC 5/18/94 Page controls should go along the contours, not downslope. He also asked that more detail (vegetation, construction sequence) be submitted on the Wetland Replication Area. G.Reich stated the Wetland Replication Area should be 2: 1 not 1: 1. Abutter, G,Leach asked about t'ne location of the house, the land is very wet. Motion by P.Tariot and seconded by K.Foley to continue to June 1. Vote unanimous. A.Manzi no long present. tl.an l ions R.Doucette presented revisions to North Andover Wetland Regs. Discussion of vernal pools. "Vernal pools"' will be removed from the Definitions section and added to the Jurisdiction Section. Motion by P.Tariot and seconded by K.Foley to adopt this revision to the North Andover Wetland Regs. Vote unanimous. NEW BUSINESS Lots 72 380 Bear Rill Road 242-158 -- Partial. Compliance Motion by P.Tariot and seconded by K.Foley to issue a. Partial Compliance. Vote unanimous. Grant A lications Comm. of MA - Discussion LWCF/Boat Ramp Motion by P.Tariot and seconded by K.Foley for the chair to send a letter to the. Town Manager indicating that the Conservation Administrator has identified a 50 funding for the boat ramp. The Commission seeks direction from the Town Manager as to whether this would be an effective use of the Conservation Administrator's time. Self-Help Program R.Doucette requested authori; tion to utilize the Conservation Fund for apprisals to purchase conservation land. The Commission. declined. Motion by P.Tariot and seconded by K.Foley utilize the Wetland Filing Fees for appraisals for two parcels adjacent to the Manzurenko parcel. R.Doucette stated that this would not be acceptable to the Town Accountant since it was not the appropriate account to use for that purpose. Motion passed. DECISIONS White Birch .Foley presented the draft decision. Motion by P.Tariot and seconded by C.Reich to issue the decision as amended. Vote unanimous. NACC 5/18/94 Page 4 Christmas Tree G Reich presented the draft decisions Motion by P Tariot and seconded by K Foley to issue the decision as amended Vote unanimous Forest St fSharpners Pond Road Motion by P Tariot and seconded by K Foley to issue the decision as amended Vote unanimous Lot 1A Sharpners Pond Road Motion by P Tariot and seconded by G Reich to continue to June 1 unless a new request for an extension is submitted If no request is submitted a Positive Determination will be issued Vote unanimous NEW DECISIONS -P Tariot will do Lot 20A Laconia -K Foley will do Lot 10A Pine Ridge Road -A Manzi will do Seven Oaks DELIBERATIONS The Commission discussed Heritage Estates R Doucette recommended a denial for the following reasons - construction of 2 homes within 50 ' of a tributary to the water supply will degrade water quality Deny the waiver - working on steep slopes in areas of fine erodible soils and seeps will cause siltation of the wetland - excessive filling, grading, excavation on an unrealistic timetable adjacent to a tributary to the water supply will degrade water quality - long term impacts of additional lawn areas, draining directly off steep slopes into a tributary to the water supply, will degrade water quality The Commission did not support this recommendation SITE VISITS Blue Ridge Road Extension Thursday May 26 at 6 30 p m The meeting adjourned at 11 00 p m George Reich Chairman
