MINUTES
Motion by Albert P Manzi, Jr and seconded by Joseph Lynch to
accept the minLtes of the August 17 , 1994 meeting
OLD BUSIh-ESS
Lake Cochichewick ACEC - Discussion
The Commission held a discussion and stated that they would meet
with the Board of Selectmen within the next couple of weeks
Lot 25 Tanglewcod Dr (242-657) P Compliance
Bob Messina of Messina Construction appeared before the
Commission and requested release of the $1 000 bond Mr Messina
is waiting for the grass to grow on slope The Commission
discussed the matter with Mr Messina
Motion by Robert Mansour and seconded by Albert Manzi to approve
the request to release the $1 000 bond Vote unanimous
North Andover Estates (242-585) - Discussion
Albert Manzi stated that he reviewed the site three times within
the last week during rainstorms Chestnut Street and Wildrose
Drive are not draining Reference was made to a letter dated
September 20 _993 which listed six specific conditions These
conditions have not been complied with Siltation is entering
Mosquito Brook Robert Mansour stated that Elm Street Service
Corp issued original bond Joseph Lynch stated that the bond
rides with the title of the land Mr Lynch suggested that
George Reich send a letter to the land owners Mr Manzi stated
that the applicant is burying them with paper There is one and
one-half to two miles of siltation running Joseph Lynch stated
that he has gore to Mosquito Brook two to three times since last
meeting and he suggested dredging of detention George Reich
suggested that a letter be sent to Toll Brothers asking them to
come to the next meeting
Motion by Albert Manzi seconded by Robert Mansour that they are
not in compliance with the letter of September 20 1993 and
request is made for them to attend the next meeting Vote
unanimous

Steven D'Urso appeared before the Commission and spoke on this
item
Motion by Joseph Lynch to move for compliance, seconded by Robert
Mansour Vote unanimous
Lots A,B C Marbleridge Rd (242-661) - Compliance
No one was present for discussion
Lot 14 Lancaster Rd (242-673) - Compliance
Albert Manzi spoke on this item This is his project It is an
agricultural road He stated that Richard Doucette was satisfied
with the project There is no bond on this project The
Commission has a note from Richard Doucette
Motion by Robert Mansour to issue compliance seconded by Joseph
Lynch Vote 5-0-1, Albert Manzi abstained
Lot A Marbleridge Rd (242-685) - Compliance
Julie Parrino stated that she was on the site with Richard
Doucette The site looks good except for full stabilization of
growing grass and some wetness to the right of the driveway
Motion by Albert Manzi to issue full compliance seconded by
Robert Mansour Vote unanimous
Crouch Machinery (242-427) - Compliance
Joseph Cushing of Richard Kaminski Assoc appeared before the
Commission -ie stated that he believes the Commission has a
letter from Mr Richard Doucette recommending issuance of
compliance Julie Parrino stated that she was with Mr Doucette
on the site an3 observed stabilization
Albert Manzi moved for issuance of full compliance seconded by
Deborah Feltovic Vote unanimous
DECISIONS

Discussion by George Reich No proof of mailing to abutters no
drainage calculations and second crossing not a limited project
Motion by George Reich to deny seconded by Albert Manzi Vote
unanimous
George Reich informed the engineer that the applicant may re-
apply
Lot 1 Ingalls 5t
Joseph Lynch spoke with Richard Doucette regarding this matter
The bond is for $3 000 This is a single-family There are 20

PUBLIC HEARING
Lot 8 Hillside Rd
Albert Manzi read the Legal Notice Curt Young appeared before
the Commission and presented a plan before them He stated that
Richard Doucette made minor modifications There were questions
on flagging A" or A6 New flags have been established in the
field The Contarino family once lived on Lot 9 The area
closest to Old Center backs into Chestnut Street The Commission
stated they wi_l walk the site Mr Philip Busby of 303 Chestnut
Street stated that he wanted to walk the site with the
Commission Curt Young stated that there is vegetative wetlands
Mr George Reich stated that a the walk of the site would be
scheduled at the end of this meeting Curt Young submitted a
letter to the Commission asking for a continuance
Motion by Albert Manzi to continue to September 21 seconded by
Deborah Feltov±c Vote unanimous
Lot 3 Christmas Tree Est
Albert Manzi =ead the Legal Notice Philip Christiansen the
engineer for the applicant was present Single family home 90
feet within we--land, 5,900 feet of buffer zone disturbed
Motion by Kevin Foley seconded by Deborah Feltovic to issue a
negative determination with erosion controls Vote unanimous
Meadowood III
John Soucy was present and appeared before the Commission
George Reich stated that he received revised plans and drafted a
decision
Motion by Kevin Foley to close the public hearing and issue a
decision in 21 days seconded by Albert Manzi Vote unanimous
Lot 13A Equestrian Drive (242-708
Steve D'Urso was present and appeared before the Commission A
site walk was conducted the end of August He stated that
Richard Doucette agreed with the line as flagged The righthand
corner may be staked incorrectly or topo at that house corner is
not quite representative Haybales are not reflected on plans
Joseph Lynch will write conditions
Motion by Kevin Foley to close the public hearing and issue a
decision in 21 days, seconded by Albert Manzi Vote unanimous
Lot 2 Halifax/Den Rock View (242- ) new home
Philip Christiansen was present and appeared before the
Commission He presented a plan to the Commission This is a
single family home on lot of Halifax Street end of paved way
Wetlands cut across the lot Wetland crossing is 580 s f and

