HomeMy WebLinkAbout1994-07-06 Conservation Commission Minutes NACC MINUTES JULY 6 1994 PRESENT George Reich Al Manzi Joseph Lynch Deborah Feltovic Robert Mansour Richard Doucette Administrator MINUTES Motion by R Mansour and seconded by J Lynch to adopt the minutes of June 15 1994 OLD BUSINESS Andover Sportsman's Club R Doucette gave an overview of the violation which was previously reported Steve Erickson presented a plan showing the approximate edge of wetland and amount of filling Discussion of location and amount of restoration area R Doucette will meet with the applicant in the field to discuss the location of the Restoration Area Butcher Boy Mall (242-504) - Extension Mr Yameen and others appeared and requested an extension Discussion of re-flagging Recommendation by R Doucette to issue a 30 day extension to re-flag the wetland Motion by R Mansour and seconded by D Feltovic to issue a 30 day extension Passed unanimously Discussion of construction sequence Woodland Estates (242-634) - Discussion Bill Bergeron of Hayes Engineering appeared to get the Enforcement Order lifted R Doucette recommended lifting the Enforcement Order Discussion of construction sequence The first crossing was discussed The applicant wants a temporary crossing R Mansour opposed the temporary crossing All Commission members present also opposed temporary crossing A letter showing names and numbers of supervisors and a construction sequence is needed Motion by G Reach and seconded by A Manzi to lift the Enforcement Order Passed unanimously Staffing Discussion Susan Ford appeared and discussed her new role and her background The list of proposed pro3ects and the possibility of hiring an Intern was also discussed R Doucette would lake the NACC to review the pro3ect list and discuss it on July 20 NACC 7/6/94 Page 2 NEW BUSINESS Woodchuck Grove (242-475) - Discussion Adele Fiorillo of Wetlands Preservation, Inc. presented revised plans (new delineation) and wetland replication plan. Re- flagging shows 8, 000 s. f. more wetlands. The approved project required 3, 000 s. f. of wetland fill. The new delineation shows 6 , 000 s. f. of wetland fill. R.Doucette recommended approving Wetlands Replication plans and urged the applicant to move ahead on the proposed re-design which would create a much better project. Motion by J.Lynch and seconded by D.Feltovic to approve the wetland replication plans and re-delineation. Vote unanimous. PUBLIC HEARINGS Lot 6 Turnpike Steve Stapinski presented plans for a single family home in the buffer zone. Motion by J.Lynch, seconded by A.Manzi to issue a Negative 13 Determination with erosion controls. Vote unanimous, Lot 4 Sharyners Pond Road Phil Christiansen presented revised plan dated 7/6/94 showing a vernal pool. Impacts on vernal pools were discussed. The plans should be rev-' sed: 1. move house approximately 201 2 » control erosion and limit of work 3 . control erosion for well for driveway Motion by G.Reich and seconded by A.Manzi to issue a Negative Determination upon submittal of revised plan. Vote unanimous. Osco Drct R.Doucette gave an overview of the drainage issues and outside review. Paul Marchionda presented his findings. Mr. Walker presented revised plans dated 7/7/94 showing revised grading and drainage modifications. J.Lynch discussed sump pump. S.Cote commented on the drainage issues. Motion by J. Lynch and seconded by A.Manzi to close the public hearing and issue a decision with 21 days. Neadowood III Ward Smith of NEE Inc. reported on the third party delineation. The wetlands area has been expanded somewhat. Discussion of using soils as part of the delineation. Motion by J.Lynch and seconded by R.Mansour to accept the delineation. Vote 2-3 , J.Lynch and R.Mansour for and D.Feltovic, G.Reich and A.Manzi NACC 7/6/94 Page 3 against The applicant was directed to move forward at their own risk until DEP confirms the use of soils in this case Motion by R Mansour and seconded by J Lynch to accept the delineation contingent upon DEP's lack of opposition to the methodology using soils Vote 3-2 J Lynch and R Mansour against Motion passed Motion by J Lynch and seconded by A Manzi to continue the public hearing to 7/20 Lots 1-5 Great Pond Road Steve Stapinski requested a continuance to July 20 to revise the plan per the Planning Board input Also,outside review of Normandeau report is not yet complete Motion by A Manzi and seconded by J Lynch to continue to 7/20 Unanimous Lot A Foster Street Ben Osgood, Jr presented plans for a single family home in the buffer zone to a bordering vegetated wetland and IN the floodplain R Doucette read the portions of the local/state regs regarding flood storage and compensation The NACC has not allowed such filling without compensation in the past R mansour discussed the sizing of the 12" culvert A Manzi no longer in attendance Applicant should provide Calculation of sizing 12" pipe construction detail on installing bentonite clay barrier and notification of abutters who live anywhere in the floodplain Abutter Mr Lynch had concerns of driveway on the right and Mr Martineau discussed flooding Lot 1A Sharpners Pond Road Motion by G Reich and seconded by J Lynch to continue the public hearing to 7/20 at the request of the applicant NEW BUSINESS (continued) Lot 18 Rocky Brook R Doucette stated the approved plan is 'not in the file How can we modify a site plan without knowing what the approved plan looks like?
