Motion by G Reich and seconded by K Foley to adopt the minutes of
June 1, 1994
NEW BUSINESS
Salem Forest IV - Discussion of Driveway Crossincis
J Serwatka and George Farr appeared to discuss the potential for
two wetland crossings on a proposed subdivision, one crossing
would be needed to access two additional lots R Doucette is
opposed to this second crossing Two commission members are
opposed one is supportive and three have no opinion at this
time
Gift of Stevens Land
R Doucette discussed the proposed gift of land Is the NACC
interested in this "gift" if it is not a free "gifti7 The NACC
is not interested unless it is an outright gift
Lyons Way
SJC decision on Lyons Way presented by R Doucette The SJC has
upheld the lower court's ruling upholding the NACC's decision
New Employee
Bob Leyland's replacement will soon be hired R Doucette will be
reviewing the resumes to determine if a qualified applicant would
be interested in an internship
Paddle-a-thon
R Doucette discussed the AWA Paddle-a-thon G Reich $20, J Lynch
$20, Al Manzi $20, B Varoutsos $20 K Foley $5 P Tariot $5

Motion by P Tariot and seconded by A Manzi to issue the decision
as written Vote unanimous

R.Doucette recommended issuance of a Partial Compliance. motion
by A.Manzi and seconded by K.Foley to issue a Partial Compliance.
Vote unanimous.
PUBLIC HEARINGS
Lot 2 j_ohgn_yqak!g - Notice
Motion by P.Tariot and seconded by J.Lynch to close the public
hearing and issue a decision within 21 days. Unanimous vote.
#684 Salem Street - Determination
Jim Bourgoeis and the Augeri 's presented plans for an addition.
Discussion of drain which was reconstructed last year without
permits. Motion by P.Tariot and seconded by K.Foley to issue a
negative Determination with erosion controls and to shorten the
drain. Vote unanimous.
#855 Winter Street - Determination
Representative of Marchionda & Associates and Carr Research Labs
presented a wetland determination. Discussion of the hillside
wetland. Abutters, Mr. Vallia and Mr. Parker asked about the
wetland determination. Motion by P.Tariot and seconded by
K.Foley to issue a Positive Determination and exclude larger
wetland at the base of the hill from this determination. Vote
unanimous.
#39 HayLpeadow Road - Determination
Mr. Reidel appeared to present plans for an addition. Motion by
K. Foley and seconded by P.Tariot to issue a Negative
Determination with erosion controls. Vote unanimous.
Lot 4 Sharpners Pond Road - Determination
Joe Barbagallo presented plans for a single family home. A
vernal pool (perhaps a pond under the Bylaw) exists on the
property. What is the area of flooding? Motion by P.Tariot and
seconded by K.Foley to continue the public hearing to July 6.
Unanimous vote.
A.Manzi no longer present.
Lot 6 Turppike - Determination
Continued to July 6 because the abutters were not notified.
#525 Turn ike - Notice (Cont. )
The Commission reviewed the correspondence relating to drainage.
Scott Cote of Merrimack College and John Walker of CDW appeared.

Mr Cote requested a continuance until Merrimack College has a
chance to review the CDW response to Merrimack College's letter
Discussion of independent review Mr Kennedy appeared and NACC
discussed the third party review He would like this to begin
immediately Motion by P Tariot and seconded by K Foley to
request the Director to hire a third party Vote unanimous
Discussion of bids Motion by P Tariot and seconded by G Reich
that in the event that an agreement is reached among the parties
to resolve this matter prior to 4 00 p m Friday a bid will not
be awarded Vote 4-1, J Lynch opposed Motion by P Tariot and
seconded by K Foley to continue the public hearing to July 6
Vote unanimous
Meadowood III (#242-700) - Notice (Cont
Site visit report P Tariot discussed the location of two houses
located in the rear pro3ection of upland the linking of
Meadowood III with Meadowood IV and the delineation Discussion
of connecting Meadowood III and Meadowood IV Motion by P Tariot
and seconded by J Lynch to write a letter to the Planning Board
opposing the connection R Doucette expressed concerns about the
delineation and the proximity of work to wetlands Motion by
P Tariot and seconded by J Lynch to continue the public hearing
to July 6 Vote unanimous
Lots 1-5 Great Pond/Marbleridge Rd (#242-696) Notice (Cont
Steve Stapinski and Tom Laudani appeared and presented revised
plans dated June 12 Changes moved two houses, one wetland
area expanded and riser pipe detail added R Doucette indicated
that the Normandeau document was not received Also What will
be the impacts of lawn? Restrict lawn area and lawn care
R Doucette recommended to continue the public hearing to July 6
to review Normandeau report and determine methods to minimize the
impacts of lawns on the Lake Motion by P Tariot and seconded by
B Varoutsos to continue to July 6 Vote unanimous
Lot 24 Lacy Street (#242-697) - Notice
Phil Christiansen presented plans for a single family home The
driveway and some clearing is in the buffer zone R Doucette
recommenced the lawn should not extend further than the "cleared
area" shown near flags B3 - B21 Motion by P Tariot and seconded
by K Foley to close the public hearing and issue a decision
within 21 days Vote unanimous
Lot 5 Turnpike (#242-699) - Notice
Steve Stapinski presented plans for a single family home in the
buffer zone Mr Otten expressed concerns about the wetlands
near Tucker Farm Motion by K Foley and seconded by P Tariot to
close the public hearing and issue a decision within 21 days

Abutter, Wolford supported the amendment Motion by K Foley and
seconded by P Tariot to close the public hearing and issue a

Lot 6 Bruin Hill (#242-448) - Partial Bond Release
R Doucette recommended full bond release if Planning Board has
sufficient bond funds to complete the detention pond As-Built
Motion by K Foley and seconded P Tariot to issue the full bond
release if the Planning Board holds sufficient bond monies to
produce an acceptable As-Built plan of the detention pond Vote
unanimous
DECISIONS