they are compensating with 780 s f This is lot 2 Halifax
Street The house is 50 ' from wetland line This is for
subdivision roadway construction There was discussion regarding
reflagging Discussion regarding lots 5, 6 7 common ownership
Discussion on Den Rock View Subdivision/Dryad & Belfast (242- )
was discussed at this time This is a paper street (Dryad
Street) the permit expired could not be renewed Request had
to be re-filer- The plan viewed was approved in 1991 The
flagging is tgree years old Loam has been removed The
Commission requires re-flagging They will conduct a site visit
after the flagging Robert Mansour discussed both plans with Mr
Christiansen
Curt Young stated Richard Doucette checked Halifax about one and
one-half years ago Mr Dave Kindred stated that he will be
acquiring this lot and hopes issues can be settled quickly
Motion by Kevin Foley, seconded by Albert Manzi to continue Lot 2
Halifax/Den Rock View to the next meeting Vote unanimous
Motion by Kevin Foley seconded by Albert Manzi to continue Den
Rock View Sub /Dryad & Belfast to the next meeting Vote
unanimous
Lot 2. 2A Abbott St (242-709) - new home
A Manzi read the Legal Notice Mr John Soucy of Merrimack
Engineering addressed the Commission The DEP No is 242-709
Mr Soucy presented the Commission with a plan Julie Parrino
brought a matter of interest to the Board regarding the
delineation She stated that Richard Doucette talked with Steve
D'Urso on yesterday An abutter inquired about wildlife species,
birds, etc Mr Soucy responded to the abutter Robert Mansour
stated that the engineer is within the state's guidelines
Motion by A Manzi to continue this to two weeks seconded by
Kevin Foley Vote unanimous
Hitching Post Rd (242- 712 ) - completion of subdivision
Kevin Foley read the Legal Notice Curt Young appeared before
the Commission and displayed a plan before them There was
discussion on road grading completion of roadway and utilities
Lots 13 & 14 wculd require Notice of Intent to be filed prior to
homes being built The enforcement order allowing completion of
the project has been satisfied The sedimentation basin is in
Roadway drainage is functioning All connections are made Road
currently at sLbgrade prepared to put hottop on grass is high
Mr Jim Phaler of Appleton Street asked questions about the
drainage between Lots 10 & 11 It was stated by Curt Young that
all utilities are coming from Appleton Street Mr Young further
stated that Lot 12 has a buffer zone Jeff Crouger of Appleton

Street asked about drainage. There is a detention basin in the
green area of Curt Young' s plan. It will remain a basin for
runoff.
Motion by A. Manzi to close the public hearing and issue a
decision, seconded by J. Lynch. Vote unanimous.

Continued to September 21.
DECISIONS
Lots 1-5 Great pond/Marbleridue
The Board discussed Richard Doucette ' s draft Order of Conditions.
Motion by J. Lynch to accept as drafted and discussed, seconded
by A. Manzi. Vote unanimous.
Meadowood III
This is a 27 home subdivision. K. Foley made a motion to issue
the Order of Conditions as amended, seconded by A. Manzi. Vote
unanimous.
Hitching Post
Plans are by Eastern Land Survey. Buffer zone only. 242-429 was
original file number. Erosion control not required on site plan.
$5, 000 Bond.
Motion by A. Manzi to adopt order as written, seconded by D.
Feltovic. Vote unanimous.
OTHER
At this time, the Commission discussed the site visit to Lot 8
Hillside. "They stated that they will visit on Wednesday,
September 14, 1994 at 6: 00 P.M.
G. Reich made a motion to adjourn at 10 : 15 P.M. , seconded by A.
Manzi. Vote unanimous.
