Discussion Mr Philip Christiansen of Christiansen & Sergi and Mr James Griffoni were present Mr Christiansen stated that the lot is in compliance pending a final site visit There was discussion regarding stump and metal debris which needed to be removed J Parrino stated she conducted a site ' visit and noted stump removal There were questions regarding additional debris within 100 feet Mr Christiansen made a note that he complied with a plans The Certificate of Compliance certifies that the Order of Conditions must be met Mr Christiansen stated he felt that was unfair because he cannot always overlook conditions that should have been met by the builder Mr Griffoni claims that extra metal debris is not on Lot 5 He claims he shouldn't have the responsibility to clean all the debris A site visit will be conducted by the Commission North Andover Estates (242-585) - Discussion A Manzi stated that the pro3ect is very active and on-going A hydro-engineer has been hired There was discussion that the detention ponds might increase j #280 Dale Street'- Discussion The applicant was not present for discussion 1 NACC Minutes 10-05-94 2 NEW BUSINESS Lot 1 Rock Road (242-021) - Compliance Attorney Andrew Caffrey was present He is representing Mr & Mrs Jacob (Lot 1) 8 Rock Road An Order of Conditions was issued in 1977 The Order of Conditions pertain only to the roadway There is Partial Compliance for Lots 8-64 Attorney Caffrey is seeking Partial Compliance for Lot 1 only The engineer's letter for Lot 1 was present in the file J Lynch made a motion to issue Partial Compliance for Lot 1 only,�IAseconded by B Varoutsos Vote unanimous ly #1780 Osgood Street - Bond Release The applicant was not present to discuss this request Lots 2, 3 , and 4 Boxford Street (242-663) - Compliance The applicant was not present to discuss this request � a OTHER At this time there was discussion by the Commission regarding a change in the wordingtjof #39 in the Boilerplate J Lynch will draft revision and present it to the Commission PUBLIC HEARINGS Lot 27A (#31) Tanglewood Lane r Beth Ellen Hopkins the owner/applicant was present A Manzi walked the site with the applicant on October 5, 1994 A plan was presented which was in accordance with�fthe site A Manzi recommended a Negative Determination with Erosion Controls B Varoutsos questioned the slope The grade of the yard was never finished off in the past J Lynch made a motion for Negative Determination with the condition that erosion controls must be installed as discussed on the site visit seconded by A Manzi Vote 4-0-1 B Varoutsos abstained Lot 7 Old Cart Wav - Notice The site walk was October 1 1994 at 8 00 A M The issues at the first meetin4' iSeptember 21 1994 were addressed The engineer and the applicant need to provide laundry list for application It will not be ready at this meeting NACC Minutes 10-05-94 3 J Lynch made a motion to continue to the next meeting October 19 1994 seconded by A Manzi Vote Unanimous 149 Lancaster Road, Lot 41 - Request for Determination Mr Mike Polito of Custom Quality Pools was present Mr Polito represents the owners of the property, Mr & Mrs Katzman A Manzi abstained from this matter because he is an abutter and he did not receive a notice The request is for installation of an inground gunite swimming pool The proposed pool is not near the construction line The property is on town sewer J Lynch wants to see a pool apron or patio surrounding the pool J Lynch made a motion to issue a Positive Request for Determination seconded by D Feltovic Vote 4-0-1 A Manzi abstained Lots 141-147 Maplewood Avenue - Request for Determination J Lynch abstained Request is for a single family residence driveway utilities landscape and other appurtenant improvements A site walk was conducted at this property on September 26 1994 at 6 00 P M Mr Kurt Young of WPI submitted a letter describing his opinion on the proposed site Small wetland 95 ft from corner of lot Mr Thomas Dilello of 12 Rosedale was present he is representing homeowners He questioned the slope of the land and inquired if the wetland area is within the Lot concern is water runoff Bob Dawe abutter on other side of Maplewood expressed his concern that the applicant will build a road the Commission is only voting on SFH and driveway B Varoutsos made a motion to issue a Negative Determination of Applicability seconded by D Feltovic Vote 3-0-2 J Lynch and K Foley abstained Sutton Street Relief Sewer - Emergency Certification - Request for Determination Ben3amin J Fehan, P E of LEA GROUP, INC was present Discussion ensued regarding the sewer in Sutton Street being undersized raw sewage is flowing into the roadway LEA GROUP INC will replace the current pipe with a larger pipe The construction is within the roadway in a straight line The 27" RCP sewer will be installed through the top of the culvert parallel to the existing 15" pipe The Commission discussed the emergency enforcement order A Manzi made a motion to close the hearing and issue the Emergency Certification in 24 hours seconded by D Feltovic Vote unanimoas NACC Minutes 10-05-94 4 Lot 2 Halifax/Denrock View- (242-710) - Notice and Den Rock View Subdivision Lots 3.4.5. 6.7 8 Dryad & Belfast (242-711) - Notice Mr Philip Christiansen of Christiansen & Sergi was present representing the applicant 242-710 - Lot 2 Halifax Street is for proposed work consisting of construction of a single family dwelling and driveway After discussion, J Lynch made a motion to close the public hearing and issue Orders of Condition seconded by K Foley Vote unanimous 242-711 - Den Rock View Subdivision Dryad Street and Belfast Street Lots 3 4 5 6 7 8 is for construction of a roadway in the existing right of way of Dryad Street and Belfast Street Also included is a sewage pump station and a detention recharge area After discussion J Lynch made a motion to close the public hearing and issue Orders of Condition seconded by K Foley Vote unanimous Lot 2. 2A Abbott Street (242-709) - Notice Steven J D'Urso and John Soussa were present The area was re- flagged Map with color codes showing delineation was presented to the Commissions A Manzi agreed with the new delineation Steven D'Urso claimed there was a new herbaceous layer An abutter questioned an area stating it is not delineated correctly and wants to have her own botanist Questions of what will happen is she proves delineation to be different There is already a waiver for the driveway An abutter raised a concern regarding water problems in the future The house footprint is not actual size The Commission made it clear to the abutter that the Order of Conditions and the bond will protect her rights J Lynch made a motion to close the public hearing and issue a decision within 21 days with the condition that a revised wetland boundary plan be submitted to the Commission seconded by K Foley Vote unanimous Lot A Foster Street (242- - Notice The applicant was not present for discussion Motion by J Lynch and seconded by A Manzi to continue to next meeting October 19 1994 Vote Unanimous Lots 1-6 (#989) Salem Street /Woodchuck-Pinewood (242- ) Two abutters were present Mr Halloran and Mrs Pouillot Continued hasn't been opened Motion by K Foley to continue to next meeting October 19 1994 seconded by A Manzi Vote Unanimous NACC Minutes 10-05-94 5 37 Anne Road, Map 37B, Lot 0053 (242- Ron Pica of R J Engineering Co Inc was present The plan proposes to construct a covered bridge over an existing paved driveway Existing driveway was a wetland crossing The applicant claims wetlands were created The area is flagged A Manzi questioned correct delineation No additional disturbance to wetland proposed K Foley questioned final compliance on previous work crossing replication The applicant claims bond was released Concerns of fire hazards were addressed The applicant claims the site has been approved by the Fire Department The Commission stated that the applicant must also file for a building permit The Commission may hire an outside consultant A Manzi would like to look at flagged wetland Motion by K Foley to continue to the next meeting, October 19 1994 seconded by D Feltovic Vote Unanimous Lots 1-6 (#989) Salem Street -
