HomeMy WebLinkAbout1994-07-20 Conservation Commission Minutes NACC MINUTES JULY 20 1994 PRESENT George Reich Joseph Lynch Al Manzi Barbara Varoutsos Deborah Feltovic Kevin Foley Richard Doucette Administrator MINUTES Motion by J Lynch and seconded by B Varoutsos to adopt the minutes of July 6, 1994 OLD BUSINESS #300 Salem Street B Olenio appeared andf responded to R Doucette's letter He wishes to mow his no-cut zone R Doucette went over the need for a no-cut zone A Manzi motioned to allow a groundcover no mowing or wood chips seconded by J Lynch Vote 4-0-1, G Reich abstained Andover Sportsmans Club - update on violation No filing yet Discussion of fine G Reich motioned to issue a fine not to exceed $200, D Feltovic seconded Vote unanimous Phase II Sewer (242-517) - Partial Bond Release M Gioso and T Viola appeared to recommend a partial bond release R Doucette recommended issuance of a $5 000 bond release contingent upon removal of the silt fence Motion by A Manzi and seconded by L Lynch to release the $5 000 Vote unanimous Lot A Marbleridge Road (242-685) - Modification Mr Donahue requested a modification and submitted a letter dated July 19 and sketch Motion by D Feltovic and seconded by A Manzi to accept the modification Vote unanimous Kevin Foley now in attendance Rocky Brook Estates (242-392) - Disc /Modification T Neve appeared and submitted plans for Rocky Brook which the Commission requested at our last meeting Motion by A Manzi and seconded by J Lynch to accept the plan dated 8/30/89 as a modification Vote 5-0-1 K Foley abstained Lot 18 Rocky Brook (242-392) - Modification Motion by G Reich and seconded by A Manzi to accept the revised plan submitted last week as a modification once that plan is compared to the 8/30/89 plan 3ust submitted Vote unanimous NACC 7/20/94 Page 2 NEW BUSINESS Love Prgperty - Discussion of wetland crossing and PRD densit Tom Neve and Dave Kindred presented conceptual plan for a subdivision. The Commission needs to provide feedback to the Planning Board regarding PRD density. Would the Commission allow the crossing which accesses 5 of the 14 lots? Discussion of limited project. Motion by A.Manzi and seconded by D.Feltovic to inform the Planning Board that the Commission would approve the crossing. Motion by J.Lynch and seconded by K.Foley to amend the motion to amend the motion to suggest the applicant help solve the floodplain issue on the adjoining Martineau proposal. Vote unanimous. Hitching Post Road (242-429) - Discussion of eLcpired file R. Doucette gave an overview. Curt Young spoke and presented plans. First City wants to complete some work on the drainage system under an Enforcement Order. J.Lynch discussed the policy of not issuing Enforcement Orders for such an issue but since the Town is somewhat at fault, the Commission should issue an Enforcement Order to finish the whole project. G.Reich expressed that he would not allow the entire project to be completed, but is open to discussing allowing some work to be completed. P.Quinn spoke about the law suit and past litigation. K. Foley stated the old OOC is not something we would approve today and individual filings would be required for two or more lines. G.Reich is not comfortable with allowing all the work to be done under an Enforcement order. A.Manzi supports the use of an Enforcement Order. R.Doucette recommended issuing an Enforcement to allow stabilization, erosion control, complete drainage work in the vicinity of the siltation basin and retention pond, bring road to sub-grade and post $1 in old bond. R.Doucette stated a new Notice of Intent will be required for finishing road, utilities, houses, etc. A.Manzi moved to accept R.Doucette's recommendation, G.Reich seconded. Vote 4-2 , J.Lynch and K.Foley against. Discussion of Intern and use of wetland filing fees R.Doucette discussed the project list and the use of Wetland Filing Fees for a stipend for an Intern. J.Parino was in attendance. R.Doucette recommended $100 per week, approximately three days per week, 10 weeks to the end of September. Motion by K.Foley to use $1, 000 from the Wetland Filing Fees as a stipend as recommended, seconded by A.Manzi. Vote unanimous. PUBLIC HEARIKG3 Meadowood 111 (242-700) subdivision (Cont. to 7Z20) Steve Stapinski spoke about ongoing revisions of the subdivision plan and discussion with the Planning Board. S.Stapinski NACC 7/20/94 Page 3 requested a continuance for the purposes of redesign as discussed R Nardella spoke on the need for a roadway connection Discussion of permitability of the roadway connection/wetland crossing R Doucette stated the NACC has not seen any plan for the adjacent project and should not change its (negative) opinion until they have a plan to review K Foley questioned the traffic study The traffic flow was discussed J Lynch asked which part of the filing was the connecting road in S Stapinski proposed two filings, one for the subdivision and one for the road Discussion of the wetland crossing continued Motion by J Lynch and seconded by G Reich to continue to August 3 Vote unanimous Lots 1-5 Gt Pond Rd/Marbleridge (242-696) 5 homes (Cont to 7/20) Steve Stapinski indicated that Sanford Ecological Services and the applicant are working out various water quality issues S Stapinski requested an extension to the next meeting Motion by A Manzi and seconded by B Varoutsos to August 3 Vote 5-0-1 K Foley abstained Lot A Foster Street (242- ) new home (Cont to 7/20) Ben Osgood presented revised plan and a letter in response to the Commission's concerns J Lynch discussed the possibility of replicating the lost flood storage on the Love property as discussed earlier tonight Motion by A Manzi and seconded by B Varoutsos to continue to August 3 Wetland line to be reviewed and initiate discussion with Kindred Vote unanimous Lot 1A Sharpners Pond Road (242- ) - new home (cont to 71M Tom Neve presented plans for a single family home R Doucette recommended approval of the plan Motion by K Foley and seconded by B Varoutsos to close the public hearing and issue the decision within 21 days Vote unanimous Al Manzi no longer in attendance Lot 2 Turnpike (242- ) - new home Steve Stapinski presented plan for a single family home 37 ' from the bordering vegetated wetland R Doucette indicated that the work is close to the bordering vegetated wetland Is there a deck'?
